The purpose of this Amendment is to provide a summary of responses to questions/clarifications asked by potential bidders.

The Bid Opening date of March 28, 2017, at 2:00 p.m. will remain the same.

Questions / Clarifications

Bidders can send written questions or inquiries for clarification to: eflhd.contracts@dot.gov.

Questions can be submitted at any time, but questions submitted within 7 days of the bid opening may not be answered in time for the bidder to properly incorporate the responses into their bids.

1. I have a question on the time limits on the project. It is my understanding that the project has to be completed by September 30, 2017. It has been a base Schedule A and then adds on up to Alternate Schedule G. If the time allowed for each alternate is added together, it is 285 days which will put the completion date well past the September 30 deadline.

Another factor is the micro needs to cure for 30 days prior to striping which equates to complete the macro by September 1.

Could you clarify the completion dates of each schedule and if all six options are accepted, what would be the overall completion date?

Response: Please refer to section 2.C. Completion of Work found on page 5 of the Proposal Schedule Instructions.

It is the Government's intention to award all schedules of work (Schedules A thru G) of the solicitation at one time.

However, if any additional funding beyond the Government's Engineer's Estimate is required to award the contract (i.e., the bids come in high), not all schedules will be awarded at one time. The Base Contract (Schedule A) will be awarded and some combination of the Government Options (Schedules B thru G) will be awarded based on the funding available. If funding becomes available after the award of the Base Contract (Schedule A), the Government will make a determination on which, if any, of the remaining Government Options (Schedules B thru G) will be awarded.

As stated in section 2.C. Completion of Work found on page 5 of the Proposal Schedule Instructions, if all schedules (A thru G) of work are awarded at one time, all contract work (A thru G) is required to be completed by September 30, 2017.

The bidder points out that if the performance periods of each of the individual schedules of work are added together, they add up to 285 calendar days. This 285 day calculation is true but it is based on the assumption that the individual schedules would be awarded individually and that only one schedule would be available to be worked on at one time (i.e., working in series). The Government's calculation of completing work by September 30 is based on the assumption that all schedules would be awarded at one time and that all schedules would have overlapping work periods (i.e., working concurrently).

Additional information can also be found in section 2.B. Schedules of Work found on page 4 of the Proposal Schedule Instructions. This explains the award timeframes if the individual schedules of work are not awarded at the same time as Schedule A (the Base Contract). If Schedule A only is awarded, Schedule B would be awarded (or decision not to award would be made) no later than the completion of Schedule A (i.e., 65 calendar days after Schedule A's Notice to Proceed). As also explained in section 2.B. Schedules of Work, if Schedule B is awarded, the decision to award the remaining schedules (C thru G), would be made by the completion of Schedule B (i.e., 35 calendar days after Schedule B's Notice to Proceed, or 100 total calendar days after the initial award of the contract). The Government has estimated that there should be adequate time to complete the remaining C thru G work by the September 30 completion date. If the actual award scenarios do not happen as explained in sections 2.B. and 2.C. of the Proposal Schedule Instructions, then a mutual agreement will be worked out with the Contractor and the Government.

Please also see the last paragraph of section 2.C. Completion of Work (which can be found on page 6), which states that Offerors are to assume that the start of construction activities is anticipated to start no earlier than May 2017.

To address the bidder's concern with curing time for micro surfacing and striping application, any type of manufacturer/supplier recommendations can be discussed with the CO during construction.
