About this file
This document is a Supplemental Agreement for Off-Site Storage of Materials and Equipment, likely associated with a tub surround installation project for 30 apartments located at multiple addresses in Billings, Montana. The agreement outlines the terms under which a contractor can store project-related materials or equipment at an off-site location while still receiving partial payment from the owner.
The agreement specifies that the owner will pay the contractor 90% of the invoice value for off-site stored materials, subject to several key conditions: the storage location must be suitable and approved by the owner, all extra storage expenses are the contractor's responsibility, storage risks are assumed by the contractor, and all stored materials must be adequately insured with the owner named as an insured party. The contractor remains responsible for completing the contract and replacing any lost or damaged materials at their own expense, and the surety's consent is required for this off-site storage arrangement.

AGREEMENT FOR STORING MATERIALS OR EQUIPMENT OFF-SITE
This Supplemental Agreement is entered into this ______ day of _________________ 20_______, between____________________________________________________________________ (herein after called the "Owner") and _______________________________________________________ (herein after called the "Contractor) for _____________________________________________________ _________________________________________________ under Contract dated _________________.
WHEREAS, the Contractor desires to properly store certain materials or equipment purchased for the Project off the site at _________________________________________________________________________________ __________________________________ in order to furnish better storage than available on the site, and desires to obtain advances for these materials or equipment in accordance with Contract provisions as if they were properly stored on the site.
The Owner agrees to pay the Contractor 90% of the invoice value of the materials or equipment stored off-site, provided the following conditions are complied with:
(1) The above described warehouse location selected for off-site storage must be suitable for storage and satisfactory for the Owner.
(2) Any extra expenses incurred because of off-site storage shall be borne by the Contractor;
(3) Storage shall be at the risk of the Contractor and the loss, damage, or destruction of any materials or equipment so stored does not relieve the Contractor of the duty to complete the Contract and the Contractor shall, if necessary, replace such items at his own expense.
(4) All materials or equipment stored off-site shall be adequately covered by property insurance naming the Owner as insured, evidence of which is herein attached; and
(5) The consent of the Surety shall be obtained and evidenced by signatures hereto.
