About this file

This is a Standard Purchase Order Terms and Conditions document issued by the Northern Wasco County People's Utility District (NWCPUD) in Oregon for RFP No. 2026004, Fiber to the Premises (FTTP) Fiber Optic Construction Services. The RFP seeks licensed and qualified contractors with experience in aerial and underground FTTP construction, including the installation of service drops and associated network equipment at premises. The document establishes the contractual framework governing the relationship between NWCPUD and selected contractors for this fiber optic construction project.

The terms and conditions establish that all pricing shall be Delivered Duty Paid (DDP) to the delivery point, with contractors bearing responsibility for all damage prior to NWCPUD acceptance. Goods must conform to NWCPUD specifications and be new, current model equipment carrying full manufacturer warranties. Contractors are required to provide Safety Data Sheets (SDS) for hazardous chemicals in compliance with OSHA regulations and must comply with all federal, state, and local laws, including Oregon's prevailing wage requirements administered by the Bureau of Labor and Industries (BOLI) and Oregon Workers' Compensation Law. Payment is made within Net 30 days following NWCPUD's acceptance of goods or services and receipt of a valid invoice. Contractors must obtain prior written approval for any assignment, sale, transfer, or subcontracting of contract rights or responsibilities. The contract incorporates Oregon Revised Statutes (ORS) 279A, 279B, and 279C requirements, limits NWCPUD's liability in accordance with Oregon law, and requires contractors to indemnify the District against third-party claims arising from the contractor's negligent or intentional acts or omissions.
