About this file

This is a Certification of Offeror/Bidder document issued by the Kenton County Airport Board for the HVAC Controls and Infrastructure Upgrades project at Cincinnati/Northern Kentucky International Airport. Offerors must complete two mandatory certification statements regarding tax delinquency and felony convictions, indicating whether they have unpaid Federal tax liabilities that are not being paid in a timely manner under an agreement with the taxing authority, or whether they have been convicted of a criminal violation under Federal law within the preceding 24 months. A mandatory pre-bid meeting and site visit is scheduled for Thursday, January 29, 2026 at 10:00 a.m. at CVG Airport's Main Terminal Ticketing area, with RSVPs required by January 28, 2026. Written questions must be submitted by 11:59 p.m. on Monday, February 9, 2026, with responses posted by Thursday, February 12, 2026. Sealed bids are due electronically by 2:00 p.m. Eastern Time on Thursday, February 19, 2026. The project involves design and installation of HVAC control system infrastructure across Concourse A (13 control panels and controllers) and Concourse B (16 control panels and controllers), with all work required to be completed by December 31, 2026, and a one-year warranty period following final acceptance with an optional three-year renewal for annual support.

Any applicant responding affirmatively to either certification requirement is ineligible to receive an award unless the agency's suspension and debarment official has determined that further action is not required to protect the Government's interests. Applicants must provide detailed information regarding any tax liability or conviction to the project owner, who will notify the FAA Airports District Office to facilitate the required debarment considerations before award decisions are made. Tax delinquency is defined as any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the taxing authority. Felony conviction is defined as a conviction within the preceding 24 months of a felony criminal violation under any Federal law and includes conviction of an offense defined in the U.S. Code that specifically classifies the offense as a felony or that is classified as a felony under 18 U.S.C. 3559. Offerors must agree to incorporate these certification provisions in all lower-tier subcontracts if awarded the contract.

PROJECT NAME

CERTIFICATION OF OFFEROR/BIDDER REGARDING TAX DELINQUENCY AND FELONY CONVICTIONS

The applicant must complete the following two certification statements. The applicant must indicate its current status as it relates to tax delinquency and felony conviction by inserting a checkmark (ü) in the space following the applicable response. The applicant agrees that, if awarded a contract resulting from this solicitation, it will incorporate this provision for certification in all lower tier subcontracts.

Certifications

1) The applicant represents that it is (____) is not (____) a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability.

2) The applicant represents that it is (____) is not (____) a corporation that was convicted of a criminal violation under any Federal law within the preceding 24 months.

Note If an applicant responds in the affirmative to either of the above representations, the applicant is ineligible to receive an award unless the sponsor has received notification from the agency suspension and debarment official (SDO) that the SDO has considered suspension or debarment and determined that further action is not required to protect the Government’s interests. The applicant therefore must provide information to the Owner about its tax liability or conviction, who will then notify the FAA Airports District Office, which will then notify the agency’s SDO to facilitate completion of the required considerations before award decisions are made.
