1.2 CONTRACT LINE ITEM NOTES

a. Submit offers using this Price Proposal Form and these Contract Line Item Notes.

b. Except when it is determined in accordance with FAR 17.206 (b) not to be in the Government's best interest, the Government will evaluate offers for award purposes by adding the total price for the options (CLINs 0002 through 0004) to the total price for CLIN 0001. In accordance with FAR 52.217-5, evaluation of options will not obligate the Government to exercise the option(s).

c. For CLINs 0002 through 0004, enter unit price and extended total in spaces provided. If there is a difference between the unit price and the extended total, the unit price will be held to be the intended price and the total recomputed accordingly. If an offeror provides a total but fails to enter a unit price, the total divided by the specified quantity will be held to be the intended unit price.

d. A firm-fixed proposed price is required for all CLINs. No provision is made for economic price adjustment.

e. The Government reserves the unilateral right to award CLIN 0002 to the Contractor at the proposed price within Three Hundred Sixty-Five (365) calendar days after contract award.

f. The Government reserves the unilateral right to award CLIN 0003 to the Contractor at the proposed price within One Hundred Twenty (120) calendar days after contract award.

g. The performance period for the work required by base price (CLIN 0001) shall be four hundred and fifty-nine (459) Days from the date of award (this date includes 15 days for submission and approval of required bonds and insurance). If any or all option items are exercised, the contract completion date remains the same as that of the base price (CLIN 0001), as the work required by these options can be performed concurrent to the base work.

h. The Government may reject an offer as nonresponsive if it is materially unbalanced as to prices for the basic requirement and the option quantities. An offer is unbalanced when it is based on prices significantly less than cost for some work and prices which are significantly overstated for other work.

i. If any of the CLINs 0002 & 0003 are exercised, additional bonding and consent of surety is required. Consequently, the Performance Bond must reflect 100 percent of the aggregate amount of all CLINs.

1.3

PLANNED MODIFICATION BID NOTES

These notes apply to Planned Modification CLINs.

a. The estimated amounts for FF&E have been supplied by the Government to provide offerors with the projected magnitude of effort. The estimated amount includes the actual cost of the FF&E including freight and installation charges. The Government FF&E Estimate is only an estimated amount.

b. If awarded, line items will be funded separately after completion of FF&E design package review by the Government, and receipt of appropriate funding by the Government. Requirements and details are provided in specification section 01 30 01.00 22 DESIGN, PROCUREMENT AND INSTALLATION OF FURNITURE, FIXTURES AND EQUIPMENT in Administrative Requirements.

c. Bonding is not required for the design, procurement and installation of CLIN 0004 FF&E.

d. Offerors may propose a Handling and Administration Rate (HAR) for the FF&E not to exceed 5 percent. This fee will account for all administrative costs, overhead, bonding fees, administration of subcontracts, profit, and any other costs associated with and related to the coordination and processing of the procurement and installation of FF&E. The proposed HAR percentage will be incorporated into the contract award and will not be adjusted regardless of fluctuations from the estimate amount for the FF&E. The proposed HAR is a fixed rate.

e. The Final FF&E packages shall be submitted no later than 9 months prior to building completion. The Government is not obligated to award the Planned Modification line item(s). Should the Government choose to award the Planned Modification, the line item will be awarded as a negotiated modification to the contract/task order. The Contractor's proposed HAR will be applied to all vendor/supplier costs for the FF&E.

f. If awarded, the FF&E modifications will be awarded at least six months prior to the contract completion date. A minimum of six months is required for the Contractor to purchase, deliver and install the FF&E without impacting the overall completion date of the project. The Contractor's schedule must assume the award of all Planned Modifications. No schedule extensions will be granted if the modification is awarded at least six months prior to the contract completion date. If the Government decides to negotiate and award the furniture modification with less than six months prior to the contact completion date, the Contractor may be entitled to a contract extension and extended field overhead. A contract extension and extended field overhead will only be granted in those cases where the Contractor demonstrates that an accepted Final FF&E package was submitted within the approved schedule deadlines and sufficient lead time for the FF&E and is not available and the Government's award of the modification is in the last six months of the contract.

g. Upon Government approval of the Best Value Determination (BVD) Analysis solicitation package, a BVD will be made and will be the rationale for selecting the FF&E vendors for the project. Accordingly, the prices provided by the selected vendors, using predominately negotiated price schedules from BPA, GSA or other Federal contracts, will be the basis for the actual cost of the Final FF&E Package. The actual total cost of the awarded planned modifications will be the total of the accepted Final FF&E Package and the HAR rate applied to the accepted Final FF&E Package. See specification section 01 30 01.00 22. DESIGN, PROCUREMENT AND INSTALLATION OF FURNITURE, FIXTURES AND EQUIPMENT in Administrative Requirements.
