About this file
This is a Terms of Use Agreement (TOUA) for Solicitation N00024-26-R-5246, issued by the Department of the Navy, Naval Sea Systems Command on 28 September 2026.
The TOUA establishes mandatory conditions for receiving and handling the ECDIS Consolidated Hardware and Software Request for Proposals (RFP) Library Set, provided as Government Furnished Information (GFI). Access to the Library Set requires a fully executed TOUA signed by both a Corporate Representative and Facility Security Officer, plus an active and approved Contract Security Classification Specification (DD Form 254). The Library Set may be used solely for proposal preparation, evaluation, and submission in response to Solicitation N00024-26-R-5246; any other use constitutes material breach. The Government retains Government Purpose Rights in all technical data, Technical Data Packages, drawings, specifications, and software contained therein, and no commercial ownership, copyright, patent, or intellectual property rights are conveyed to recipients.
The Library Set contains UNCLASSIFIED technical data and Controlled Unclassified Information (CUI) requiring safeguarding in compliance with DoD Instruction 5200.48, DoD Manual 5220.22-M (NISPOM/32 CFR Part 117), and DCSA approved procedures. Recipients may share portions with prospective subcontractors only as necessary for proposal preparation, provided each subcontractor executes a corresponding TOUA. The agreement strictly prohibits duplication beyond ten copies, posting to unaccredited IT systems or commercial cloud services, disclosure to individuals lacking security clearance or need-to-know, disclosure to Foreign Nationals, and transmission outside United States boundaries. Recipients must maintain a real-time Master Copy Log (Attachment L-11), make all copies available for inspection upon demand, and destroy originals and all copies no later than 180 days after proposal submission, submitting a completed Master Copy Log within seven days and maintaining destruction records for five years.
