About this file
Summary
This is a Department of the Army permit issued by the U.S. Army Corps of Engineers, Jacksonville District, authorizing Florida Keys Electric Cooperative Association to install a 590 linear foot fiber optic cable crossing at Vaca Cut in Marathon, Florida. The permit, designated SAJ-2026-00706 (NWP-ICF), was issued on May 20, 2026, and authorizes the installation of 144-strand All Dielectric Self-Supporting (ADSS) fiber optic cable between existing poles at coordinates 24.730814°, -81.028699° and 24.730464°, -81.030434°. The project involves installing overhead wire above the lowest existing line across the Vaca Cut channel that intersects U.S. Route 1. The permit was issued under Nationwide Permit 57 (Electric Utility Line and Telecommunications Activities) pursuant to Section 10 of the Rivers and Harbors Act of 1899 and is valid until March 15, 2031. The permittee must complete the work within this timeframe and comply with all General Conditions, Jacksonville District Regional Conditions, and project-specific special conditions specified in the permit.
The permit includes comprehensive special conditions addressing safety, cultural resources, water quality certification, coastal zone management, and compliance requirements. Installation safety measures require use of a truck-mounted reel with friction brake assembly and handline control to prevent the fiber from falling into or above Vaca Cut, with no anticipated contact with water or channel floor. The permittee must submit an ENG Form 6285 certification of compliance within 60 days of work completion, maintain a copy of the permit and approved plans at the construction site, and coordinate with utility locating services prior to construction. Additionally, the permittee is responsible for obtaining any required authorizations from the Florida Keys National Marine Sanctuary and must comply with Florida Electric Transmission Line Siting Act requirements and state sovereignty submerged lands regulations. All right-of-ways must be restored to original or better condition, and the permittee must allow Corps representatives to inspect the activity at any time to ensure compliance.

Dear Mr. Arnold:
The U.S. Army Corps of Engineers (Corps) has completed the review of your application for a Department of the Army permit received on March 13, 2026. Your application was assigned file number SAJ-2026-00706. A review of the information and drawings provided indicates that the proposed work would result in the installation of a 590 linear foot fiber optic cable from one existing pole to another existing pole on either end of Vaca cut. The activities subject to this permit are authorized pursuant to authorities under Section 10 of the Rivers and Harbors Act of 1899 (33 U.S.C. § 403). The project would affect waters of the United States associated with Vaca Cut within the Atlantic Ocean. The project is located at a Channel crossing in Marathon, between coordinates 24.730814,º, -81.028699º and 24.730464º, -81.0304340º, in Monroe County, Florida.
Your project, as depicted on the enclosed drawings stamped on May 14, 2026, is authorized by Nationwide Permit (NWP) 57 (Electric Utility Line and Telecommunications Activities). This verification is valid until March 15, 2031. In order for this NWP authorization to be valid, you must ensure that the work is performed in accordance with the Nationwide Permit General Conditions, the Jacksonville District Regional Conditions, and the General and Project-Specific Special Conditions listed below. Furthermore, if you commence or are under contract to commence this activity before the date that the relevant NWP is modified or revoked, you will have 12 months from the date of the modification or revocation of the NWP to complete the activity under the present terms and conditions of this NWP. You can access the U.S. Army Corps of Engineers' (Corps) Jacksonville District's Regulatory Source Book webpage for links to view NWP information at:
https://www.saj.usace.army.mil/Missions/Regulatory/Source-Book/. Please be aware this Internet address is case sensitive and should be entered as it appears above. Once there, you will need to select “Nationwide Permits.” Among other things, this part of the Source Book contains links to the federal register containing the text of the pertinent NWP authorization and the associated NWP general conditions, as well as separate links to the regional conditions applicable to the pertinent NWP verification.

6. Assurance of Navigation and Maintenance: The Permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structures or work herein authorized, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the Permittee will be required, upon due notice from the U.S.
Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. No claim shall be made against the United States on account of any such removal or alteration.
7. Water Quality Certification (WQC) and Coastal Zone Management Act
(CZMA) Condition: Prior to construction, activities qualifying for a nationwide permit 57 (NWP 57) must be authorized by a written final order granting certification pursuant to the Florida Electric Transmission Line Siting Act (for electric utility line activities), or authorized by the applicable permit or exemption under Part IV of Chapter 373, F.S. (for telecommunication line activities), and by any authorization required to use or occupy sovereignty submerged lands (SSL) under Chapter 253, F.S., and as applicable, Chapter 258, F.S.
This letter of authorization does not include conditions that would prevent the ‘take’ of a state-listed fish or wildlife species. These species are protected under sec. 379.411, Florida Statutes, and listed under Rule 68A-27, Florida Administrative Code. With regard to fish and wildlife species designated as species of special concern or threatened by the State of Florida, you are responsible for coordinating directly with the Florida Fish and Wildlife Conservation Commission (FWC). You can visit the FWC license and permitting webpage (http://www.myfwc.com/license/wildlife/) for more information, including a list of those fish and wildlife species designated as species of special concern or threatened.
The Florida Natural Areas Inventory (http://www.fnai.org/) also maintains updated lists, by county, of documented occurrences of those species.
