About this file
This is a Buy American Certification document applicable to the Kenton County Airport Board's 2026 Fall Protection Systems Installation project in Kentucky. The document establishes federal compliance requirements for all steel and manufactured goods used in Airport Improvement Program (AIP)-funded construction projects. Bidders must certify their compliance method by selecting one of three mutually exclusive options: installing only U.S.-produced steel and manufactured products; installing products for which the FAA has issued a waiver and are listed on the FAA Nationwide Buy American Waivers Issued list; or installing products designated as Excepted Articles, Materials, or Supplies under Federal Acquisition Regulation Subpart 25.108. The certification statement must be completed, signed, dated, and submitted with each proposal as a matter of bid responsiveness. A pre-bid meeting and site visit are scheduled for Thursday, March 19, 2026 at 10:00 am at CVG Centre, Admin. Offices in Erlanger, Kentucky. Questions must be submitted by 11:59 pm on Friday, April 3, 2026, with answers posted by 11:59 pm on Tuesday, April 7, 2026. Bids are due by Thursday, April 16, 2026 at 2:00 pm and cover three separate bid packages: Storm Water Treatment Plant Fall Protection Components and Confined Space Equipment; T3 Parking Deck Fall Protection Components; and Concourse A Roof Fall Protection Components.
Bidders selecting the first certification option agree to provide evidence documenting the source and origin of steel and manufactured products and comply with domestic product requirements. Bidders selecting the second option and submitting the apparent low bid must submit a formal waiver request with supporting documentation within 15 calendar days of bid opening, with failure to do so resulting in proposal rejection. Type 3 waivers require documentation demonstrating that U.S.-produced components comprise more than 60 percent of item costs, while Type 4 waivers require cost comparisons showing U.S. domestic sourcing exceeds non-domestic sourcing by 25 percent across the entire project. Bidders must refrain from seeking waiver modifications after contract establishment unless extenuating circumstances emerge that the FAA determines justified. False certifications concerning this matter within FAA jurisdiction may subject the maker to prosecution under Title 18, United States Code.
