RE: Florida Beaches Habitat Conservation Plan – Planning Assistance – Phase 1 Scope of Services
Dear Mr. Wettstein
Below please find the amended scope of work (SOW) to assist the Florida Department of Environmental Protection (FDEP or Department) in cooperation with the Florida Fish and Wildlife Conservation Commission (FWC or Commission) with updating and finalizing the Draft Florida Beaches Habitat Conservation Plan (FBHCP or plan) with the associated Incidental Take Permit (ITP) application to the U.S. Fish and Wildlife Service (FWS or Service).
Background The Department has obtained funding from the Service via the Cooperative Endangered Species Conservation Fund to provide planning assistance for the FBHCP. The Service is the responsible federal agency for approval of the FBHCP. The Department is the proposed applicant for an ITP addressing activities permitted seaward of the Coastal Construction Control Line (CCCL) in partnership with the Commission. The FBHCP has undergone 9 years of plan preparation and an additional 2 years of implementation strategy development.
The FBHCP and accompanying ITP application will encompass Florida’s beach and dune systems, approximately 825 miles of shoreline and 47,150 acres of federally and state listed species habitat, and coastal wildlife proposed for protection by Florida’s CCCL permitting program. This program will facilitate and coordinate state and federal coastal construction permitting, provide a means to foster relationships with stakeholders, reduce conflicts between listed species and economic development, and promote the long-term conservation of listed species and the ecosystems on which they depend.
Scope of Services Without full knowledge and access to the file record for the work completed in the previous 11 years of plan preparation and implementation strategy development, Atkins is unable to fully scope all the work within the requested budget. In order to proceed, Atkins proposes that the tasks requested for completion by FDEP undergo an orderly phased approach. To best accommodate the range of variables and unknown project elements, Phase 1, included herein, will include the review of existing materials and a situation assessment of stakeholder involvement conducted to date. At the completion of Phase 1, Atkins will gain an understanding of the work done to date in order to properly scope the remaining tasks within the given budget.
Phase 1 will include the following tasks as outlined, and numbered, in the Habitat Conservation Planning Assistance Grant Proposal (dated March 9, 2021): 1) FBHCP Update, 4) Outreach, and 5) Project Management. We are proposing to initiate task activities immediately upon Notice to Proceed (NTP). The specific details of these tasks are outlined herein and include deliverables, budget, and schedule.
The results of Phase 1 will provide insight into the level of effort necessary to complete the next phase of work. Atkins will lay out the options and associated costs for the next phase of work, as well as provide the preferred option towards completion of the FBHCP and present those options at the Large Group meeting on October 27, 2022. Note that If budget constraints limit the ability for Atkins to fully complete a task, the Phase 2 SOW will provide the constraints of what work can and cannot be completed. The Phase 2 SOW will include the specific details for the tasks including deliverables, budget, and schedule.
Task 1 – FBHCP/EA Review and Data Management Plan As part of this task under the Phase 1 SOW, Atkins will review the current draft of the FBHCP to identify any data gaps and/or missing information; assess the accuracy of data and premises of the FBHCP chapters; and assess the validity of threat, take, minimization, and mitigation components.
Atkins will also review the current draft of the accompanying Environmental Assessment (EA) to identify any data gaps and/or missing information. It is anticipated that FDEP will provide a data drive of FBHCP documents, supporting data, and newly digitized updated mean high-water line and vegetation line data upon NTP. Atkins will review the data and provide a detailed data gaps matrix, including GIS data needed to update the maps currently in the FBHCP in the next phase of work.
Atkins will then prepare a Technical Memo that presents the overall status of the draft FBHCP and EA and includes, as an attachment the detailed data gaps matrix for review by the agencies. Atkins will participate on a call with the agencies to discuss the findings and assessment of the current draft documents. In preparation for that call, Atkins will prepare a powerpoint presentation that provides a high level summary of those findings. The feedback and guidance provided by the agencies will help to inform the Phase 2 SOW.
As part of this task, after review of the current documents, data, and information provided, Atkins will assist with development of a Data Management Plan that outlines how to collect, catalogue, assess, manage, store, and share new and historic FBHCP planning documents, data or information. Atkins will prepare a Draft Data Management Plan for review by the agencies. Atkins will address any comments on the Draft Data Management Plan during the FBHCP/EA review call mentioned above. Atkins will address one round of comments from the agencies and prepare a Final Data Management Plan. Atkins will create a FBHCP project site via Microsoft Teams to share data and information, work products/deliverables, including this Data Management Plan, and other documentation with the agencies throughout further development of the HCP.
Deliverables for Task 1 will include: FBHCP/EA Review Technical Memo with detailed data gaps matrix for the FBHCP and EA, FBHCP/EA Review call powerpoint presentation, Draft Data Management Plan, Final Data Management Plan, and project Teams site populated with files and work products.
Completion Date: Approximately 92 days upon receipt of the above referenced materials from FDEP (i.e., draft documents, supporting data, GIS shapefiles, and newly digitized updated mean high-water and vegetation line baseline data), inclusive of the FBHCP/EA review call (August 18, 2022) with the agencies to present the findings on the current draft documents.
Task 2 – Situation Assessment As part of this task, Atkins will review the current CCCL program rules and procedures and conduct a situation analysis of the FBHCP development materials prepared to date for the project. It is anticipated that FDEP will provide all previous stakeholder outreach materials, including but not limited to, steering committee meeting presentations and minutes, Working Group activities, and previous contract deliverables. Atkins will prepare a Technical Memo summarizing the analysis and findings for review by the agencies. Atkins will participate in one in-person meeting with the agencies to present the findings of both the Situation Assessment and FBHCP/EA review. Atkins will prepare a PowerPoint presentation, assist FDEP with the meeting agenda, and provide feedback on the meeting notes. Without prior knowledge of the materials prepared to date and the interactions amongst the various stakeholders, interview sessions and/or surveys with agency staff are not recommended and may be included as a future task under a separate SOW as needed.
Deliverables for Task 2 will include: Situation Analysis Technical Memo, digital copy of PowerPoint presentation, meeting agenda additions, and meeting note additions.
Completion Date: Approximately 60 days upon receipt of the above referenced materials from FDEP (i.e., all previous stakeholder outreach materials), inclusive of the in-person meeting with the agencies on October 27, 2022.
Task 3 – Project Management & Quality Control This task involves coordination of the above tasks amongst team members, monitoring workflow and deliverables, project scheduling, budget tracking and invoicing, and quality control on all work products or deliverables. Additional administrative support includes scheduling and hosting calls and/or virtual meetings with FDEP and other agency staff. As part of this task, Atkins will lay out the options and associated costs for the next phase of work, as well as provide the preferred option towards completion of the FBHCP.
Deliverable for Task 3 will include: amended Phase 1 SOW and Phase 2 SOW options and costs.
Completion Date: Duration of work for Task 3 will be over an approximate 5-month period to complete the tasks under Phase 1 SOW, inclusive of participation in the FBHCP Large Group meeting on October 27, 2022.
Project Costs The Phase 1 SOW is proposed on a lump sum basis and a not to exceed budget of $58,197.22 as summarized below. Atkins will prepare one invoice for submittal to FDEP for payment once all tasks are complete and no further charges are to be incurred. Attached is a breakdown of costs by labor hours and rates based on the rate schedule included in the Professional Services Contract No.
