About this file
This is a Buy American Certification document issued by the Kenton County Airport Board for the Cincinnati/Northern Kentucky International Airport's 2026 Fall Protection Systems Installation project. The certification establishes compliance requirements with 49 USC 50101, which mandates that all steel and manufactured goods used in Airport Improvement Program (AIP)-funded projects must be produced in the United States unless the FAA has issued a waiver or the product qualifies as an excepted article or material. Bidders must complete and submit the certification with their proposal by the April 16, 2026 bid deadline at 2:00 pm. Bidders must select one of four mutually exclusive certification statements indicating their compliance approach: installing only U.S.-produced materials; installing specified construction materials manufactured in the United States; installing FAA-waivered products; or installing excepted articles listed in Federal Acquisition Regulation Subpart 25.108. Bidders selecting the fourth option certifying inability to meet 100 percent Buy American preferences must submit a formal waiver request within 15 calendar days of selection as the responsive bidder, with failure to provide required documentation resulting in rejection. Waiver types include Type 2 (Nonavailability), Type 3 (Domestic content exceeding 60 percent of component costs), and Type 4 (Unreasonable costs exceeding 25 percent of project cost), each requiring specific documentation including content percentage worksheets, final assembly questionnaires, and market research records. False certifications may subject the maker to prosecution under Title 18 of the United States Code.
