About this file
This is a Federal Funding Accountability and Transparency Act (FFATA) Certification Form 8040-A issued by the Texas Health and Human Services Commission (HHSC). The form serves as a certification document that contractors must complete to comply with federal reporting requirements. The form requires contractors to provide material certifications regarding their federal funding and compensation information, with the understanding that HHSC will rely on these certifications when reporting to the federal government. Contractors must certify their responses accurately and provide immediate written notice to HHSC if any certification becomes erroneous due to changed circumstances or if they cannot certify all statements.
The certification form contains three primary sections addressing federal funding thresholds and compensation disclosure. Section A requires contractors to certify whether their organization received 80% or more of annual gross revenue from federal awards during the preceding fiscal year. Section B requires certification of whether the organization received $25 million or more in annual gross revenues from federal awards in the preceding fiscal year. Section C, applicable only if both Sections A and B are answered affirmatively, requires disclosure of public access to compensation information for highly compensated officers and senior executives through Securities Exchange Act filings or Internal Revenue Code Section 6104 reports. If the organization does not have publicly available compensation information, it must provide the names and total compensation of the top five highly compensated officers or senior executives. The authorized representative must sign and date the form and provide applicable HHSC contract numbers.
