About this file

This is a Certificate of Bidder/Contractor Employee Drug Testing Program for RFP No. 2026004, issued by the Northern Wasco County People's Utility District in Oregon. The certificate establishes compliance requirements for the Fiber to the Premises (FTTP) Fiber Optic Construction Services project, which involves the installation of aerial and underground fiber optic infrastructure, including service drops and associated network equipment at customer premises. The Northern Wasco County People's Utility District requires all bidders and contractors to demonstrate implementation of a comprehensive employee drug testing program as a condition of contract award. This certification becomes a continuing representation and warranty throughout the contract term and is binding upon contract execution.

Bidders must certify that they maintain and enforce a written employee drug testing policy meeting minimum standards, including pre-employment drug testing, reasonable cause drug testing for employees suspected of drug use, and compliance with Oregon Department of Transportation Commercial Driver's License drug testing regulations. Bidders must make their current written employee drug testing policies available for inspection by the District upon request. Breach of these representations and warranties constitutes grounds for debarment under Oregon Revised Statutes 279C.130. The District assumes no liability for disputes arising from the contractor's drug testing program substance or procedures, nor for contractor negligence in establishing, implementing, or failing to implement such policies. The contractor bears sole responsibility for all damages or injuries resulting from employees acting under the influence of drugs while performing contract work.

2) A copy of the Bidder/Proposer’s current written employee drug testing policy will be available for inspection by the District at any time upon the District’s request.

The District shall not be liable, either directly or indirectly, in any dispute arising out of the substance or procedure of Contractor’s drug testing program. Nothing in this drug testing provision shall be construed as requiring Contractor to violate any legal, including constitutional, rights or any employee, including but not limited to, selection of which employees to test and the manner of such testing. Northern WASCO PUD shall not be liable for Contractor’s negligence in establishing or implementing, failure to establish or implement a drug testing policy, or for any damage or injury caused by
