INDUSTRIAL USER PERMIT NO. 001

Vance Air Force Base

PART 1 - EFFLUENT LIMITATIONS

A. From the period of January 17, 2017 to January 16, 2022, the permittee is authorized to discharge domestic wastewater, processed industrial wastewater, and remediated groundwater, to the City of Enid sewer system. The total discharge at Vance Air Force Base shall be measured on a "continuous" basis at Outfall 001 (except for weekends/holidays where readings will be collected on Friday and Monday and the difference will be for the weekend), the processed remediated groundwater shall be measured on an as operating basis at the groundwater remediation plant discharge point Outfall 003. The discharge points are listed below:

B. During the period of January 17, 2017 to January 16, 2022, the combined base discharge, and the groundwater remediation discharges shall not exceed the appropriate effluent limitations. Vance Air Force Base has been identified as a Significant Industrial User (SIU).

Samples shall be obtained at the base discharge Outfall 001, and at the groundwater remediation discharge Outfall 003 B. Samples shall be collected at Outfall 003B when the Central Groundwater Treatment Facility (CGWTF) is operating. Analytical results shall not exceed the local limits listed below and in Exhibit B.

C. The discharge from the following outfalls listed above shall not exceed the following effluent limitations:

D. The permittee shall not discharge wastewater containing any of the following substances from any of the discharge points without approval from the City:

1. Uncontaminated cooling water and unpolluted industrial process waters. The discharger shall monitor potential sources of inflow and infiltration monthly and perform repairs required to restrict storm water, surface water, ground water, roof runoff, and subsurface drainage from being discharged as wastewater.

a. Vance Air Force Base will not connect any additional buildings to the industrial sewer without prior approval from the City of Enid.

b. Specified buildings at Vance Air Force Base have been inspected and listed as approved appurtenances as of February 1, 1993 (Exhibit C) and revised on August 8, 1996 (Exhibit G). Exhibit G may be amended by the CityNance Air Force Base as needed without altering the effectiveness of the terms and conditions of this permit.

2. Any liquids, solids, or gases which by reason of their nature or quantity are, or may be, sufficient either alone or by interaction with other substances to cause fire or explosion or be injurious in any other way to the Publicly Owned Treatment Works (POTW) or to the operation of the POTW. Pollutants which cause a fire or explosion hazard to the POTW, including but not limited to, waste streams with a closed cup flashpoint of less than 140 degrees Fahrenheit or 60 degrees Centigrade using the methods specified in 40 CFR 261.21. At no time shall two (2) successive readings on an explosion hazard meter, at the point of discharge into the system (or at any point in the system) be more than five percent (5%) nor any single reading over ten percent (10%) of the lower explosive limit (LEL) of the meter. Prohibited materials include, but are not limited to: gasoline, kerosene, naphtha, benzene, toluene, xylene, ethers, alcohols, ketones, aldehydes, peroxide, chlorates, perchlorates, bromates, carbides, hydrides, and sulfides and other substances which the City, State or EPA has notified the user is a fire hazard or a hazard to the system, unless otherwise noted in the permit.

3. Solid or viscous substances which may cause obstruction to the flow in a sewer or other interference with the operation of the wastewater treatment facilities such as, but not limited to: grease, garbage with particles greater than one-half inch, any entrails, whole blood, feathers, ashes, cinders, sand, spent lime, stone or marble dust, metal, glass, straw, grass clippings, shavings, rags, spent grains, spent hops, waste paper, wood, plastics, gas, tar, asphalt residues, residues from refining, or processing of fuel or lubricating oil, petroleum oil, non-biodegradable cutting oil, or products of mineral oil origins, mud, or glass grinding or polishing wastes.

4. Any wastewater having a pH of less than five and five-tenths (5.5), or having a pH greater than eleven (11.0), or wastewater having any other corrosive or acidic properties capable of causing damage or hazard to structures, equipment, and/or personnel of the POTW.

5. Any wastewater containing toxic pollutants in sufficient quantity, either singularly or by interaction with other pollutants, to injure or interfere with any wastewater treatment process, constitute a hazard to humans or animals, create a toxic effect in the receiving waters of the POTW, or to exceed the limitation set forth in a categorical pretreatment standard. A toxic pollutant shall include but not be limited to any pollutant identified pursuant to Section 307(a) of the Federal Water Pollution Control Act (Clean Water Act).

6. Any noxious or malodorous liquids, gases, or solids which either singularly or by interaction with other wastes are sufficient to create a public nuisance or hazard to life or are sufficient to prevent entry into the sewer system for maintenance and repair.

7. Any substance, which may cause the POTW's effluent or any other product of the POTW such as residues, sludges, or scums to be unsuitable for reclamation processes.

In no case, shall a substance discharged to the POTW cause the POTW to be in non compliance with sludge use or disposal criteria, guidelines or regulations developed under Section 405 of the Clean Water Act, the Clean Air Act, the Toxic Substance Control Act, or state criteria applicable to the sludge management method being used.

8. Any substance, which will cause the POTW to violate its NPDES and/or state disposal system permit or the receiving water quality standards.

9. Any wastewater with objectionable color not removed in the treatment process, such as, but not limited to, dye wastes and vegetable tanning solutions.

10. Any wastewater having a temperature which will inhibit biological activity in the POTW treatment plant resulting in interference, but in no case shall wastewater effluent be discharged from any user into the sewer system at temperatures which exceed 150 degrees Fahrenheit (65 degrees Centigrade) or in no case shall heat be discharged from any user in such quantities that the influent temperature at the City's POTW will exceed 104°F (40°C).

11. Any pollutants, including oxygen demanding pollutants (BODs-5 day Biochemical Oxygen Demand, etc.) released at a discharge rate and/or pollutant concentration which a user knows or has reason to know will cause interference to the City of Enid wastewater treatment facility.

12. Any wastewater containing any radioactive wastes or isotopes of such half-life or concentration as may exceed limits established by the superintendent of the sewage treatment plant in compliance with applicable State or Federal regulations.

13. Any wastewater, which causes a hazard to human life or creates a public nuisance.

Discharges shall comply with all other applicable State and Federal pretreatment laws, regulations, standards, or requirements that may become effective during the term of the discharge. The permittee will notify the City in writing of any changes in the discharge.

Part 2 • MONITORING REQUIREMENTS

A From the effective date of the permit until January 13, 2022, the permittee shall monitor Outfall 001 the Base Discharge, and Outfall 003 B the Groundwater Remediation discharge for the following parameters, at the indicated frequency:

Prior to treating contaminants at new monitoring well sites in the treatment process, Vance AFB will submit to the City of Enid analytical results to review. If it is determined that a new well can potentially cause a problem, a chronic bio-monitoring test will be performed and the analysis reviewed by the City prior to permitting the new discharge from the Groundwater Remediation Facility.

2. (Continuous) daily flows are to be recorded from the permittee's flow meter (except as previously indicated for holidays and weekends). Water meter readings are acceptable, when the flow meter is down for repairs. Operating flows from the groundwater remediation facility is to be monitored when the facility is discharging. All of these flows

-6-will be reported in the Semi-Annual Report.

3. Sample type and duration: Grab samples will be collected over a period of time not to exceed fifteen (15) minutes in duration. Grab samples shall consist of one (1) sample collected during a representative operating period for each sampling event.

4. Composite sampling will be collected during a normal operation period by one of the following methods:

a. The Preferred Method is a flow proportional composite sample, collected either as a constraint sample volume at time intervals proportional to stream flow, or collected by increasing the volume of each aliquot as the flow increases while maintaining a constant time interval between the aliquots.

b. A time composite sample can be collected, composed of discrete sample aliquots collected in one container at a constant time interval providing representative samples irrespective of stream flow.

Composite samples will be collected at Outfall 001.

5. Semi-annual samples are to be analyzed once every six (6) months or more often if you so choose and shall consist of samples collected during a normal operating period.

6. Quarterly samples are to be analyzed four (4) times/year (two times/six month reporting period) and shall consist of samples collected during a normal operating period.

7. At Outfall 001, pH will be collected once/month and analyzed immediately after collection. All six (6) results will be reported in the Semi-Annual Self-Monitoring Report.

8. At Outfall 001, temperature will be collected once every six (6) months and analyzed immediately after collection. This result will also be reported in the Semi-Annual Self Monitoring Report.

9. Semi-Annual Self-Monitoring Reports shall include a qualifying statement signed by the designated responsible party at Vance Air Force Base. Semi-Annual Self-Monitoring Reports shall include: Military name, address, exact sample location, method of sampling, date of sampling, time of sampling, name of sampler, preservation technique used, chain-of-custody documentation, date and time of analysis, analytical method, name of analyst, name of chemist responsible for analysis, blank, duplicate, spike and percent of recovery for sample results, laboratory certified by the Oklahoma Department of Environmental Quality (ODEQ) or their successor and the analytical results. Each of these items must be included in the package sent to the City by Vance Air Force Base for the results to be accepted as valid or the information should be available for inspection upon request at Vance Air Force Base by the City of Enid.

10. Significant Industrial Users (SIUs) will use a laboratory certified by the Oklahoma Department of Environmental Quality (ODEQ).

B. All handling and preservation of collected samples and laboratory analyses of samples shall be performed in accordance with 40 CFR Part 136 and amendments thereto, unless specified otherwise in the monitoring conditions of this permit

Part 3 • REPORTING REQUIREMENTS

A. Monitoring Reports

Monitoring results obtained shall be summarized and reported on official letterhead to the City of Enid, two (2) times per year. For convenience the reports are now due on the 301 h day of January and July. Therefore, the next report is due on July 301 2012. If the semi-annual report date falls on a Saturday or Sunday the report will be due the following Monday. The report shall indicate the nature and concentration of all pollutants in the effluent for which sampling and analyses were performed during the calendar period preceding the submission of each report. The permittee has the obligation to inform the City if operation conditions have changed. If changes have occurred, the City has the option to reopen the permit

B. If the permittee monitors any pollutant more frequently than required by this permit, using test procedures prescribed in 40 CFR Part 136 or amendments thereto, or otherwise approved by EPA or as specified in this permit, the results of such monitoring shall be included in any calculations of actual daily maximum or monthly average pollutant discharge and results shall be reported in the semi-annual report submitted to the City of Enid. Such increased monitoring frequency shall also be indicated in the semi-annual report.

C. Automatic Resampling

If the results of the permittee's wastewater analysis indicate that a violation of this permit has occurred, the permittee must:

1. Notify the City of Enid of the violation within 24 hours of awareness; and

2. Repeat the sampling and pollutant analysis for the parameters that are in non compliance of the Pretreatment Ordinance and submit in writing the results of the second analysis to the City of Enid within thirty (30) days of violation awareness per 40 CFR Part 403. 12(g)(2).

D. Accidental Discharge Report

1. The permittee shall notify the City of Enid immediately upon the occurrence of an accidental discharge of substances prohibited by Section 8-3A-11 B or any slug loads or spills that may enter the public sewer. During normal business hours, the City of Enid should be notified by telephone as listed in Exhibit D. The notification shall include

-8-location of discharge, date and time thereof, type of waste including concentration and -volume, and corrective actions taken. The permittee's notification of accidental releases in accordance with this section does not relieve it of other reporting requirements that arise under local, State or Federal laws.

2. Within five (5) days following the awareness of an accidental discharge, the permittee shall submit to the City of Enid a detailed written report. The report shall specify:

a. Description and cause of the upset, slug load or accidental discharge, the cause thereof, and the impact on the permittee's compliance status. The description should also include location of discharge, type, concentration and volume of waste.

b. Duration of non-compliance, including exact dates and times of non-compliance and, if the non-compliance is continuing, the time by which compliance is reasonably expected to occur.

c. All steps taken or to be taken to reduce, eliminate, and/or prevent recurrence of such an upset, slug load, accidental discharge, or other conditions of non compliance.

d. The report shall include the conditions under which plant operations were conducted.

E. All reports required by this permit shall be submitted to the City of Enid at the following address and also delineated in Exhibit E:

PART 4 - SPECIAL CONDITIONS

Section 1 - Additional Special Monitoring Requirements

The solids removal system and the ultraviolet oxidation unit were shut down in 2001 and eight weeks of sampling for volatile and semi-volatile organic compounds were collected. No semi-volatile organic compounds were detected in the eight-week sampling period other than an anomaly in the sixth week of sampling. Therefore, less frequent additional special monitoring requirements for the Central Groundwater Treatment Facility (CGWTF) were implemented. The new requirements began on May 9, 2001 (the day after the last of the eight-week sampling period was collected- May 8, 2001).

Vance AFB collected another round of eight weeks of samples between May 81 h and July 11, 2002 when the 2nd collection system was tied to the Central Groundwater Treatment Facility. The results were well within the TTO limits. There was an anomaly in the first week of sampling when the effluent results were higher than the influent results. This is probably a laboratory error. As per your request of October 25, 2004, the analytical results from the previous two (2) years identified all semi volatile results below detection limits. However, the only way to determine if there is break-through is to continue to monitor for this parameter. Therefore, less frequent additional special monitoring requirements for the Central Groundwater Treatment Facility (CGWTF) was implemented at that time. Vance AFB will sample the effluent at the CGWTF for semi-volatile organics once every six-(6) months to demonstrate compliance. Results will be reported twice/yr (January and July).

If any new monitoring well is added to the treatment process Vance AFB will sample the effluent at the CGWTF for volatile and semi-volatile organics once every week for two (2) consecutive months to demonstrate compliance with the TTO limit. The monitorin~ wells included in this list are any of the corrective measure sites or any well that is added to the 2" interceptor collection trench. Additional sampling would also be required for any new contaminated groundwater site that is hauled to the CGWTF. Vance AFB will submit the results of any new sampling events within two (2) weeks of receipt to the Environmental Specialist. If a result above the Practical Quantification Limit (PQL) is detected for any volatile or semi-volatile organic then the City will be notified immediately. The analyses will be reviewed and if a meeting is needed it will be scheduled with Vance AFB to discuss the findings.

If a problem develops at the POTW from the current groundwater treatment system or any new monitoring well or from hauled waste to the CGWTF, then the City of Enid may:1) require the groundwater remediation system to be shut down until the problem is corrected, and/or 2) establish more stringent limits for the groundwater treatment facility.

Two samples for BODs, TSS and NH3 must be collected and analyzed for every semi-annual report.

Section 2 - Reopener Clause

A. This permit may be reopened and modified to incorporate any new or revised requirements contained in a National Categorical Pretreatment Standards under 40 CFR.

B. This permit may be reopened and modified to incorporate any new or revised requirements resulting from the City of Enid re-evaluation of its local limits.

C. This permit may be reopened and modified to incorporate any new or revised requirements developed by the City of Enid as are necessary to ensure POTW compliance with all controlling agencies.

D. This permit may be reopened and modified to incorporate any mission change of Vance Air Force Base.

Overflows

The permittee shall give notice (report) any overflows (any wastewater spill or release) to the City of Enid (616-7302) within 24 hours from the time the permittee becomes aware of the overflow. It does not matter whether it is a small overflow (1 gallon or less) or a large overflow (greater than 1 million gallons), it still must be reported to the City of Enid (attention: Environmental Compliance Specialist).

The following shall be included as information which must be reported within 24 hours:

A. Any unanticipated bypass which exceeds any effluent limitation in the permit.

B. Any upset which exceeds any effluent limitation in the permit.

C. Any violation of a maximum daily discharge limit for any of the pollutants listed in the permit.

D. Any bypass in the collection system (sanitary sewer overflow (SSO)).

A written submission shall be provided within 5 working days of the time the permittee becomes aware of the overflow. The report shall contain the following information:

A. A description of the overflow and the cause.

B. The period of the overflow including exact dates and times, and if the overflow has not been corrected, the anticipated time it is expected to be corrected.

C. Steps being taken to immediately stop, contain, clean-up, reduce, eliminate and/or prevent recurrence of the overflow.

The City of Enid may also require the permittee to implement permanent corrective actions if the overflows occur too frequently.

PART 5 - STANDARD CONDITIONS

A. Severability The provisions of this permit are severable, and if any provision of this permit, or the application of any provision of this permit to any circumstance, is held invalid, the application of such provision to other circumstances, and the remainder of this permit shall not be affected thereby.

B. Duty to Comply

The permittee must comply with all conditions of this permit. Failure to comply with the requirements of this permit may be grounds for administrative action, or enforcement proceedings including civil or criminal penalties, injunctive relief, and summary abatements.

Duty to Mitigate

The permittee shall take all reasonable steps to minimize or correct any adverse impact to the public treatment plant or the environment resulting from non-compliance with this permit, including such accelerated or additional monitoring as necessary to determine the nature and impact of the non-complying discharge.

D. Permit Modification

This permit may be modified for good causes including, but not limited to the following:

1. To incorporate any new or revised Federal, State or local pretreatment standards or requirements.

2. Material or substantial alterations or additions to the discharger's operation processes, or discharge volume or character which were not considered in drafting the effective permit.

3. A change in any condition in either the industrial user or the POTW that requires either a temporary or permanent reduction or elimination of the authorized discharge.

4. Information indicating that the permitted discharge poses a threat to the Control authority's collection and treatment system, POTW personnel or the receiving waters.

5. Violation of any terms or conditions of the permit

6. Misrepresentation or failure to disclose fully all relevant facts in the permit application or in any required reporting.

7. Revision of or a grant of variance from such categorical standards pursuant to 40 CFR 403.13.

8. To correct typographical or other errors in the permit

9. To reflect transfer of the facility ownership and/or operation to a new owner/operator; or

10. Upon request of the permittee, provided such request does not create a violation of any existing applicable requirements, standards, laws, or rules and regulations.

The filing of a request by the permittee for a permit modification, revocation and reissuance, or termination, or a notification of planned changes or anticipated non-compliance, does not stay any permit condition.

Permit Termination

This permit may be terminated for the following reasons:

1. Falsifying self-monitoring reports,

2. Tampering with monitoring equipment,

3. Refusing to allow timely access to the facility premises and records,

4. Failure to meet effluent limitations,

5. Failure to pay fines,

6. Failure to pay sewer charges, and

7. Failure to meet compliance schedules

F. Permit Appeals

The permittee may petition to appeal the terms of this permit within thirty (30) days of the notice.

This petition must be in writing. Failure to submit a petition for review shall be deemed to be a waiver of the appeal. In its petition, the permittee must indicate the permit provisions objected to, the reasons for this objection, and the alternative condition, if any, it seeks to be placed in the permit. The effectiveness of this permit shall not be stayed pending a consideration by the Environmental Compliance Specialist. After consideration, if found proper, the permit shall be re-issued. Those permit provisions being reconsidered by the Environmental Compliance Specialist shall be stayed pending re-issuance.

G. Property Rights

The issuance of this permit does not convey any property rights of any sort, or any exclusive privileges, nor does it authorize any injury to private property or any invasion of personal rights, nor any violation of Federal, State or local laws or regulations.

H. Limitation of Permit Transfer

Industrial User Permits may not be re-assigned or transferred to a new owner and/or operator.

I. Continuation of Expired Permits

An expired permit will continue to be effective and enforceable until the permit is re-issued if:

1. The permittee has submitted a request for the renewal of the permit at least sixty (60) days prior to the expiration date of the user's existing permit.

2. The failure to re-issue the permit prior to expiration of the previous permit is not due to any act or failure to act on the part of the permittee.

Dilution

The permittee shall not increase the use of potable or process water or, in any way, attempt to dilute an effluent as a partial or complete substitute for adequate treatment to achieve compliance with the limitations contained in this permit.

K. Definitions

1. Daily Maximum-The maximum allowable discharge of pollutant during a calendar day.

Where daily maximum limitations are expressed in units of mass, the daily discharge is not the total mass discharged over the course of the day. Where daily maximum limitations are expressed in terms of a concentration, the daily discharge is the arithmetic average measurement of the pollutant concentration derived from all measurements taken that day.

2. Composite Sample-A sample that is collected overtime, formed either by continuous sampling or by mixing discrete samples. The sample may be composited either as a time composite sample: composed of discrete sample aliquots collected in one container at a constant time interval providing representative samples irrespective of stream flow; or as a flow proportional composite sample: collected either as a constraint sample volume at time intervals proportional to stream flow, or collected by increasing the volume of each aliquot as the flow increases while maintaining a constant time interval between the aliquots.

3. Grab Sample-An individual sample collected in less than fifteen (15) minutes, without regard for flow or time.

4. Instantaneous Maximum Concentration-The maximum concentration allowed in any single grab sample.

5. Slug Load-Any pollutant (including BOD) released in a discharge at a flow rate or concentration which will cause a violation of the specific discharge prohibitions in 40 CFR 403.5(b) to 403.12(f).

6. Cooling Water-

a. Uncontaminated: Water used for cooling purposes only which has no direct contact with any raw material, intermediate, or final product and which does not contain a level of contaminants detectably higher than that of the intake water.

b. Contaminated: Water used for cooling purposes only which may become contaminated either through the use of water treatment chemicals used for corrosion inhibitors or biocides, and by direct contact with process materials and/or wastewater.

7. Monthly Average-The arithmetic mean of the values for effluent samples collected during a calendar month or specified 30-day period (as opposed to a rolling 30 day window).

8. Weekly Average-The arithmetic mean of the values for effluent samples collected over a period of seven (7) consecutive days.

9. Bi-Weekly-Once every other week.

11. Bi-Monthly-Once every other month.

12. Upset-Means an exceptional incident in which there is unintentional and temporary non-compliance with technology-based permit effluent limitations because of factors beyond the reasonable control of the permittee, excluding such factors as operational error, improperly designed or inadequate treatment facilities, or improper operational and maintenance or lack thereof.

12. Bypass-Means the intentional diversion of wastes from any portion of a treatment facility.

13. Conventional Pollutants-Substances such as bio-chemical oxygen demand (BOD), total suspended solids (TSS), fecal coliform, pH, and other pollutants as designated by the

EPA.

14. Sewage-The organic waste and wastewater produced by residential and commercial establishments, i.e. car washes, flows from building heating and cooling systems, and restaurants.

Compliance with Applicable Pretreatment Standards and Requirements

Compliance with this permit does not relieve the permittee from its obligations regarding compliance with any and all applicable local, State and Federal pretreatment standards and requirements, including any such standards or requirements that may become effective during the term of this permit.

M. Adverse Impact

The permittee shall take all reasonable steps to minimize any adverse impact to the POTW resulting from non-compliance with any effluent limitation specified in this permit, including such accelerated or additional monitoring as necessary to determine the nature and impact of the non-complying discharge. The permittee shall immediately notify the City of Enid of sludge discharges, spills that may enter the public sewer, or any other significant changes in operations, wastewater characteristics and constituents.

PART 6 - OPERATION AND MAINTENANCE OF POLLUTION CONTROLS

A.

Proper Operation and Maintenance

The permittee shall at all times properly operate and maintain all facilities and systems of treatment and control (and related appurtenances) which are installed or used by the permittee to achieve compliance with the conditions of this permit. Proper operation and maintenance includes but is not limited to: adequate laboratory controls, effective performance, adequate operator staffing and training, and quality assurance procedures. This provision requires the operation of back-up or auxiliary facilities or similar systems only when necessary to achieve compliance with conditions in this permit.

Duty to Halt or Reduce Activity

Upon reduction of efficiency of operation, or loss or failure of all or part of the treatment facility, the permittee shall to the extent necessary to maintain compliance with its permit, control its production or discharges (or both) until operation of the treatment facility is restored or an alternative method of treatment is provided. This requirement applies, for example, when the primary source of power of the treatment facility fails or is reduced. It shall not be a defense for a permittee in an enforcement action that it would have been necessary to halt or reduce the permitted activity in order to maintain compliance with the conditions of this permit.

C. Bypass of Treatment Facilities

1. Bypass is prohibited unless it is unavoidable to prevent loss of life, personal injury or severe property damage or no feasible alternatives exit.

2. The permittee may allow bypass to occur which does not cause effluent limitations to be exceeded, but only if it is also for essential maintenance to assure efficient operation.

3. Notification of Bypass

a. Anticipated bypass: If the permittee knows in advance of the need for a bypass, it shall submit prior written notice, at least ten (10) days before the date of the bypass, to the City of Enid (address specified in Part 3 of this permit).

b. Unanticipated bypass: The permittee shall immediately notify the City of Enid and submit a written notice within five (5) days. This report shall specify:

i. A description of the bypass and its cause, including its duration; and

ii. Whether the bypass has been corrected; and

iii. The steps being taken or to be taken to reduce, eliminate and prevent a recurrence of the bypass.

D. Removed Substances

Solids, sludges, filter backwash, or other pollutants removed in the course of treatment or control of wastewaters shall be disposed of in accordance with Section 405 of the Clean Water Act and Subtitles C and D of the Resources Conservation and Recovery Act (RCRA).

PART 7 - MONITORING AND RECORDS

A Representative Sampling

Samples and measurements taken as required herein shall be representative of the volume and nature of the monitored discharge. All samples shall be taken at the monitoring points specified in this permit and, unless otherwise specified, before the effluent joins or is diluted by any other wastestream, body of water or substance. All equipment used for sampling and analysis must be routinely calibrated, inspected and maintained to ensure their accuracy.

Monitoring points shall not be changed without notification to and the approval of the City of Enid.

B. Flow Measurement

The appropriate flow measurement devices and methods consistent with approved scientific practices shall be selected and used to ensure the accuracy and reliability of measurements of the volume or monitored discharges. The devices shall be installed, calibrated, and maintained to ensure that the accuracy of the measurements is consistent with the accepted capability of that type of device. Devices selected shall be capable of measuring flows with a maximum deviation of less then ten (10%) percent from true discharge rates throughout the range of expected discharge volumes. Calibration and maintenance of the meter(s) shall be the responsibility of the City of Enid.

C. Analytical Methods to Demonstrate Continued Compliance

All sampling and analysis required by this permit shall be performed in accordance with the techniques prescribed in 40 CFR Part 136 and amendments thereto, otherwise approved by EPA, or as specified in this permit.

D. Additional Monitoring by the Permittee

If the permittee monitors any pollutant more frequently than required by this permit, using approved test procedures identified in Part 7 C, the results of this monitoring shall be included in the permittee's self-monitoring reports.

Inspection and Entry

The permittee shall allow the City of Enid, the State of Oklahoma, the USEPA, or other authorized agencies, upon the presentation of credentials and other documents as may be required by law, to:

1. Enter upon the permittee's premises where a regulated facility or activity is located or conducted, or where records must be kept under the conditions of this permit;

2. Have access to and copy, at reasonable times, any records that must be kept under the conditions of this permit;

3. Inspect at reasonable times any facilities, equipment (including monitoring and control equipment), practices, or operations regulated or required under this permit;

4. Sample or monitor, for the purposes of assuring permit compliance, any substances or parameters at any located; and

5. Inspect any production, manufacturing, or storage area where pollutants, regulated under the permit, could originate, be stored, or be discharged to the sewer system.

Retention of Records

1. The permittee shall retain records of all facility monitoring/maintenance information, copies of all reports required by this permit, and records of all data used to complete

-17-the application for this permit, for a period of at least three (3) years from the date of the sample, measurement, report or application.

This period may be extended by request of the City of Enid at any time.

2. All records that pertain to matters that are the subject of special orders or any other enforcement or litigation activities brought by the City of Enid shall be retained and preserved by the permittee until all enforcement activities have concluded and all periods of limitation with respect to any and all appeals have expired.

F. Record Contents

Records of sampling and analyses shall include:

1. The date, exact place, time, and type of sampling or measurements, and sample preservation techniques or procedures:;

2. The individual(s) who obtained the sampling or field measurements;

3. Chain-of-custody documentation; and

4. Samples shipped at 4°C or 39°F;

The following information shall either be contained in the laboratory report or in the chain-of custody documentation provided by the permittee:

1. The date(s) and times analyses were performed for each parameter;

2. The individual(s) initials that performed the analyses;

3. The analytical techniques or methods used;

4. Results received from blank, duplicate, percent recovery and spike samples;

5. Name of chief chemist responsible for analyses;

6. Oklahoma Department of Environmental Quality certification number; and

7. The results of such analyses.

Falsifying Information

Knowingly making a false statement on any report or other document required by this permit or knowingly rendering any monitoring device or method inaccurate, is a crime and may result in the imposition of criminal sanctions and/or civil penalties.

PART 8 R ADDITIONAL REPORTING REQUIREMENTS

A. Planned Changes

The permittee shall give notice to the City of Enid ninety (90) days prior to any facility expansion, production increase, or process modifications, which results in new or substantially increased, discharged or a change in the nature of the discharge.

B. Anticipated Non-Compliance

The permittee shall give advance notice to the City of Enid of any planned changes in the permitted facility or activity, which may result in non-compliance with permit requirements.

If the results of the permittee's wastewater analysis indicates a violation has occurred, the permittee must notify the City of Enid within 24 hours of becoming aware of the violation and repeat the sampling and pollutant analysis for the parameter{s) that were in non-compliance of the Pretreatment Ordinance and submit in writing the results of this second analysis to the City of Enid within thirty {30) days of violation awareness.

Duty to Provide Information

The permittee shall furnish to the City of Enid within ten (10) working days any information which the City of Enid may request to determine whether cause exists for modifying, revoking and reissuing, or terminating this permit, or to determine compliance with this permit. The permittee shall also, upon request, furnish to the City of Enid within ten (10) working days copies of any records required to be kept by this permit.

E. Signatory Requirements

All applications, reports, or information submitted to the City of Enid must contain the following certification statement and be signed as required in items 1 or 2 below. Photostatic copies of signatures will not be accepted.

"I certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or persons who manage the system, or those directly responsible for gathering the information, the information submitted is, to the best of my knowledge and belief, true, accurate and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fines for knowing violations."

a. The authorization is made in writing by the Commander, 11•t Mission Support Group.

b. The authorization specifies either an individual or a position having responsibility for the overall operation of the facility from which the industrial discharge originates, such as a position having overall responsibility for environmental matters for Vance Air Force Base; and

c. The written authorization is submitted to the City of Enid.

3. If an authorization under paragraph 2 of this section is no longer accurate because a different individual or position has responsibility for the overall operation of the facility, or overall responsibility for the environmental matters for Vance Air Force Base, a new authorization satisfying the requirements of paragraph 2 of this section must be submitted to the City of Enid prior to or together with any reports to be signed by an authorized representative.

4. All applications, correspondence, reports, and self-monitoring reports may be signed by a duly authorized representative of the person described above.

5. Any change in authorization shall be submitted to the City of Enid in writing within thirty

(30) days after the change.

Annual Publication

Annually, a list of all Significant Industrial Users (SIUs) which were in significant non compliance during the five (5) previous quarters with applicable pretreatment standards will be published by the City of Enid in the Enid News & Eagle. Accordingly, the permittee is apprised that non-compliance with this permit may lead to an enforcement action and may result in publication of its name in an appropriate newspaper in accordance with this section.

Penalties for Violations of Permit Conditions

Section 8-3H-9 provides that any user who violates a permit condition is subject to a criminal penalty of not less than $100.00 per day of such violation. Any user who willfully or negligently violates permit conditions is subject to criminal penalties of a fine or up to one thousand dollars ($1000.00) and costs or imprisonment not exceeding ninety (90) days or both. The permittee may also be subject to sanctions under state and /or Federal law.

Recovery and Costs Incurred

In addition to civil liability, the permittee violating any of the provisions of this permit or Municipal Ordinance or causing damage to or otherwise inhibiting the City of Enid wastewater disposal system shall be liable to the City of Enid for any expense, loss, or damage which was proximately caused by such violation or discharge. The City of Enid shall bill the permittee for the costs incurred by the City of

Enid for any cleaning, repairing, or replacement work caused by the violation or discharge.

I. Enforcement Action

Enforcement actions are based upon the Enforcement Response Plan approved by the USEPA and passed by the City Commission. Copies have been distributed to all Significant Industrial Users (SIUs).

SAMPLING PROCEDURES FOR SIGNIFICANT INDUSTRIAL USER'S (SIU's)

Sample description:

Composite samples for copper, mercury, silver, and zinc will be collected in the same sample bottle. A one (1) liter plastic bottle will be filled 1/4 full during each of the four (4) samples collected during the operating day. After each sample is taken it will be cooled and kept at 4 degrees Centigrade or 39 degrees Fahrenheit. At the end of the day there will be one (1) bottle, which will be preserved with HN03 to a pH less than 2. One sample result for each of the eight (8) metals listed will be reported in the self monitoring report.

Composite samples for BODs, TSS, and NH3 will be collected in the same one-liter plastic container during each sample. Four (4) samples will be collected during the operating day. After each sample is taken, it will be cooled and kept at 4 degrees Centigrade or 39 degrees Fahrenheit. One sample result for the BODs, TSS, and NH3 parameter will be reported in the self-monitoring report.

All grab samples will be collected one ( 1) time/day during the operating period. A grab sample for phenol will be collected in at least a 500 ml glass container with a teflon lid. A grab sample for oil and grease will be collected in a one-liter glass wide mouth container with a teflon lid. One (1) grab sample will be collected for each parameter during the operating day. After the phenol and oil and grease samples are taken they will be cooled and kept at 4 degrees Centigrade or 39 degrees Fahrenheit. Phenols and oil and grease will be preserved with H2S04 to a pH less than 2. Phenols and oil and grease will be reported in the self-monitoring report.

A grab sample for volatiles and acetone will be collected once/day during normal working hours in two (2) 40 ml VOA bottles.
