Questionnaires

(PPQ)

The DRFP implies a requirement to send out PPQs 15 days after release of Formal RFP. Contractor requests additional time in order to firm up execution supplier/partner selection strategies and proposal strategies.

We recommend that the requirement for release of PPQ be extended to at least 45 days after RFP release.

Verbiage under 4.4.1 has been updated from "shall" to "strongly recommended" to ensure responses are received in a timely manner.

2 Section L Past Performance 4.5 9 Recent Relevant Contracts

The DRFP requires a maximum of 3 recent, relevant contracts. It is not defined whether these are Prime Contracts only or must include Subcontractor contracts if they are performing a significant portion of the proposed workscope. Since there is no clear requirement to include subcontractors, an Offeror could potentially use their past performance contracts that may not be relevant to the instant proposal, resulting in unaccounted for or masked execution risk. In order to ensure that past performance more accurately reflects potential future performance, we recommend the following:

a. Require a minimum of 3 and a maximum of 5 past performance contracts;

b. Require at least 1 past performance contract from each Subcontractor projected to perform at least 20% of the proposed value.

The government considers 3 contracts sufficient to clearly show a contractor's past performance. Relevant subcontractor performance under a prime contract may be considered. It is advised that contractors select contracts that most strongly support recent and relevant performance for this acquisition.

6 Task #3: -33 Wing Production

Para. 2.2.3 states: "The prime contractor shall not begin assembling of any production units until final inspection and acceptance of the First Article wing."

Additionally, the USAF Government has provided a definition of their BEQ and estimated delivery schedule. The schedule provided indicates a first production delivery two months after the first article acceptance has been approved. In the event that the First Article approval date slides, will the subsequent production article delivery dates be adjusted accordingly?

The PCO will consider the situation on a case-by-case basis if/when it occurs.

1 Calendar Year The BEQ states that "All years shown in tables are calendar years (CY)".

What are the start and end dates of each calendar year? Are they January to December or November to October (based on Contract Award in November 2019)?

1 Ordering Period The Order Quantity for CY 2019 is 40. When is the most likely order date for the initial quantity of 40?

1 Ordering Period For Option years, what is the most likely order date for follow-on quantities (1st, 2nd, 3rd, or 4th quarter of each Calendar Year)?

Orders will be placed in January/February of each year.

3 Contract Minimum The contract Production Article minimum is established as 40.

Additionally, based on the BEQ information it appears this will be odered all in Ordering Period (Year 1) in a single order. However, this is not specifically stated in the schedule. Would the Government please clarify their intent on how they plan to order the Contract Minimum of 40 Production Articles?

Initial award will include the basic contract and first delivery order of 1 First Article and 40 Production Articles.

Single or Multiple Awards

FAR 52.216-27 Single or Multiple Awards (OCT 1995): Per prescription FAR 16.506(f) this clause should be inserted if the Government intends to award multiple contracts for the same or similar advisory and assistance services to two or more sources under this solicitation unless the Government determines, after evaluation of offers, that only one offeror is capable of providing the services at the level of quality required.

Section M of the model contract states that the Government intends to award a single award, firm fixed price contract. Please confirm applicability of this clause? Request this be removed if it doesn’t apply.

The government intends to award a single contract. This clause has been removed.

Privacy Training FAR 52.224-3 Privacy Training (JAN 2017): Per 24.302 This Clause is required in contracts that The Contractor shall ensure that initial privacy training, and annual privacy training thereafter, is completed by contractor employees who--

(1) Have access to a system of records;

(2) Create, collect, use, process, store, maintain, disseminate, disclose, dispose, or otherwise handle personally identifiable information on behalf of an agency; or

(3) Design, develop, maintain, or operate a system of records (see also FAR subpart 24.1 and 39.105).

Please confirm applicability. Request this clause be removed if it doesn’t apply.

Production Progress Reports

FAR 52.242.-2 Production Progress Reports (APR 1991): Generally this clause would be accompanied with reporting instructions in the contract schedule of a Contract Data Requirements List (CDRL). Will there be a CDRL reporting requirement for this clause? If there will not be a CDRL, request that this clause be removed. If this is applicable, will this CDRL be released with the final RFP?

This clause is not applicable and has been removed from the RFP.

Please confirm applicability of this clause since a small business plan is required and should be prepared in accordance with 252.219-7003 and 52.219-9. Request this clause be removed if it doesn’t apply.

Per prescription 223.7304 Exceptions this clause does not apply to paragraph (a) Legacy systems and their related pats, subsystems, and components that already contain hexavalent chromium. Please confirm applicability of this clause. Request this clause be removed if it doesn’t apply.

Mandatory Payment by Government-wide Commercial Purchase Card

DFARS 252.232-7009 Mandatory Payment By Government-wide Commercial Purchase Card (MAY 2018): Per prescription 232.1110 this clause applies to payments for orders or calls that are valued at or below the micro-purchase threshold. Please confirm applicability. Request that the clause be removed if it doesn’t apply.

#4.5.2

Hazardous Material In paragraph 4.5.2 of the SOW “Hazardous Material” states that a copy of the prime contractor’s Test Report and signed certification that the package configuration meets both CFR and UN requirements and shall be made available to the procuring contract office, as required, prior to acceptance or shipment of any portion of the product IAW CDRL requirements (Reference AFMC Form 158) however, the CDRL was not included as part of the RFP. Please confirm applicability of 4.5.2. If 4.5.2 is applicable please the CDRL and if it doesn’t apply recommend the language be removed or tailored.

This paragraph is not applicable and no further CDRL will be required. Please note last sentence stating that if this paragraph is not applicable to disregard.

Economic Price Adjustment (EPA)

Paragraph 4 of the SOW outline the Economic Price Adjustments conditions and requirements however, there is not a corresponding economic profit adjustment clause in Section I of the model contract.

Please confirm if a FAR or DFARS will be added for Economic Profit Adjustment upon release of the formal RFP.

The EPA clauses found in the FAR and DFARS were not specific enough for this requirement so the Government wrote a tailored statement for the EPA and included in the SOW only.

16 Solicitation/Contract SECTION I Contract Clauses

Progress Payments Paragraph G (the second paragraph G) of Section A of the contract states that the contractors can submit customary progress payments for first article and production articles in order to procure long lead items however, FAR 52.232-16 Progress Payments is not included in Section I of the contract. If 52.232-16 is applicable to this effort Boeing requests that it be added to the solicitation.

Government Property

Paragraph F of Section A of the contract states that a GFP List is Attached as Attachment F to the SOW however, 52.245-1 Government Property is not included in the solicitation. If 52.245-1 is applicable to this effort Boeing requests that it be added to the solicitation.

252.227- 7013, - 7014 & -

Rights in Technical Data

The solicitation contains 252.227-7032 RIGHTS IN TECHNICAL DATA AND COMPUTER SOFTWARE (FOREIGN), which is applicable only to contracts with foreign contractors to be performed overseas, however, DFARS 252.227-7013, -7014 & -7017 are not included in the solicitation. Please confirm if these additional DFARS (DFARS 252.227-7013, -7014 & -7017) should be included in the solicitation.

19 Solicitation Att. L-6 Total Evaluated Price (TEP)

Please provide the TEP in Excel format with formulas in the Final RFP. TEP is in Excel format in Final RFP.

20 Solicitation Section L and M L-3.4.2.1 and M- 3.2.2.1

IMP/IMS Section L 3.4.2.1 and M 3.2.2.1 do not mention the word “schedule”. The word “plan” is used. In the Cross Reference Table (Sect L Attachment 7), for L 3.4.2.1 & M 3.2.2.1, both CDRL A001 Integrated Master Plan and CDRL A002 Integrated Master Schedule are referenced. Question: Is it the intent of the Government to receive BOTH the IMP and the IMS as part of the offeror response to Section L 4.3.2.1.

Recommendation: Revise the wording in Section L to read “As part of the Integrated Master Plan and Integrated Master Schedule, the offeror shall provide the details of the Offeror’s proposed process………..”

Revise the wording in Section M to read “This sub-element is met when the Offeror’s proposed Integrated Master Plan and Integrated Master Schedule demonstrates an approach that clearly identifies the following……..”

The Cross Reference Table has been updated to only reference CDRL A001 under Sub Factor Two (Program Management).

The Government wants to understand the overall plan to acquire materials, complete first article, and then meet full rate production of 3 wings per month. A complete IMS isn't required until after contract award.

21 Solicitation Section L and M L-2.19.4 and M-3.2.2.1IMS Background Info: Section L 2.19.4, Electronic Offers, Section M 3.2.2.1. In order for the Government do an in depth evaluation of the IMS, it is necessary for the Offeror to provide the Microsoft Project (.mppx) file with as part of the Electronic submission.

Question: Is it the intent of the Government to receive the Electronic File for the Integrated Master Schedule?

Recommend: Revise Section L 2.19.4 to include the format for Microsoft Project .mppx

A complete IMS isn't required until after contract award. There is no need to submit a completed schedule in Microsoft Project.

22 Solicitation Section L L-3.4.2.1 IMS Is it allowable for the full Integrated Master Schedule to be submitted as an attachment that is not page limited?

The page limits are firm and a complete IMS is not required until after contract award.
