Answers to Industry Questions to Draft RFP #5 Posted 27 March 2019
1) The CLIN structure in the model contract is a basic structure providing guidance on how individual task orders are to be structured. The table under each CLIN in the model contract provides guidance on how the CLIN structure is to be built for task orders that contain options.
Section J, Attachment 5, Pricing Matrix, provides the determined CLIN structure for each of the awardable tasks for every ordering period and contract option for the length of the contract. Each tab in this attachment represents its own contract option period. As the awardable tasks will all be yearly orders, they do not contain options. Therefore the table under each CLIN in the model contract does not apply to the awardable tasks.
2) CLINs 0004, 1004, 2004, 3004, 4004 & 5004 and Section L Paragraphs 3.2.2.1 & 3.2.2.2 have been updated to remove discussion on unburdened material and travel cost estimates.
3) If projected labor rates exceed the 5% threshold in accordance with the H.004 Labor Rate Adjustment Clause, it would not result in an automatic modification to the Labor Rate Matrix. It would be the Government’s duty at that point to make a fair and reasonable determination and negotiate to a fair and reasonable amount prior to the modification being executed. The Government is not aware of any scenario at present in which the modification would not be executed were a fair and reasonable determination made, but the Government intends to provide itself the flexibility to make the determination not to make the change should a valid reason arise that would have a negative impact on the Government and/or contract.
4) FAR Clause 52.216-18 and DFARS Clause 252.216-7006 have been updated to reflect the correct ordering period of 30 Jun 2020 – 29 Jun 2038.
5) HAC/RMPE budget in Section L, Table 1 has been updated for contract years 1 and 2 to account for dual baseline.
6) Section L Paragraph 2.3.2.4 (Sample Task Four) has been updated to clarify that “other requirement traceability gaps” refers only to COP 3.2.
7) Evaluation of the Sample Task Prices will remain in the TEP. Including the Sample Tasks in the TEP provides the ability to connect the offeror’s technical solution to cost and provides the offeror the opportunity to price efficiencies and/or innovation into its approach.
8) The TEP calculation formula was developed in order to tie the cost evaluation to the offeror’s technical solution instead of solely performing a rate evaluation.
9) Section M, Paragraph 3.7 has been updated to clarify that the Government-developed Sample Task Multiplier and the Notional Hours will be the same for all offerors.
10) The intent of the Government not providing required education and years of experience for the Labor Category Descriptions is because the Government recognizes that the offerors understand best the talent they need to hire in order to fulfil the GSSC 2.0 requirements.
11) A SME Labor Category has been added to Section J, Attachment 7, Government Labor Category Descriptions
12) All missing Labor Category Descriptions have been filled in for Section J, Attachment 7, Government Labor Category Descriptions.
13) Section J, Attachment 9, Labor Hour Summary, will not be used to determine the notional hours. Notional hours will be determined by the Government prior to receiving proposals from offerors. Per Section M, Paragraph 6, Section J, Attachment 9, will be used to evaluate the reasonableness and balance of the offeror’s proposed skill mix for the Awardable Task Orders.
14) Section J, Attachment 10, Labor Rate Matrix has been updated to remove the inclusion of Interdivisional Organizations as part of the Prime Contractor rates.
15) Section J, Attachment 14, TEP no longer has Tabs requiring offerors to fill in detailed cost summaries by major cost element for the Awardable Task Orders because that information will be provided by the offeror in other TEP tabs and Section J attachments.
16) All tables and attachments are consistent. Section J, Attachment 5, Pricing Matrix shows a Basic with ordering period 1 starting FY 2020-FY 2021 and five Option Periods with the last ordering period of FY 2037-FY 2038. This totals 18 ordering periods.
Section J, Attachment 9, Labor Hour Summary and Section J, Attachment 10, Labor Rate Matrix do show FY 2020-FY 2038. This is 19 years, but only spanning 18 periods (e.g. Period 1 = 2020-2021)
Section L, Table 1 is 18 contract years to align with the 18 ordering periods. Contract year 1 does align with FY 2020 but will overlap into FY 2021 based on when the contract is awarded.
The table below illustrates how each contract year and ordering period correspond with each FY on the contract.
