Dear Mr. Klimoski:
This is in reference to your application, NAB-2023-61614-M55 (US Navy/Naval Support Activity Annapolis/King George Street/Utility Bridge Replacement), dated November 1, 2023, for Department of the Army (DA) authorization to demolish and replace a utility bridge over College Creek. The approximate 604 feet long by 15 feet wide bridge will be supported by 62 steel piles, and constructed at a minimum height of 15 feet above mean high water in College Creek, Annapolis, Anne Arundel County, Maryland. [Latitude: 38.985281, Longitude: -76.494221]
Our evaluation has determined that the proposed work, if accomplished in accordance with the description within the application, does not require a DA authorization pursuant to Section 10 of the River and Harbors Act of 1899 and/or Section 404 of the Clean Water Act. If any of the information contained in the application and/or plan(s) is later found to be in error, this determination may be subject to modification, suspension, or revocation.
However, please be advised that the construction of a bridge over navigable waters of the United States requires prior approval of the United States Coast Guard (USCG) under Section 9 of the Rivers and Harbors Act. Thus, you must contact the USCG prior to construction of the bridge, as a permit under Section 9 of the Rivers and Harbors Act may be required.
Please contact Mr. Hal R. Pitts, Chief, Bridge Branch, Fifth Coast Guard District at Hal.R.Pitts@uscg.mil to apply for USCG approval. Information on the USCG bridge permit application process can be found on the USCG website at https://www.dco.uscg.mil/Office-of-Bridge-Programs/ under “Bridge Permits”.
A copy of this letter will be sent to Mr. Hal Pitts, US Coast Guard, and Ms. Mel Throckmorton, Maryland Department of the Environment Tidal Wetlands Division.
