About this file

This is an Indian Health Service Buy Indian Act Indian Economic Enterprise Representation Form for federal contract solicitation 75H70126R00031 titled "Santa Fe and Taos-Picuris IHC Lab and Rx Casework Improvements."

The form serves as a self-certification document that offerors must complete to verify their eligibility as an Indian Economic Enterprise (IEE) under the authority of the Buy Indian Act (25 U.S.C. 47) and HHSAR 326.601. Offerors must meet the IEE definition and demonstrate Indian Ownership at three critical points: when submitting an offer, at the time of contract award, and throughout the full contract performance period. Any changes in eligibility status during these periods require immediate written notification to the Contracting Officer. The form requires offerors to identify the federally recognized tribal entity, the 51% owner of the IEE firm, business name, and DUNS number. Successful offerors must be registered with the System of Award Management (SAM) in addition to completing this self-certification. The document warns that submitting false or misleading information constitutes a violation under 18 U.S.C. 1001, and false claims during contract performance are subject to penalties under 31 U.S.C. 3729-3731 and 18 U.S.C. 287. Individual Contracting Officers may require supporting documentation of eligibility before awarding set-aside or sole source contracts, and awards are subject to protest if the offeror's eligibility is questioned.
