About this file

This Addendum 1 document is issued by Brevard County Purchasing Services in Florida regarding the Max Brewer Causeway Shoreline Restoration Project (Bid Number B-8-26-29). The addendum clarifies responses to four prospective bidder questions and adds Attachment F (SJRWMD Permit) to the bid package. Key clarifications address sand sourcing requirements, liquidated damages provisions, project completion dates, and liability for delays. The bid opening remains scheduled for Thursday, March 19, 2026, at 10:00 AM, with all other original bid terms and conditions unchanged. Contractors must acknowledge receipt of this addendum on the Price Sheet with their sealed bid submission.

The addendum clarifies that contractors must source sand from an upland sand mine with acceptability determined by the County or engineer per Section 32 20 25-5, and that liquidated damages apply only if a bidder fails to execute the contract within 10 days of award notification—not for construction delays. The County does not anticipate extending the completion date but may consider limited extensions subject to approval, provided sufficient time remains before the June 30, 2026, grant closeout deadline. Contractors will not be assessed liquidated damages for days beyond the completion date caused by uncontrollable delays. The addition of the SJRWMD Permit attachment addresses permitting requirements necessary for the restoration work on this navigable waterway project.

ADDENDUM 1

TO ALL PROSPECTIVE BIDDERS

This is an Addendum to and shall be considered as part of the original bid package for the above-mentioned bid. Please acknowledge receipt of Addendum 1 in the space provided on the Price Sheet.

Bidders are requested to acknowledge receipt of this addendum with their bid.

CLARIFICATION TO QUESTIONS RECEIVED:

Question 1: Do you have a list of the approved Beach Sand vendors for this project? It is not listed in the specifications. Sometimes it’s listed in the Corps permits.

Answer: The Contractor shall provide sand from an upland sand source that must meet certain requirements, and the acceptability of any proposed material will be the sole judgment of the County or engineer (Section 32 20 25-5).

Question 2: What are the liquidated damages in regard to delays in the project?

Answer: The liquidated damages referred to in the bid relate to the Bid Security Bond and apply if the bidder fails to execute a contract within 10 days of receiving the notice of award.

There are no liquidated damages stated for construction delays. The contract time and required completion date are established to ensure the County meets the project’s grant funding deadline.

Question 3: If there are any delays, would the date of completion be pushed further back?

Answer: The County does not anticipate extending the contract completion date, but a limited time extension may be considered, subject to County approval. Any extension must provide the County with enough time to conduct post-construction surveys and grant closeout procedures before June 30, 2026.

Question 4: Would we be liable to pay for any days past the date of completion that were delayed?

Answer: No, liquidated damages will not be assessed for any days past the date of completion due to uncontrollable delays.

ADDITIONAL ATTACHMENT:

Attachment F – SJRWMD Permit has been added.

Please note that the bid opening date and time remain Thursday, March 19, 2026 @ 10:00 AM.

All other terms and conditions remain unchanged.

Sincerely, Mary Bowers Purchasing Manager
