About this file

This is a First-Tier Subcontractor Disclosure Form for RFP No. 2026004, issued by the Northern Wasco County People's Utility District in Oregon. The form is required to be submitted by offerors with their proposal for Fiber to the Premises (FTTP) Fiber Optic Construction Services, which involves aerial and underground fiber installation, service drop installation, and network equipment deployment at customer premises. The disclosure form must be submitted either with the proposal by the bid opening date or within two working hours after the advertised opening date. Failure to submit this form by either of these two deadline options results in rejection of the proposal as nonresponsive and ineligible for contract award consideration.

Offerors must disclose all first-tier subcontractors that meet specific thresholds: subcontract values equal to or greater than 5 percent of the project bid amount (with a minimum of $15,000) or $350,000 regardless of percentage. Required disclosure information includes the subcontractor's name, dollar value of the subcontract, and the category of work to be performed. If no subcontractors meeting these criteria will be utilized, offerors must indicate "NONE" on the form. The disclosure requirement applies because NWASCOPUD estimates the contract value for this public improvement project to exceed $100,000. First-tier subcontractor disclosure forms not included in the initial proposal submission must be returned via OregonBuys or email within two working hours after the proposal due date and time. Compliance with disclosure and submittal requirements is mandatory for responsiveness, and NWASCOPUD may reject any offer that fails to meet these requirements.

First-Tier Subcontractor Disclosure forms (attached as Exhibit G to this RFP) not included in the proposal submission must be returned via OregonBuys within two working hours after the proposals due date/time, or via e-mail within two working hours after the proposals submission due date/time directed to the SPC, if this disclosure form(s) cannot be submitted via OregonBuys. Failure to comply with this First-Tier Subcontractor Disclosure submission requirement will result in rejection of the proposal as non-responsive.

SUBSTANTIAL COMPLIANCE REQUIRED

Proposals not in substantial compliance with RFP requirements cannot be considered and cannot be supplemented by submissions delivered after the stated due date/time (with the exception of First-Tier Subcontractor Disclosure Forms submitted within 2 working hours of Opening Date). However, NWASCOPUD may waive minor informalities as described in OAR 137-049-0350, and NWASCOPUD may seek clarification of any response that, in its sole discretion, it deems necessary or advisable.

FIRST-TIER SUBCONTRACTOR DISCLOSURE INSTRUCTIONS AND FORM

Pursuant to ORS 279C.370 and OAR 125-249-0360, Offerors are required to disclose information about certain first-tier subcontractors when NWASCOPUD estimates the Contract value for a Public Improvement to be greater than $100,000. Specifically, when the Contract amount of a first-tier subcontractor furnishing labor, or labor and materials, would be greater than or equal to: (i) 5% of the project Bid, but at least $15,000, or (ii) $350,000 regardless of the percentage, the proposer must disclose the following information about that subcontract in its proposal submission or within two (2) working hours after the established due date/time. Below information must be provided on the form. See Exhibit G for details.

(a) The subcontractor's name,

(b) Dollar value and,

(c) The category of work that the subcontractor would be performing.

If the Offeror will not be using any subcontractors that are subject to the above disclosure requirements, the Offeror is required to indicate "NONE" on the Disclosure Form.

NWASCOPUD MUST REJECT AN OFFER IF THE OFFEROR FAILS TO SUBMIT THE DISCLOSURE

FORM WITH THIS INFORMATION BY THE STATED DEADLINE.

Compliance with the disclosure and submittal requirements is a matter of responsiveness. Offers which are submitted by the Opening Date, but for which the disclosure forms have not been made by one of the two (2) alternative deadlines, are not responsive and shall not be considered for Contract award.

NWASCOPUD shall obtain, and make available for public inspection via OregonBuys, the disclosure forms required by OAR 125-249-0360. NWASCOPUD is not required to determine the accuracy or completeness of the information submitted. Substitution of affected first-tier subcontractors shall be made only in accordance with ORS 279C.585.
