About this file

This is a Memorandum for Record documenting the use of brand name products as the basis of design for a solar panel system procurement by the Department of the Air Force, Headquarters 131st Bomb Wing at Whiteman Air Force Base, Missouri.

The memorandum authorizes the use of First Solar FS-6450A PV Modules, CPS SCA 25KTL-DO/US-208 inverters, and Lithonia FEX-L48 products as the design basis for project LTUY202005 Construct Vehicles Ops Covered Parking. The design notes permit system layout optimization as needed. The estimated system value is below the simplified acquisition threshold. The Contracting Officer justifies this approach based on standard commercial practice for solar panel system procurement, which typically employs design-build delivery methods rather than design-bid-build. The memorandum indicates that providing brand name specifications will facilitate clearer government communication of requirements, simplify contractor quote preparation, and reduce procurement risk, while allowing contractors to furnish alternative equivalent systems and optimize the layout to meet required output specifications. The authorization is documented in compliance with RFO FAR 12.102(a), RFO DFARS 212.102-70(b), and NGB-AQ Procurement Implementation Memorandum 2020-02. The memorandum is signed by JOSEPH P. BERNIER, MSgt, MOANG, Contracting Officer, dated May 27, 2026.

MEMORANDUM FOR RECORD

SUBJECT: Use of Brand Name or Equal Product Descriptions as Basis of Design

1. Purpose. This memo documents restricting competition by use of brand name or equal products as the basis of design for solar panels and associated components for project LTUY202005 Construct Vehicles Ops Covered Parking in accordance with RFO FAR 12.102(a), RFO DFARS 212.102-70(b), and NGB-AQ Procurement Implementation Memorandum 2020- 02.

2. Basis of Design. The solar panel system design for this project used a First Solar FS-6450A PV Module, CPS SCA 25KTL-DO/US-208 inverter, and Lithonia FEX-L48 products as the basis of design. The design notes that the system layout may be optimized as needed. Based on the estimate developed by the designer of record, the value of this system is less than the simplified acquisition threshold.

3. Justification for Use. Solar panel systems are typically procured using a design-build project delivery method and use of design-bid-build is not common. Because the construction contractor will likely furnish a different system and will be optimizing the designed layout to meet the required output, providing as much information as possible to contractors will help clearly communicate the needs of the Government, facilitate quote preparation, and reduce risk to the procurement. Additionally, as a project solicited under RFO FAR part 12, use of brand names as the basis of design is a standard commercial practice.
