1 Project Description
1.1 This is a firm-fixed-price (FFP), indefinite-delivery/indefinite-quantity (IDIQ) contract for Simplified Acquisition of Base Engineer Requirements (SABER) at Los Angeles Air Force Base (LAAFB) in El Segundo, California (CA), and Camp Parks in Dublin, CA.
1.2 LAAFB sites include Fort MacArthur in San Pedro, CA, Pacific Heights in San Pedro, CA, Pacific Crest in San Pedro, CA, and Defense Contract Management Agency (DCMA) in Carson, CA.
1.3 Each individual construction project will be awarded by issuing individual Delivery Orders (DOs) against the basic contract on an as-needed basis. Projects will be in support of real property maintenance, repair, alteration, and new construction.
1.4 The contractor shall be required to furnish all materials, equipment, and personnel necessary to design, construct, manage, and accomplish the requirement in accordance with (IAW) this Statement of Work (SOW).
1.5 The DOs will include tasks in a variety of trades, including but not limited to: tenant improvement, carpentry, civil, excavation, electrical, plumbing, sheet metal, carpet installation, painting, demolition, concrete, masonry, interior/exterior signage, welding, heating, ventilation, air conditioning (HVAC), telecommunication, lead and asbestos abatement, and office furniture removal/reconfiguration.
1.6 The contractor shall provide technical support and project management to: assure quality and completeness of designs and drawings when applicable; assure accuracy of estimates/proposals; accommodate concurrent "active" projects; provide flexibility of staff and subcontractor pool to handle rapid increases in work volume; perform according to schedule with on-time completion; process engineering, construction, and environmental submittals in a timely manner; and present a professional demeanor.
1.7 The contractor shall ensure safe work environment for all Government personnel, other contractors, civilians, and his/her own personnel.
1.8 The contractor shall provide capabilities to do emergency work (i.e. less than six hours from Contracting Officer authorization to DO award) to include but not limited to subsurface civil, surface civil and above-ground built environment.
2 Project Review Meetings
2.1 The contractor shall host project review meetings at the request of the Government with applicable Space and Missile Systems Center, Operational & Integration Contracting (SMC/PKE) and 61st Civil Engineer & Logistics Squadron (61 CELS) personnel. The contractor shall coordinate the meeting date and time with the Contracting Officer and 61
CELS personnel. The Contracting Officer shall chair the meetings. For the project review meetings, the contractor may use Government conference rooms in SMC/PKE or 61 CELS, as available and with approved coordination through the Contracting Officer.
2.2 The contractor shall provide a list of all projects including (but not limited to):
2.2.1 The contract number
2.2.2 DO number and cost
2.2.3 Project number (if applicable)

2.3 The contractor shall maintain a submittal and request for information (RFI) log/registry for each DO.
3 Projected Award and Construction
3.1 The Government is not obligated to issue any particular type of work under this contract and may accomplish work using Government personnel or by other contracts, as the Government deems necessary or desirable, and to do so will not breach or otherwise violate this contract.
3.2 The negotiated price for construction DOs shall remain valid for six calendar months from the date of proposal submission to the Government. The contractor agrees that the Government is not obligated to issue a DO to the contractor for the construction of a project that has been negotiated. All materials submitted to the Government in the contractor’s DO proposals will remain the property of the Government after the DO has been awarded for construction.
3.3 The contractor shall not be allowed to renegotiate or submit new or updated material costs for any line items on any contracts that are awarded within six calendar months of final negotiation. Any material cost quotes (not otherwise listed in the Unit Price Book (UPB)) as part of individual DOs shall be the actual cost of that material at the time the proposal was submitted. If the Government cannot independently verify the material quotes listed by the contractor, these quotes shall be re-solicited by the contractor to reflect only actual material costs. If proposal efforts not awarded within the six month price guarantee period are renegotiated, then re-negotiations will be accomplished using the current UPB cost, contractor coefficient, not previously priced material, and labor costs.
4 Technical Design Support
4.1 The contractor's staff shall have multidiscipline experience. Areas of required technical design competence shall include engineering and drafting capabilities. The contractor's design shall comply with the requirements of all building codes listed in Section 6, Construction Requirements.
4.2 The Government will only provide basic concept design information for a specific DO.

However, some portions of a design may require a 100% design development by a registered Professional Engineer (PE) in the appropriate field (such as civil, electrical, structural, mechanical) or Registered Architect (RA), and employed by the contractor.
Where possible, this requirement will be identified in the Request for Proposal (RFP) Government package. A separate cost proposal for Architect & Engineer Services (A/E) effort shall be included in the contractors’ proposal. The DO shall include adequate 35% developmental, where applicable and as identified in the RFP design submittals as follows:
4.2.1 Civil/Structural
4.2.2 Architectural
4.2.3 Landscape/Irrigation
4.2.4 Mechanical/Plumbing
4.2.5 Electrical, including labeling outlets, panels, switches, conduit runs, etc.
4.2.6 Voice/Data requirements to include connectivity test between nearest communication closet and voice/data jack
4.3. Any other necessary 35% drawings not specifically listed above shall be submitted as soon after project award as possible. All architectural, structural, electrical, roofing systems, fire suppression designs, and shop drawings shall be stamped by the applicable engineer-of-record prior to submittal to the Government. For all design/build DOs the contractor shall retain services of the A/E contractor during construction for all engineering, and technical support. The A/E contractor shall fully design applicable project aspects (i.e.
civil, Mechanical, Electrical, Plumbing (MEP), architectural, structural, etc.) from design concept to Issue for Construction (IFC) drawings and specifications. Where applicable, the contractor shall employ a third party inspection agency to perform independent testing.
4.4. The contractor is responsible to ensure each project complies with the requirements in Section 6, Construction Requirements. If a discrepancy exists between any codes, the contractor shall notify the Government and use the most stringent requirement. Any work that is later found to not meet codes, guides, and standards that were in force at the time of DO award shall be corrected to comply with such codes, guides and standards at no extra cost to the Government. For all design/build DOs, the contractor developed drawings shall be stamped by the specific engineering discipline.

7.7 The Government inspection does not negate the need for regular contractor quality control nor does it indicate, either expressed or implied, that all codes, safety regulations or any other criteria have been followed properly.
8 Contracting Officer’s Authority
No person other than the Contracting Officer shall have authority to modify the terms of this contract. The Contracting Officer is the only person authorized to approve changes in any of the requirements under this contract and, not withstanding any provisions contained elsewhere in this contract, authority remains solely with the Contracting Officer. The contractor shall not take direction from anyone other than the Contracting Officer. In the event the contractor effects any such changes at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract price to cover any increase in costs incurred as a result thereof. The Contracting Officer is the only person who can obligate the Government. Input taken and acted on that changes the contract (other than health/life safety concerns) in any way received from anyone else besides the Contracting Officer is done so at the sole financial and legal responsibility of the contractor.
9 RS MEANS (National) Total Bare Cost
CLIN amounts for each DO shall be derived from the RS MEANS UPB. The National Total Bare Cost (which excludes RS MEANS Overhead and Profit) is derived by adding RS MEANS bare cost of material, labor and equipment as shown in Figure 1 below, and Figure 2 below. Depending on the specific line item from the RS MEANS UPB, any combination of material, labor and equipment may be added.
Figure 1: RS MEANS (National) Total Bare Cost Example shows how the (National) Total Bare Cost is calculated when there are no equipment costs.
Figure 2: RS MEANS (National) Total Bare Cost Example shows (National) Total Bare Cost when material labor and equipment are added.
10 Developing the Contractor’s Coefficient
10.1 The coefficients shall be applicable according to Figure 3 below:
TABLE OF COEFFICIENTS
Standard Hours Non-Standard Hours
Figure 3: Table of Coefficients
10.2 Coefficient is defined as a numerical factor that compensates the contractor for any and all indirect costs (not direct costs) and profit not included in the UPB line item for National Total Bare Cost. Coefficients shall include, but not be limited to, overhead, profit, insurance, procurement of required tools, minimum (35%) design, and General and Administrative costs. These costs will not be considered by the Government outside of the coefficient during performance of the contract.
10.3 The contractor shall consider the following factors which affect the calculation of the coefficients:
10.3.1 The coefficients are fixed for the term of the contract, as proposed for each contract year.
10.3.2 Direct labor and direct materials shall not be included in the coefficient.
10.3.3 The coefficient shall cover all items and all allowable contractor costs, with the exception of direct labor and direct materials. Examples of such costs are: senior project manager wages, quality control manager wages, all site and home office overhead and profit, bonds, insurance, mobilization and demobilization, taxes, general conditions, general and administrative expenses, special clothing for workers, on and off site storage, proposal development and negotiation (including minimal design and submittals), routine security delays, contingencies, clean-up, plus subcontractor overhead and profit.
10.3.4 All vehicles, office supplies/setup, remote office, administrative requirements, Personal Protective Equipment and equipment/tools which are customary to the trade shall be part of overhead, and therefore included in the coefficients. Under normal circumstances, no tool rental will be allowed as a direct cost to any DO.
For example, the contractor shall provide and maintain tools such as a generator, gasoline powered pump with hoses, laser level, flatbed trailer, etc. The cost of maintaining, operating, mobilizing, demobilizing and transporting the contractor’s equipment for the purpose of the overall SABER contract (i.e. not DO specific) shall be included in the coefficient.
10.3.5 Daily clean-up shall be performed at all active project sites and shall be included in the coefficient.
10.3.6 Equipment rental shall not be allowed as a direct cost to any DO, except under special circumstances such as performing work which is not normal for a given trade. For example: DO is issued to replace light bulbs in a high bay. Rental of a scissor lift shall be part of the DO as a direct cost since this is not a normal tool or equipment a contractor would provide and maintain.
10.3.7 Tarpaulins, temporary controls, tethers, work site signs, site security, required permits, licenses, submittals, drawings, and other risks to doing business shall be included in the coefficient.
10.3.8 All costs associated with Associate Contractor Agreements (ACA) are included in the coefficients of this contract (see Section 60).
11 RS MEANS City Cost Index
11.1 The City Cost Index (CCI) shall be Los Angeles, CA, for LAAB work sites. The CCI shall be San Francisco, CA, for Camp Parks work sites. Please refer to Figure 4 below CCI information.
Figure 4: Example of past CCI. In this case, work in Los Angeles, CA, is 107.2% of the national average, as defined by RS MEANS (National) Total Bare Cost.
12 Non-Priced Line Items
12.1 Any item of work not found in the UPB but required under an individual DO may be negotiated by the Contracting Officer as a non-priced line item (NPLI). The negotiated price of a NPLI will be the "in-place" price to include material, equipment, and labor (exclusive of the contractor's or subcontractor's indirect expenses such as overhead, profit, labor burden, etc.) multiplied by the applicable percentage factor (coefficient) in effect at the time of submission.
12.2 The total dollar amount of all NPLIs for an individual DO cannot exceed 10% of the total cost of the DO unless a waiver is obtained from the Contracting Officer. A DO will not be issued when the total amount of all non-priced items exceeds 25% of the total estimated cost of a specific DO. The contractor shall track the total non-priced (cost) percentage for each DO and shall clearly indicate the percentage on each new DO or modification proposal.
12.3 If the contractor's DO proposal includes any NPLIs, the items cost shall be negotiated. The burden of justification for the dollar value of the NPLI falls on the contractor, who shall provide documentation of the actual-installed cost of the item. The following documentation shall be provided as part of the proposed effort: a minimum of three independent written price quotes which shall include material description with unit price and installation cost. The price quotes must be submitted on the contractor’s letterhead and be signed by the owner or authorized representative of the contractor.
12.4 Although NPLIs of work will be negotiated, this will not be construed to include elements of work which are not separately priced but which are incidental to or are customarily required for performance of a priced item of work.
12.5 NPLIs are priced for the local market and therefore are not adjusted by the local CCI.
13 Total Project Cost
13.1 The total project cost is derived using the RS MEANS (National) Total Bare Cost for each CLIN required to complete the project, the corresponding CCI and the contractor’s derived coefficient. Numbers listed below are used as examples only.
13.2 The RS MEANS (National) Total Bare Cost line items are multiplied by the contractor’s coefficient and the CCI as follows:
(RS MEANS (National) Total Bare Cost) x (CCI) x (coefficient) = Total Cost
13.3 The following is a numerical example for further clarification:
RS MEANS (National) Total Bare Cost = $10K
Los Angeles, CA CCI = 107.2%
Contractor’s Coefficient = 15%
($10K) x (1.072) x (1.15) = $12,328
14 Delivery Order Procedures
14.1 As the need exists for performance under the terms of this contract, the Contracting Officer will notify the contractor of an existing performance requirement and request a price from the contractor for a "one job, lump sum" DO. The Government will provide to the contractor a RFP inclusive of a SOO describing the work to be performed, which may include special instructions and conditions, any applicable drawings or documents (see Section 14.4.2), and potentially an AF Form 66, Schedule of Material Submittal. The contractor shall not be reimbursed for any pre-DO costs including proposal preparation (to include site verification, field measurements or quantity survey) and attendance during negotiations or site visits.
14.2 The contractor shall respond to the RFP within three working days by visiting the proposed work site with the Contracting Officer or COR, the SABER PM, and a representative of the using agency (typically 61 CELS). The purpose of this site visit will be to establish a clear understanding between the contractor and Government as to what work will be required in the DO. On-site changes may be made to the SOO or drawings at this time if the contractor or the Government identifies items of work that have been left out which need to be accomplished as part of the DO.
14.3 Upon establishment of the requirements of the individual DO, the contractor shall then prepare a detailed proposal by identifying tasks, refining quantities, developing cost estimate, preparing construction drawings, detailed engineering plans and drawings (as the requirements exists), developing performance times, and preparing all proposal documents, which includes a detailed SOW of proposed work, for submission to the Contracting Officer.
14.4 Priced Line Items
14.4.1 The RS MEANS UPB shall serve as the basis for establishing the value of the work to be performed on a unit price basis. Quantities calculated in preparing estimates/proposals for DOs shall be bare costs (not to include Overhead and Profit pricing) of materials, equipment, and labor for each work item, without markups for Overhead and Profit. The bare cost shall be adjusted by the appropriate RS MEANS City Cost Index (CCI), and then the total result multiplied by the contractor’s coefficient to get the total amount for each DO. Actual measured quantities shall be used for quantity take-offs.
14.4.2 The contractor's proposal for each DO shall be supported by necessary documentation as required, to indicate that adequate engineering and planning to accomplish the requirement have been done so as to minimize any delays in the construction process. Examples of documentation that might reasonably be expected include sketches, construction drawings, calculations, catalog cuts, specifications, and architectural renderings.
14.4.3 The contractor's proposal on each DO shall also be supported by a detailed materials take-off with applicable pricing applied from the UPB.
14.4.4 Cost proposals shall be submitted in the format approved by the Contracting Officer. The contractor’s coefficient will be applied to the RS MEANS Total National Total Bare Cost, after the Appropriate Cost Index is applied, as shown below:
(RS MEANS National Bare Cost) x (CCI) x (contractor’s coefficient) = Total Cost
14.4.5 Time allowed for submittal of the contractor's proposal documents for individual DO requirements will be 10 calendar days from the date of site visit or as agreed upon by the Contracting Officer and the contractor.
14.5 Non-Priced Line Items (NPLI)
14.5.1 All non-priced work to be included in an individual DO proposal shall be supported with the information called for in Section 12, NPLIs.
14.5.2 NPLIs are totaled differently than priced line items using only the RS MEANS National Total Bare Cost multiplied by the contractor’s coefficient. The CCI is not used in the calculation of the total cost for NPLIs.
(RS MEANS (National) Total Bare Cost for NPLIs) x (contractor’s coefficient) = Total Cost
14.6 Upon receipt of the contractor's proposal, the Government will review the proposal for completeness. In most cases this will require a technical evaluation by the 61 CELS, unless agreed upon by the Contracting Officer and 61 CELS.
14.7 A DO will be issued by the Contracting Officer using a DD Form 1155, Order for Supplies or Services, if it is in the best interest of the Government to do so.
14.8 If differing site conditions or changes to the requirements are encountered after DO award, a modification to the DO will be made as appropriate.
14.9 The contractor shall be required to submit weekly payroll reports for office staff to the Contracting Officer for the duration of the contract. For each DO issued, a weekly payroll report shall be submitted to the Contracting Officer in order to ensure compliance with the Davis Bacon wage rate.
14.10 Normally, the contractor will only be paid monthly for completed DOs. If the performance period of a DO exceeds 60 days, partial payments may be authorized.
15 Computer And Software Requirements
15.1 The “e4Clicks Professional Project Estimator” or “e4Clicks Premier Project Estimator" software in conjunction with the current year RS MEANS Master Composite Bare Cost Database will constitute the UPB for this contract. This UPB will be used by both the Government and contractor to develop estimates and proposals for each DO, including modifications.
15.2 The contractor shall provide and maintain “e4Clicks” estimating software and RS MEANS data book. The contractor shall provide, install, and maintain all computer hardware for contractor’s use.

Updates shall be provided when RS MEANS updates become available throughout the term of this contract. The Government and contractor will schedule the annual updating of the RS MEANS Facilities Construction and Master Composite cost database so that it occurs at the same time.
15.6 The contractor shall also install and maintain a copy of the latest version of AutoCAD (to be verified by Contracting Officer) on contractor’s equipment for the development of construction drawings and as-built drawings. All drawings submitted by the contractor shall be created from AutoCAD software. Drawing files shall be compatible with AutoCAD, without any need for translation or modification by the Government. AutoCAD drawings shall comply with the Tri-Service Center’s A/E/C and spatial data standards.
Custom menus, line types and text styles shall not be used without prior approval of the Contracting Officer. All external reference drawings if used shall be provided with the basic drawing and be modifiable if required. The contractor shall submit all AutoCAD drawing files on a CD-ROM. License renewal of AutoCAD software shall be the responsibility of the contractor.
16 Pre-Construction Conference
