Construction Contract (MACC)
Section L, Part II - Factor 2
Sub-paragraph c. - The RFP states: "Relevant contracts include performance of multi-discipline efforts that are similar in scope, magnitude, and complexity to the effort of individual task orders contemplated to be issued on this contract…" Do you define "scope: as the three types of projects listed in this paragraph? If not, then please provide a general description for "scope". Likewise, for "complexity" give a definition or types of work that would be "complex", since Attachment XW only had numbers of TO and no types contemplated.
The following criteria shall be considered most relevant:
(i) Contracts with a preponderance of work associated with existing facility whole building renovation work involving Mechanical, Electrical, Plumbing, Fire Protection, Building Envelope and other systems, and with values equaling or exceeding $1M-$10M; and
(ii) Contracts with a preponderance of work associated with Water, Wastewater, or Electrical utility infrastructure, and with values equaling or exceeding $1M-$10M.
(iii) Design Build contracts with a preponderance of work associated with existing facility whole building renovation work and/or utility infrastructure work with values equaling or exceeding $1M-$10M.
Question
Sub-paragraph c. I,ii and iii - It is not clear if projects that fall within the $1 to $10M range are equal to a project that might be larger than $10M. We ask that all firms have to submit on projects between the $1 to $10M range, since a larger project may have more scope elements and would give those firms an unfair competitive advantage.
Answer
Yes.
Question
Sub-paragraph b. - Do the materials included for the "Quality and Satisfaction Rating for Contracts…" count within the page count. If not, then suggest a maximum page count, which will allow all firms the same limits.
Answer
Yes, the past performance project list is part of the page count. The Past Performance Customer Questionnaires are not included in the page limitation.

The third paragraph refers to "RFP Attachment 8 - Past Present Performance Questionnaire (PPPQ))" Did you intend this to be Attachment+XU PPQ? If not, then please clarify and provide the correct PPPQ.
Answer
Correct - RFP Attachment 8 "RFP Attachment 8 - Past Present Performance Questionnaire (PPPQ))" is attached as
"Solicitation Attachment XU - Past Performance Customer Questionnaire".
Question
The second paragraph states: "...consideration will be given, but not limited to, such things as project scope, magnitude, project complexity, contract type, contract environment, division of company proposing, and subcontractor interaction."
Several items:
1st - Please define "project complexity"? Does this mean if the project has "complex" on the CPARS, then it qualifies for the definition?
2nd - Section L did not request "contract environment, division of company proposing, and subcontractor interaction" -are these to be addressed in Attachment+XU, Part D-Description of Work? Please clarify.
3rd - Please define "contract envrionment"? Do you mean competitive bid, RFP, two step, etc.?
(i) Contracts with a preponderance of work associated with existing facility whole building renovation work involving
Mechanical, Electrical, Plumbing, Fire Protection, Building Envelope and other systems, and with values equaling or exceeding $1M-$10M; and
(ii) Contracts with a preponderance of work associated with Water, Wastewater, or Electrical utility infrastructure, and with values equaling or exceeding $1M-$10M.

Section L-1.3
Section L-1.3
This solicitation limits the question period to 3 days after the site visit. Typically on design bids and hard bid projects, questions are allowed until 10 days prior to bid. This is particularly important on design build projects that require design activities in order to prepare the bids. Will the question period be extended to allow better review of the RFP and better development of responses & bids.
Answer
No, questions were due 21 Oct 22, 4:00 p.m. and the Government does not anticipate extensions if this period.
Question
What percentage of work will be design build?
Answer
Approximately 10% of task orders may be design build.
Question
Confirm that the plans and specifications for the seed project are complete and that design after award is not required.
Answer
The seed project is a design-bid-build task order. The plans and specifications are complete and provided as Solicitation
Attachments YS through YV.
Question
Question
Sub-Paragraph on "considered most relevant" - Section L limited the number of projects for each of the three categories listed. Are all three categories equal in the evaluation for most relevant? In other words, if we submit ten projects for (i) renovation, are those projects considered more relevant than the other two categories listed? If not, then are they considered equal?
Answer
A project determined to be most relevant in one category would be rated the same in relevancy as a project found to be most relevant in one of the other two categories.
Question
We did not see a definition for a "contract". Many solicitations define a "project" as a single task order and not a multiple award contract. Please define and clarify the intent of "contracts" for past performance.
Answer
48 CFR § 2.101, defines "Contract" as a mutually binding legal relationship obligating the seller to furnish the supplies or services (including construction) and the buyer to pay for them. It includes all types of commitments that obligate the
Government to an expenditure of appropriated funds and that, except as otherwise authorized, are in writing. In addition to bilateral instruments, contracts include (but are not limited to) awards and notices of awards; job orders or task letters issued under basic ordering agreements; letter contracts; orders, such as purchase orders, under which the contract becomes effective by written acceptance or performance; and bilateral contract modifications. Contracts do not include grants and cooperative agreements covered by 31 U.S.C. 6301, et seq. For discussion of various types of contracts, see part 16.

Section L, Factor 2
Section L, Factor II, Paragraph c.
The instructions in this section do not indicate if these projects all need to be completed within the last 5 years. Are they all to be complete and if not what percentage complete do they need to be?
Answer
Past Performance is recent if one day of performance occurred within five (5) years of the release of the solicitation.
Confirm that design team qualifications are not required for response to this solicitation.
Answer
Confirmed.
Question
Confirm that the plans and specifications for the seed project are complete and that design after award is not required.
Answer
The seed project is a design-bid-build task order.
Contractors should use the form provided in the solicitation to avoid evaluation delays. See Solicitation Attachment XU -
Past Performance Customer Questionaire.
Question
For the MACC, will there be any set aside contractors for specialty work outside of the 5-primary, 2-alternate contractors to be awarded to? Prior MACC’s have typically use this approach if there are projects that consist of 90+ percent work to be performed proprietary or specialty trade specific contractors where the scope requires they be used.
Answer
No.
Question
Question
Can one project be used and counted under two categories? For example both Design Build and whole building renovation?
Answer
Yes, provided the limits of the categories are not exceeded - Reference Section L, Factor II, Paragraph c. "No more than two (2) of the fifteen contracts executed shall be Design-Build contracts."
Question
For the MACC, will there be any projects that will allow GC admin to triple hat? i.e. projects with single trade work, with small vicinities as a work area, or scopes of work that are not considered complex.
Answer
It is unlikely that a task order will allow "triple hatting", most Task Orders will require at least one (1) Superintendent and one (1) QC Manager / SSHO.

For the MACC, in the event of a single bidder scenario on a task order, what are the stipulations of this MACC to award the project?
Answer
In the unlikely event of a single proposal received, orders will be placed in accordance FAR 16.505.
Question
If Key Personnel experience is acceptable, what is the degree of their involvement that must be presented to satisfy the
Government?
Answer
Reference Section M-3.2.1, Paragraph (2) In determining performance confidence assessment ratings IAW Table 5 above, consideration will be given to the entity that performed the work. Past performance of the offeror will have a greater weight than past performance of other business entities or personnel. Demonstration of previous working relationships with the proposed entity will have a greater weight than a new relationship. Teaming partners supported by written agreements will have a greater weight than partners with no written agreement.
Question
Is there any difference in how a key personnel's experience (if allowed) will be evaluated vs. the actual company's experience?
Answer
Question
Would the government consider dropping the Bid Bond requirement? If the government puts out severl projects together this would tie-up bonding in the full amount of the contractors proposal until the awards are made. This could limit the contractors bonding ability on future work.
Answer
The Source Selection Team, having carefully considered this request, determined that Individual Task Order Proposal
Requests (TOPRs) will specify the Proposal Bond and/or a Performance Bond required for each task order. The most likely scenarios is that individual TOPRs will require 20% proposal bond with 100% payment and performance bonds.
Question
In regard to a reference project for past performance, does the project need to be performed by the HubZone company?
Will projects be accepted if a relevant key person was involved? Will projects from a subcontractor/teaming partner be accepted?
Answer
Reference Section M-3.2.1, Paragraph (2) In determining performance confidence assessment ratings IAW Table 5 above, consideration will be given to the entity that performed the work. Past performance of the offeror will have a greater weight than past performance of other business entities or personnel. Question
Question
Will a lack of past performance in SBA Region IV be evaluated as a neutral confidence rating? Will a neutral past performance confidence rating be evaluated for award?
Answer
Performance Confidence Assessment Ratings will be assigned in accordance with Table 5 is Section M-3.2.1. Past
Performance may only be determined relevant if it occurred within SBA Region IV (SE Region). The SE Region consists of the following eight states: Alabama, Florida, Georgia, Kentucky, Mississippi, North Carolina, South Carolina, and
Tennessee. Past Performance submissions older than five (5) years from the solicitation due date; i.e. non- responsive as to recency, and Past Performance submissions which occurred outside the SE Region, i.e. non-responsive as to relevancy, shall not be evaluated. As a result of the relevancy and performance of the work evaluated, offerors will receive an integrated performance confidence assessment rating. The past performance evaluation represents an overall evaluation of contractor performance. Offerors without a record of recent/relevant past performance or for whom information on past performance is so sparse that no meaningful confidence assessment rating can be reasonably assigned will not be evaluated favorably or unfavorably on past performance and, as a result, will receive a "Neutral
Confidence" rating for the Past Performance factor. "Substantial Confidence" or "Satisfactory Confidence" past performance ratings will be evaluated more favorably than a neutral confidence rating.
Question
How will reference projects below the $1m range be evaluated? Will they be considered not relevant or less relevant than the Government's preferred $1-5m range?
A project's magnitude affects the relevancy determination. The following criteria shall be considered most relevant:
(i) Contracts with a preponderance of work associated with existing facility whole building renovation work involving
Mechanical, Electrical, Plumbing, Fire Protection, Building Envelope and other systems, and with values equaling or exceeding $1M-$10M; and
(ii) Contracts with a preponderance of work associated with Water, Wastewater, or Electrical utility infrastructure, and with values equaling or exceeding $1M-$10M.
(iii) Design Build contracts with a preponderance of work associated with existing facility whole building renovation work and/or utility infrastructure work with values equaling or exceeding $1M- $10M.
The Government will use Table 4. - Past Performance Relevancy Rating Method when assessing recent contracts.

Answer
No
This section states that Proposal Bonds will be required for each task order in the amount of 20%. This is a highly unusual requirement, in fact we have not seen this on any other IDIQ/MACC/MATOC under which we have performed work. The expense of the additional bid bonds and the restriction of bonding capacity should be considered. Can this be removed, leaving only the need for a bid bond for the initial proposal? Performance and payment bonds are understood.

As- Builts
In the current economic climate, contractors are seeing unprecedented increases in cost of both materials and labor between bid day and contract award. Federal acquisition regulation FAR 16.203 - Fixed price contracts with economic price adjustment, permit escalation clauses in those instances where "there is serious doubt concerning the stability of market or labor conditions that will exist during an extended period of contract performance" and "contingencies that would otherwise be included in the contract price can be identified and covered separately in the contract." With this in mind, we respectfully request that the government add clause "48 CFR 52.216-4 - economic price adjustment - Labor and materials" to the solicitation to ensure it receives the highest quality end product. If this cannot be added to the RFP, it will be very difficult to bid this project or any project moving forward, due to the ever changing market we are currently working in.
Answer
Economic price adjustment(s) will not be added to this solicitation.
