About this file
This is a Supplementary General Conditions attachment for a state and local contract opportunity. The document outlines two critical contractual requirements that the contractor must meet during the contract term. The first requirement mandates that the contractor obtain and maintain umbrella liability insurance throughout the contract period in an amount equal to one hundred percent (100%) of the total awarded contract sum, including any selected alternate pricing amounts. This umbrella coverage must be at least as broad as the primary liability coverages and apply in excess of and follow form of those primary coverages, with "drop down" provisions to ensure protection where underlying primary insurance limits are insufficient or become exhausted.
The second requirement establishes liquidated damages at $1,000.00 per day, which represents the predetermined compensation for contract breaches or non-performance. This daily rate serves as the measure of damages for failures to meet contractual obligations, eliminating the need to prove actual damages in the event of default.
