MEMORANDUM FOR: INSERT CONTRACTOR’S NAME

FROM: 27 SOCES/CENM

SUBJECT: Base Contractor’s Temporary Work Site Laydown Area Agreement and Disclaimer

1. The purpose of the Contractor Temporary Work Site Laydown Area Agreement is to inform the Prime contractor of Cannon Air Force Base’s expectations for providing a safe and environmentally sound storage location while under an active contract. Therefore, the following items are not authorized:

a. Controlled substances or firearms.

b. Vehicles, trailers, etc; or any other mechanical devices in a non-operating or non-functioning condition.

c. Any used oil, batteries, or any chemicals deemed hazardous by the Hazardous Material Pharmacy (Hazmart Pharmacy).

d. Excess pallets, excess wood, scrap metal, trash, machine or engine parts. Excess wood and pallets shall be defined as those materials not necessary for use during any currently awarded contracts.

e. Vehicles requiring registration or licensing that are not current with the Department of Motor Vehicles and Cannon Air Force Base.

2. Repair work on any type of machinery is not authorized in the contractor’s temporary work site laydown area to eliminate the potential for oil spills or contaminants. If a laydown area has been contaminated, it will be reported as soon as possible to 27 SOCES/CEAN (904-6738) for action/remediation, at the contractor’s expense. All Hazmat materials being used in the execution of the contract shall be stored in approved storage containment with the proper SDS and ESO-MIS paperwork on hand.

3. All vehicles, and trailers shall be maintained in a proper operating condition at all times and must have current insurance coverage. Vehicles, trailers, etc; shall not be stored on jacks or blocks.

4. Each assigned temporary work site laydown area shall have a weather-proof sign posted on the external gate listing the prime contractor in whose name the temporary work site laydown area is assigned, contact information, the current contract number(s), and the expected contract completion date of the contract(s).

5. Areas inside the Contractor’s temporary work site laydown yard must be kept clean and present an orderly configuration. Compliance with CAFB standards with regards to cleanliness inside/outside fence shall include, but is not limited to the removal of tumbleweeds, leaves, grass, weeds, trash, etc. It is recommended that all temporary work site laydown areas be cleaned weekly or more frequently as determined by the 27th SOCES. Failure to properly maintain a clean lot may result in the contractor being removed from the temporary laydown yard at no additional expense to the government and may affect future requests for any temporary work site laydown areas on base. Contractor is responsible for all maintenance within 5 feet of the contractor’s assigned temporary work site laydown area’s perimeter, to include going back and forth to the actual work site. The contractor’s required maintenance shall include the complete interior of the assigned laydown area. Grass shall not exceed 2 inches in height. Demolition debris shall not be stored inside the temporary laydown area.

6. Tarps shall be used for loose / granular material, and secured in a way that will prevent high winds from dislodging material. If the material in question is able to be dislodged by high winds, it must be secured. If loose items are found to be blown around the lot, the items shall be secured with a tarp, rope, or container, as deemed sufficient for protection from the elements.

7. All wood, plumbing pieces, loose cables, metals, etc., shall be stacked in a neat, orderly appearance.

8. Upon contract completion, the Prime contractor shall clean and vacate the assigned storage lot and inform a representative from the 27 SOCES/CENM no later than 1 day after beneficial occupancy/acceptance of the project by the government. Failure to clean the lot properly prior to vacancy may result in the contractor being denied usage of any requested storage lots in the future.

9. All terminations will be given a maximum of 2 days to vacate the assigned contractor’s temporary laydown area.

10. In addition to the expectations above, I, INSERT CONTRACTOR’S NAME, understand that:

a. As long as my company has this active INSERT CONTRACT NUMBER with CAFB, my company and my subcontractors are eligible to place equipment/materials/vehicles in my assigned temporary work site laydown area at no charge.

b. My company may not store items, materials, equipment, etc. for any other contractors unless they are subcontractors for my active contract. My company is not authorized to use any other storage lots/spaces/temporary laydown areas other than the one assigned.

c. It my company’s responsibility to keep my equipment/materials/vehicles or personal property secured or locked at all times. My company also understands that no security is provided for the work site laydown area.

d. My company understands that the Government has the right to confiscate any construction material outside the assigned fenced area or within work site laydown areas that are not signed for by a prime contractor.

e. The United States Air Force, neither CAFB nor its designated officials, will be responsible for any damage or theft to my property or contents thereof as a result of vandalism, weather, and other occupants or by any other means to any equipment/materials/vehicles or personal property and contents that is stored in my Work Site Laydown area.

f. CAFB requires all contractors utilizing the contractor’s temporary work site laydown area to have full comprehensive insurance coverage to provide financial protection in the event of damage or loss of property. My company understands that we can be held liable for any damages in which my employees, guest, and I may cause to any personal or Government property.

g. My company has and will continue to maintain the required insurance coverage. Please initial here_______________.

h. If an additional contractor’s temporary work site laydown area is needed, I am to submit another request through my Contracting Officer for approval from 27 SOCES/CENMP.

i. Failure to comply with this Contractor’s Temporary Work Site Laydown Area Agreement is grounds for removal from the temporary laydown area.

11. Prime Contractor Project Manager: I have read, understand and will comply with all the above requirements in the Contractor Temporary Work Site Laydown area Agreement and Disclaimer. Upon notification of approval, I will perform a check of the assigned area for any existing damage and report it to 27 SOCES/CENM immediately. Within 5 days of approval, I will also post the requested sign as requested above (see page 1).

12. Contractor’s Temporary Work Site Laydown Area is located LAYDOWN YARD LOCATION.
