VHAPG Part 806.3 OFOC Revision: 03 Effective Date: 04/15/24
5. Demonstration that the Contractor’s Unique Qualifications or Nature of the Acquisition Requires the Use of the Authority Cited Above (applicability of authority):
These items have been standardized throughout the Manchester VAMC. Installing a different manufacturers’ system will create significant duplication in cost for the facility, and in most cases, the equipment will not function properly compromising the safety and security of patients and staff. The specific impact for not using the brand name items is listed below:
a. Building Automation and HVAC DCC
i. Johnson Controls Metasys
ii. Impact: Using equipment from a different manufacturer may result in reduced functionality or may require installing an entirely new front-end system, which would duplicate the existing system. Using a single control system for the campus greatly improves maintenance efficiency because the maintenance and engineering staff only need to learn one system, all alarms and monitoring are completed on one system, and maintenance and emergency repair can be handled in a single contract for a vendor qualified for that single system. Additionally, installation of components that match the existing building automation system minimizes bench stock requirements.
b. Physical Access Control System (PACS)
i. Lenel
ii. Impact: Lenel is the only PACS system in use at the Manchester VAMC.
Using a single control system for the campus greatly improves safety and reliability because the Police and electronics technicians only need to learn one system, all alarms and monitoring are completed on one system, and maintenance and emergency repair can be handled in a single contract for a vendor qualified for that single system. Using a single, reliable system is important in Police operations, where dispatchers are already monitoring multiple alarm systems and where fast response is required. Using a different PACS system would require installation and maintenance of new head end equipment, workstations, and software, increasing both the cost of initial installation and long-term maintenance.
c. Intrusion Detection System
i. DMP
ii. Impact: DMP is the only intrusion detection system in use at the Manchester
VAMC. Using a single intrusion detection system for the campus improves safety and reliability because the Police and electronics technicians only need to learn one system, all alarms and monitoring are completed on one system, and maintenance and emergency repair can be handled in a single contract for a vendor qualified for that single system. Using a single, reliable system is important in Police operations, where dispatchers are already monitoring multiple alarm systems and where fast response is required. Using a different intrusion detection system would require installation and maintenance of new head end equipment, workstations, and
VHAPG Part 806.3 OFOC Revision: 03 Effective Date: 04/15/24 software, increasing both the cost of initial installation and long-term maintenance.
d. Video Surveillance System
i. American Dynamics
ii. Impact: American Dynamics is the only camera system in use at the
Manchester VAMC. If a different manufacturer’s cameras were to be used, it would not be possible to integrate them into the existing proprietary camera software system. This would reduce functionality of the system for the VA Police. It would be more difficult and less efficient to monitor multiple camera systems, potentially leading to security issues.
e. Fire Detection and Alarm
i. Johnson Controls SimplexGrinnell
ii. Impact: Johnson Controls SimplexGrinnell is the only fire alarm system in use at the Manchester VAMC. SimplexGrinnell is a proprietary system, and it is not possible to integrate devices from other manufacturers into the system. Installing devices from other manufacturers to the existing system would not be in compliance with NFPA 72, which requires installation in accordance with manufacturer’s instructions and listing. Because compliance with NFPA 72 is required for Joint Commission accreditation, the facility would be at risk of losing its accreditation.
6. Description of Efforts Made to ensure that offers are solicited from as many potential sources as deemed practicable:
In accordance with the Competition in Contracting Act (CICA), the components listed above are identified as brand name; however, the overall procurement will be competed as a Service-Disabled Veteran-Owned Small Business (SDVOSB) set-aside. This Justification for Other Than Full and Open Competition will be posted to Contract Opportunities with the solicitation.
7. Determination by the CO that the Anticipated Cost to the Government will be Fair and
Reasonable:
The Government estimate was prepared and provided by the architect/engineer (A/E) and reviewed by the Contracting Officer’s Representative (COR). The anticipated price to the Government for the items requested to be brand name is approximately .
The items for which brand name approval is being requested are subsequent components to the overall construction project. The procurement will be completed and based on competition; the Contracting Officer (CO) will make a determination of fair and reasonable pricing prior to award.
8. Description of the Market Research Conducted and the Results, or a Statement of the
Reasons Market Research Was Not Conducted:
The market research for the equipment was conducted and prepared by the A/E, reviewed by the COR, and shared with the CO for further review. The CO was in concurrence with the
VHAPG Part 806.3 OFOC Revision: 03 Effective Date: 04/15/24 information that provided the brand name items. Approval of the items as brand name only is critical for the overall efficiency of the completed project and the entire Manchester VAMC.
Market research was conducted from February 2024 – April 2024 and updated in May 2025 to ensure requirements of the Buy American Act are met for each of the brand name items that were included for the Specialty Care Building at the Manchester VAMC. The research involved reviewing the information that was available through the company websites including product certifications and technical documentation.
1. Building Automation and HVAC Direct Digital Control (DCC)
i. Johnson Controls Metasys System
ii. Findings: The temperature control system is manufactured and designed in their Norman, Oklahoma facility. There is no conflict with the Buy American Act.
2. Physical Security Access
i. Lenel
ii. Findings: The company website includes information on manufacturing in one of two locations; Pittsford, NY or Framingham, MA. They also have a Press Release for LenelS2 OnGuard System gaining approval for US Federal Government use. There is no conflict with the Buy American Act
3. Intrusion Detection System
i. DMP
ii. Findings: The company website includes information in which their products are designed, engineered and manufactured in Springfield, MO.
There is no conflict with the Buy American Act.
4. Video Surveillance System
i. American Dynamics
ii. Findings: American Dynamics operates as a subsidiary of Johnson Controls International. After extensive research online, it has been found that most of the video surveillance systems manufactured by American Dynamics meet the requirements of the Trade Agreements Act (TAA), ensuring it is either made in the U.S. or a designated country (this contract would be subject to FAR 52.225-11 Buy American-Construction Materials Under Trade Agreements). As such, there is no conflict with the Buy American Act.
5. Fire Alarm System
i. SimplexGrinnell Model 4100ES Fire Alarm Panel
ii. Findings: The fire alarm panel is manufactured and assembled in the United States. Therefore, there are no concerns regarding “Buy American” compliance.
9. Any Other Facts Supporting the Use of Other than Full and Open Competition
