MACC Questions and Answers (Part 1)
Q. Was the intent for E.2.b to have unlimited page count as opposed to E.2.a?
A.
Yes. VOLUME 1 – TECHNICAL (FACTOR 1) 35% design referenced the incorrect paragraph. The 35% design described in paragraph E.2.b is unlimited page count. See amended “Instructions to Offerors” paragraph E

Subfactor 3 requires a surety and SBA letter, typically the surety and bonding letters are excluded from the page count?
A.
Volume 1 – Technical, is limited to 20 pages with exemption of the 35% design which is unlimited pages

Q.
SOW Para. 1.3.2.1.6- 'Walls require sufficient sound attenuation so in-person and telephone conversations remain confidential.' Please define what specifically is required. What is required for the walls? What is required for the doors? What is required for the ceilings? Do the remaining exterior windows require sound attenuation?
A.
See paragraphs 1.3.2.1.2 and 1.3.2.1.6.1 of the revised SOW, dated 17 February
2016, for the responses to the questions regarding the walls and doors. The remaining windows do not require sound attenuation.
Q.
SOW Para. 1.3.2.1.7- 'Install "black out" gypsum wall board to five (5) windows.'
There are 4 windows in the court room / gallery. Is the 5th window the one in the
Deliberation Room?
A.
That is correct. The five (5) windows are those four (4) in the courtroom and the one (1) in the jury deliberation room.
Q. Is this project exempt from UFC 04-010-01 – ATFP requirements?
A.
The project does not have the triggers for mandatory compliance to UFC 04-010-
01. The project cost is below 50% of the plant replacement value of the existing building. Additionally, this building would be routinely occupied by less than 50 personnel which is different from the 116 personnel you estimated. Our estimate includes: 12 Jurors, 25 Gallery, 1 Judge, 1 Bailiff, 1 Court Reporter, 4 Witnesses, 3
Defense Team, and 2 Prosecution Team for a total of 49. USAFWC/JA and the
Fire Department concurred with this estimate. USAFWC/JA also indicated that it is a rarity for the gallery to be at full capacity.

Q.
Is the project exempt from ABA (Architectural Barriers Act) requirements as required by UFC 01-200-01 General Building Requirements?
A.
It would have been ideal to meet ABA requirements. However, it is not possible to accomplish that with the constraints and limited space available in the existing facility. Ramps to elevated areas are not required for this project. This facility will be used by able-bodied military members. Accessibility is only being provided at the main entrance for potential civilian witnesses or spectators with special needs since the existing restrooms are already ADA compliant.
Q.
If ABA is required the vestibule will need to be enlarged and the roof modified. Is an enclosed vestibule required?
A.
Yes, an enclosed vestibule is required. The measurements we took confirm there is adequate room to provide an enclosed vestibule and meet ADA maneuvering clearances. Refer to para 1.3.2.1.11 of the revised SOW, dated 17 February 2016.
Q.
Please confirm the desired location of the SF 1442 within the submitted proposal;
Volume 3 or Volume 4 or both.
A.
SF 1442 shall be in Volume 4. See amended “Instructions to Offerors” paragraph
D(1)
Q. Can the PPIS be formatted to fit the criteria of the proposal format?
A.
PPIS shall be in format provided. See amended “Instructions to Offerors” paragraph 10
Q.
Will the Government consider assigning a “Very Relevant” rating to Past/Present
Performance projects submitted which involved a contractually required period of performance shorter than 120 days, but exceeded magnitude requirements (~$2M) and which involved essentially the same level of effort/complexities as projects under this solicitation?
A. Past performance submissions will be evaluated as stated in the solicitation criteria.
