About this file
This is an AIA Document A101-2007 Standard Form of Agreement Between Owner and Contractor executed by Dartmouth Fire District #3 in Massachusetts for the removal and installation of fuel storage tank systems. The project involves the selective removal of an existing underground fuel storage tank and accessories, coupled with the installation of a new above-ground fuel storage tank, fuel dispenser, and related piping and accessories. The contract is structured as a stipulated sum agreement with the contract sum and specific dates of commencement and substantial completion to be filled in by the parties. The work shall commence on the date of the agreement, with substantial completion dates and adjustments to contract time as outlined in the referenced AIA Document A201-2007 General Conditions. The contract documents include the agreement itself, general conditions, supplementary conditions, specifications, drawings, addenda, bid forms, bonds, certificates of compliance, prevailing wage rates documentation, and various Commonwealth of Massachusetts certifications related to non-collusion, conflict of interest, non-debarment, EEO/AA/SDO compliance, and state tax matters.
The contract is based on a stipulated sum payment structure with progress payments computed monthly, provided applications for payment are submitted to the architect by the fifth of each month, with payment due by the twentieth of that month. A five percent retainage is withheld from progress payments, with final payment constituted by the entire unpaid balance upon completion of work and issuance of a final certificate of payment, due no later than thirty days after certification. The estimated project value is One Hundred Eighty-Six Thousand Dollars ($186,000.00). Dispute resolution is designated as litigation in a court of competent jurisdiction rather than arbitration. The contractor must maintain insurance and provide performance and payment bonds as specified in the AIA Document A201-2007 General Conditions. Payments due and unpaid shall bear interest at the legal rate prevailing at the project location.
