If the Government’s requirements for services set forth in the statement of work do not result in orders in the amount described as “estimated maximum,” the event shall not constitute the basis for an equitable price adjustment under this contract.
C.1.4 Objective
This contract is intended to provide for a full range of new construction, alterations, maintenance, repair, sustainment, restoration, and modernization services for the U.S.
Army Garrison and the tenant organizations located at Redstone Arsenal (RSA).
Potential projects include administrative facilities; base support and facility maintenance shops; child development centers; physical fitness centers; vehicle maintenance and engine repair shops; food service facilities; public safety facilities (police, fire, and crash rescue); airfield structures (including rigid and flexible paving); roads; ball fields;
bridges; underground utilities; overhead utilities; gates; warehouses; auditoriums; and research, development, and testing facilities. The work may also include incidental design and testing, studies, and survey and abatement for lead based paint (LBP) and asbestos containing materials (ACM). Facility repairs, renovations and construction shall conform to the requirements of the technical criteria listed in the task order. These objectives shall be achieved through the implementation of task orders issued under the terms of this contract for all the herein described tasks or additional tasks described in specific task orders.
C.2 Scope of Work
Except when specified as Government furnished, upon receipt of a task order, the Contractor shall provide, all work, materials, supplies, parts (to include system components), plant, supervision, labor, and equipment, to repair, maintain, alter, or construct real property facilities and structures at RSA, Alabama. All work shall be performed in strict accordance with all the terms, conditions, special contract requirements, specifications, drawings, attachments, and exhibits contained in this contract.
C.2.1 Management of Work
The Contractor’s work and responsibility shall include all contractor planning, programming, administration, and management necessary to provide all repair or construction and related services as specified. The Contractor shall conduct the work in strict accordance with the contract, to include the Contractor’s proposal and all applicable Federal, State of Alabama, and local laws, regulations, codes, or directives.
The Contractor shall ensure that all work provided meets or exceeds critical reliability rates or tolerances specified or included in applicable specifications. The Contractor shall provide all related Contractor administration services to perform the work such as quality control, Contractor financial control, preparing and submitting required reports, and submitting necessary information as specified under this contract and within individual task orders.
C.2.1.1 Task Order Coordination
Prior to scheduling work for a task order, the Contractor shall coordinate with the Contracting Officer’s Representative (COR), and the staff of occupied facilities, and agree on a sequence of procedure; means of access to premises and building; space for storage of materials and equipment; delivery of materials and use of approaches;
and use of corridors, stairways, elevators, eating spaces, and restrooms for Contractor personnel.
C.2.1.2 Subcontractor Coordination
The Contractor shall coordinate with the subcontractors and ensure that everything in the scope of work (SOW) and on the drawings is included in subcontractor bids and is properly completed prior to the final inspection.
C.2.1.3 Workload Management
The Contractor shall be responsible for managing multiple, simultaneous task orders to meet the JOC requirements of the USAG-Redstone and various tenant organizations on RSA. Therefore, it is imperative that the Contractor coordinate, schedule, and manage the overall workload of the JOC and communicate with the Government Project Managers and COR. The Contractor shall submit an annual execution report of the contractor’s completed and in-process task order performance of the contract within 10 days of the expiration of each contract year IAW Attachment J22, Contract Data
Requirements List (CDRL) A001. The report must contain, at a minimum, a listing of all issued task orders by contract year, award date, awarded and final cost of each task order broken down by contract line item (CLIN), percent invoiced, period of performance, completion date, awarded duration and actual duration for completion of the task order (in workdays).
C.2.2 Unit Price Book (UPB)
The UPB contains pricing information for the description of work to be accomplished and for the unit of measure specified. The UPB will be revised for each year of the contract considering current Davis Bacon Wage Rates and current material and equipment pricing for the local area. Items of work that are not covered in the UPB but that are within the scope and general intent of the contract may be negotiated by the Contracting Officer (KO) or designated representative. These items shall be designated as non-prepriced work and shall be incorporated into and made a part of the task order.
C.2.2.1 UPB Prices
Prices in the UPB include the following: direct labor through the foreman level at current Davis-Bacon wage rates for the area, equipment costs for the region, tools and material costs including delivery, sales tax, and all incidentals. Incidentals are items such as nails, screws, welds, and connectors. All prices in the UPB are for complete and in-place construction unless explicitly described otherwise. Waste or excess material quantities are incidental costs which are included within the UPB prices.
Quantities used on individual task order proposals shall be taken from field measurements or design plans, as appropriate, without allowance for waste.
C.2.2.2 UPB Price Adjustment Modifiers
The UPB presented under this contract contains unit pricing data to be used by the Contractor in development of price proposals for each task order. The pricing data is presented as basic items and as price adjustment modifiers to the basic item. Price adjustment modifiers provide a method for adding to or deducting from the basic item prices for optional materials, and/or methods of installation. One or more modifiers can be applied to adjust the basic item price.
C.2.2.3 Non-Prepriced Prices
Non-prepriced items that are incorporated into a task order shall include bare costs only (direct labor, subcontractor overhead and profit, material, sales tax, equipment costs, and shipping and handling). Prime Contractor overhead and profit, etc. will be added by the coefficient factor for non-prepriced items. The Contractor shall submit a minimum of two (2) vendor quotes, or other sources of information, to validate the bare cost proposal for non-prepriced items. The Government will review the quotes for fairness and reasonableness. If the quotes are validated by the Government, the lower of the two quotes shall be incorporated into the task order.
C.2.2.3.1 Using an Estimating Guide for Non-Prepriced Items
If an estimating guide is used to price a non-prepriced item for a task order, the bare cost of the item shall be adjusted by the area or city cost index. The coefficient factor for non-prepriced items shall then be applied. Estimating guides shall only be used when it is difficult to obtain two vendor quotes. At least one vendor quote must be obtained in addition to the estimating guide price.
C.2.2.3.2 Adding Non-prepriced Items to the UPB
Frequently used non-prepriced items will be added to the UPB prior to the beginning of the yearly revision. Items that are added to the UPB will be adjusted to reflect current labor, equipment, and material costs.
C.2.2.4 Volatile Price Conditions
In the event of volatile price conditions which result in substantial changes to construction material and equipment prices that result in significant total project cost impacts, the Contractor may request in writing that the Government consider an unscheduled update to the UPB to ensure that the UPB accurately depicts market conditions. If the Government agrees that the market conditions warrant an unscheduled revision, it will initiate the UPB update. The unscheduled revision of the UPB will consider current material and equipment pricing for the local area. The Davis Bacon Wage Rates will continue to be updated only during the execution of option periods; therefore, only the UPB revision concurrent with the exercise of the option will consider Davis Bacon Wage Rate changes. The Contractor shall utilize the UPB version current due date of initial proposal submission in accordance with (IAW) C.9.4 Proposal Delivery Requirements.
C.2.2.5 Technical Specifications The Contractor shall interpret specifications for tasks as follows: All labor, material, equipment, spare parts, services, and work required by a specification shall be considered part of the unit price unless the task description or technical specifications state otherwise.
C.2.2.6 Demolition
Demolition prices in the UPB cover the cost of removal and disposal of the items.
Demolition includes removal of the item, handling, disassembly if required, loading in a truck or dumpster, and disposal of demolished items, whether salvageable or non-salvageable, unless specified otherwise by the UPB task. Unit prices for demolition exclude costs for hauling.
C.3 Personnel
The Contractor shall provide all personnel necessary to accomplish all work within the time frames specified for each task order. All employees that interface with customers shall be able to speak and understand the English language.
C.3.1 Identification
The Contractor shall ensure that each employee obtains an identification badge from Security Forces. Each employee shall follow established Installation procedures for displaying their identification badge while within the boundaries of the Installation.
