About this file

This is Addendum 3 to the sealed bid solicitation issued by Brevard County Purchasing Services for the Max Brewer Causeway Shoreline Restoration Project (Bid Number B-8-26-29). The addendum provides clarifications to eleven questions submitted by prospective bidders regarding project requirements, contract terms, and technical specifications. Key clarifications include: the contract completion date has been adjusted to June 10, 2026 (reflecting the addition of five days to the original duration); liquidated damages will not apply, though contractor-caused delays may result in action through the contractor's Construction Bond; payment will be based on the fixed conversion rate of 1.35 tons per cubic yard regardless of actual tested unit weight; the required plant survival guarantee threshold is 80% (not 90% as stated in one section); and the specific allowable turbidity limit is 29 NTUs over background levels. The addendum also addresses procedures for electronic bidders to submit required physical sand samples to the County Purchasing Department prior to the bid opening on March 19, 2026, at 10:00 AM, and clarifies that two previously approved upland sand sources include Rock Solid Rock (Cocoa) and Stuart Materials (Ft. Pierce), though contractors may propose alternative sources subject to County approval.

The addendum confirms that the contractor assumes responsibility for determining appropriate weather delay days to build into their 50-day project schedule and will be compensated only for documented work completed prior to high-water events. Regarding permits, the USACE permit was anticipated to be issued prior to the final bid due date but issuance was not guaranteed. The contractor bears responsibility for obtaining all required permits and compliance approvals from the St. Johns River Water Management District, Department of the Army, and Florida Department of Transportation. All other terms, conditions, and bid requirements from the original solicitation and prior addenda remain unchanged.

ADDENDUM 3

TO ALL PROSPECTIVE BIDDERS

This is an Addendum to and shall be considered as part of the original bid package for the above-mentioned bid. Please acknowledge receipt of Addendum 3 in the space provided on the Price Sheet.

Bidders are requested to acknowledge receipt of this addendum with their bid.

CLARIFICATION TO QUESTIONS RECEIVED:

Question 1: With the duration increased to 50 days from Notice to Proceed per Addendum 2, does the hard completion deadline of June 5, 2026, still apply, or has the final completion date been adjusted to align with the June 30, 2026 grant deadline mentioned in Addendum 1?

Answer: The addition of five (5) days adjusts the contract completion date to June 10, 2026.

Question 2: Addendum 1, Question 2 states there are no liquidated damages for construction delays. However, Question 4 states liquidated damages will not be assessed for "uncontrollable" delays. Will liquidated damages be assessed for contractor-caused (controllable) delays, and if so, what is the daily rate?

Answer: Liquidated damages will not apply; however, the Contractor must ensure the work is completed by the Contract completion date. Contractor-caused delays that impact the completion date may result in the County pursuing action through the Contractor’s Construction Bond.

Question 3: Section 01 22 00 (1.4.1.a) mandates a fixed conversion rate for payment of "1.35 tons =

1.0 cubic yard in-place contract measure," but the same section also requires the contractor to provide the actual unit weight from the upland sand supplier. If the actual tested unit weight of the approved sand differs from 1.35 tons/CY, which metric will govern the calculation for final payment?

Answer: Payment will be made on the fixed conversion rate of 1.35 tons = 1.0 cubic yard in-place contract measure. The actual tested unit weight is only requested for the County’s awareness.

Question 4: Section 01 22 00 (1.4.2.b) states payment will not be made for volumes placed outside the specified tolerances. If material naturally shifts outside the template tolerances due to wave action before the final post-construction survey, will the contractor still be compensated based on the weighed material delivered and placed?

Answer: The specific allowable NTU limit over background for this project is 29 NTUs.

Question 5: Section 35 20 25 (3.6.1) requires a physical representative sand sample to be submitted "with his bid". Since the ITB notes that "Electronic bidding is preferred," how and where should electronic bidders deliver the physical sand sample prior to the bid opening to ensure their bid remains responsive?

Answer: The physical sand sample can be delivered to the County Purchasing department utilizing the same means a physical bid copy would be submitted. Please ensure Company name, date, contract information, and County project number details are included.

Question 6: Section 32 93 00 (3.6.B.2) contains a typographical error regarding the survival rate, stating: "The Contractor shall guarantee the survival of at least ninety (80) percent cover...". Could you please clarify if the required survival guarantee threshold is 90% or 80%?

Answer: The required survival guarantee threshold is 80%.

Question 7: Section 01 57 25 (3.2.2.b) refers to reporting turbidity that exceeds background levels by "the amount described in paragraph 3.1.1". However, paragraph 3.1.1 does not provide the allowable numeric limit (NTUs over background). Assuming this numeric limit is not established in the SJRWMD permit, what is the specific allowable NTU limit over background for this project?

Answer: The specific allowable NTU limit over background for this project is 29 NTUs.

Question 8: Section 01 11 00 allows for time extensions due to weather "more severe than the adverse weather anticipated for the project location during any given month". Does the County have a baseline table of anticipated adverse weather days per month that the contractor is expected to build into their 50-day schedule?

Answer: It is the responsibility of the Contractor to determine an appropriate number of days per month needed to be built into the Contractor’s schedule.

Question 9: Addendum 1 added the SJRWMD permit to the documents. Has the final USACE permit been issued yet, or is there an anticipated date of issuance to ensure the full Notice to Proceed is not delayed?

Answer: The USACE permit is anticipated to be issued prior to final bid due date, but this is not a certainty.

Question 10: Can the County provide a list of previously approved upland sand mines acceptable for this project?

Answer: Rock Solid Rock (Cocoa) and Stuart Materials (Ft. Pierce) have previously supplied material to the County that met beach renourishment specifications used for this project, however, the Contractor shall provide sand from an upland sand source that must meet certain requirements, and the acceptability of any proposed material will be the sole judgement of the County or Engineer (Section 32 30 25-5).

Question 11: If the Indian River Lagoon water rises during construction, and erodes imported fill as well as landscaping. Will the contractor be compensated fully for work in place?

Answer: The Contractor will be compensated for work in place that their construction records document to be in place prior to the high water event.

Question 12: The Landscaping has an establishment spec. If the Lagoon rises, causing the plants to not survive with the contractor be liable for replanting?

Answer: The Contractor will be compensated for work in place that their construction records document to be in place prior to the high water event.

Please note that the bid opening date and time remain Thursday, March 19, 2026 @ 10:00 AM.

All other terms and conditions remain unchanged.

Sincerely, Mary Bowers Purchasing Manager
