About this file
Document Summary
This is a draft agreement document for the New England and Tribal Organizations (NEATO) WIC Retail Infant Formula Rebate Agreement, involving multiple state agencies including the Connecticut Department of Public Health, Maine Department of Health and Human Services, Massachusetts Department of Public Health, New Hampshire Department of Health and Human Services, Rhode Island Department of Health, Vermont Department of Health, and the Cherokee Nation. The agreement establishes a coordinated infant formula rebate program for WIC (Women, Infants, and Children) retail participants across these jurisdictions. The contract term extends from September 1, 2025, through September 30, 2028, with provisions for potential extensions in some jurisdictions. The agreement encompasses standard contractual terms, performance requirements, scope of work specifications, budget parameters, and reporting schedules across three funding periods, with reports due quarterly and final reports due within forty-five days of contract completion or specified due dates.
The document contains appendices with jurisdiction-specific standard contract clauses and requirements for Connecticut, Maine, Massachusetts, New Hampshire, Rhode Island, and Vermont, addressing compliance with federal regulations (7 CFR Part 246), state laws, HIPAA requirements, confidentiality safeguards, insurance requirements, debarment certifications, and other administrative provisions. Pricing, budget amounts, and specific payment terms are indicated as "TBD" (to be determined) and will be established in subsequent contract execution documents. The agreement incorporates federal Uniform Guidance requirements (2 CFR 200), federal cash management standards, and compliance with various federal acts including the Drug-Free Workplace Act, Americans with Disabilities Act, and whistleblower protection provisions. All participating jurisdictions reserve sovereign immunity rights, and the agreement establishes obligations for contractor performance, data ownership by the state, confidential information protection, audit rights, and termination procedures.
