About this file

This is a Maryland Living Wage Requirements Affidavit of Agreement form effective July 2024, applicable to state and local contract opportunities in Maryland, specifically for the Commercial Doors and Window Replacement project at the Victor Cullen Center operated by the Department of Juvenile Services. The affidavit requires bidders and contractors to either certify that their contract is exempt from Maryland's Living Wage Law or affirm their commitment to comply with Title 18 of the State Finance and Procurement Article of the Annotated Code of Maryland. Contractors must declare their status through specified exemption categories or acknowledge their obligation to pay covered employees the applicable living wage rate for all hours spent on state contract activities, with the same requirement extended to all subcontractors.

The document outlines exemption criteria including nonprofit status, public service company classification, or contract values below specified thresholds based on employee count. For non-exempt contracts, contractors must commit to paying the living wage rate in effect at the time services are provided, submit payroll reports to the Commissioner of Labor and Industry as required, comply with all wage rate increases automatically upon their effective date, and ensure subcontractor compliance throughout the initial contract term and all renewal periods. The affidavit also permits contractors to claim no covered employees if proposed workers will spend less than half their time on the contract, are 17 years of age or younger, or will work fewer than 13 consecutive weeks on the state contract. The Commissioner reserves the right to request payroll records and supporting documentation to verify all affirmations at any time.
