(ix) FAR 52.212-2, Evaluation – Commercial Products and Commercial Services applies to this acquisition with the following addenda. This addenda replaces the provision at FAR 52.212-2 in its entirety:
a. General:
The Government will award Blanket Ordering Agreements (BOAs) and separate task orders resulting from this Request for Quotations (RFQ) to responsible vendors whose quotes conforming to the RFQ will be most advantageous to the Government, price and other factors considered. This acquisition establishes BOAs for right of way vegetation clearing services at Joint Base Charleston, SC and includes separate task orders for: (1) ROW Vegetation Clearance
– Work Request 1, and (2) ROW Vegetation Clearance – Work Request 2. Future projects will be competed amongst BOA holders. The BOA has an attached Performance Work Statement (PWS) describing the scope of right of way vegetation clearing services covered by the agreement.
b. Evaluation Factors:
The following factors shall be used to evaluate quotes:
1. Price
2. Past Performance
c. Price Evaluation
1. The Government will calculate a Total Evaluated Price for each quote by adding the prices for Project 1 and Project 2 together.
2. Vendors will then be ranked from lowest Total Evaluated Price to highest.
d. Past Performance Evaluation:
The government will begin evaluating past performance, starting with the vendor that has the lowest Total Evaluated Price. Evaluation of the vendor’s past performance is subjective and will result in a Performance Confidence rating of (See table below) Substantial, Satisfactory, Neutral, or Limited confidence. Vendors who do not have recent and relevant past performance relating to this requirement will receive a rating of Neutral Confidence.
Rating Description
Substantial Confidence: Based on the Vendor’s recent/relevant performance record, the Government has a high expectation the vendor will successfully perform the requirement.
Satisfactory Confidence: Based on the vendor’s recent/relevant performance record, the Government has a reasonable expectation that the vendor will successfully perform the requirement.
Neutral Confidence: No recent/relevant performance record is available, or the vendor’s performance record is so sparse, no meaningful confidence assessment rating can be reasonably assigned. The vendor may not be evaluated favorably or unfavorably on the factor of past performance.
Limited Confidence: Based on the vendor’s recent/relevant performance record, the Government has a low expectation the vendor will successfully perform the requirement.
The Government will evaluate past performance for recency and relevancy. Recency is defined as performance of similar services within the past three (3) years from the date of this solicitation. Relevancy is defined as performance of similar services of the same magnitude and scope as those described in the BOA's PWS.
e. Award Decision:
1. The Government intends to award three BOAs as a result of this solicitation; however, the Government reserves the right to award fewer than three BOAs, or more than three BOAs, if determined to be in the best interest of the Government.
2. If the three lowest-priced vendors all receive a rating of Substantial Confidence, the Government may award BOAs to those three vendors and cease further evaluation.
3. However, the Government reserves the right to continue evaluating additional quotes and award more than three BOAs if it determines that doing so is in the best interest of the Government, even if three vendors have already received a rating of Substantial Confidence.
Factors that might lead the Government to award additional BOAs include, but are not limited to:
a need for specialized expertise, or concerns about the capacity of the initial three vendors to meet future needs.
4. Furthermore, in the event the three lowest-priced vendors do not receive a rating of Substantial Confidence, the Government will continue evaluations until three vendors receive a rating of Substantial Confidence, or all quotes are evaluated. The Government reserves the right to award a BOA to vendors that receive a past performance rating of Satisfactory Confidence or Neutral Confidence and reserves the right to award to other than the lowest-priced vendors, if the Government determines that doing so represents the best value.
5. Project 1 and Project 2 task orders will be awarded to the selected BOA awardee who submitted the lowest price for that specific project.
f. Your quote should include your best terms. The Government intends to award agreements and orders without interchanges with respective vendors. The Government, however, does reserve the right to hold interchanges with one, some, none, or all vendors.
(x) All vendors shall include a completed copy of FAR 52.212-3, Offeror Representation and Certifications – Commercial Products and Commercial Services (MAR 2025) (DEVIATION 2024-O0004) or complete electronic annual representations and certifications at http//www.sam.gov
