NEMCON Draft RFP Questions and Answers 80KSC019R0019
# DRFP Section PWS Section Attachment Section Requirement/Paragraph
Page # Question Government Response
B.2 SUPPLIES
AND/OR SERVICES TO
BE PROVIDED
n/a n/a NASA typically supplies information on the staffing and/or other workload indicators as part of the proposal. This is done so that the incumbent does not have an "unfair advantage" over others bidding the contract. Is it KSC's intent to do so on this proposal?
The NEMCON Website provides documents, information, and supplemental task data.
Note: The information provided in the supplemental task data document is provided for information purposes only to assist Offerors in gauging the volume and types of services that may occur during contract performance. However, this information is not to be construed as a limit or guarantee of future work or the actual volume of services required, nor is it representative of an obligation or commitment of the Government. The information provided is not intended to be a comprehensive representation of all work performed by the NEMCON Contractor. It is the responsibility of the Offeror to understand requirements and propose adequate resources to meet the requirements of the solicitation.
B. 3 INDEFINITE
DELIVERY/INDEFINITE
QUANTITY (IDIQ)
ITEMS (CLINS 300 &
400)
N/A N/A
B.3.9(c) Last Sentence of this paragraph.
5 This sentence states "The IDIQ fixed fee percentage shall be the same as the award fee percentage for the basic work." Will the Government please define the term "Basic Work"? Additionally, will the Government confirm that the intention of this paragraph is that the Contractor must propose the same fee percentage for the CPFF portion (CLINS 300 and 400) of the contract as the CPAF (CLINS 100 and 200) of the contract?
Refer to Table B.2‐1 for basic work (baseline).
Yes. The contractor must propose the same fee percentage for the CPFF portion of the contract as the CPAF portion of the contract.
B.7 SPECIAL COST
REQUIREMENTS
N/A N/A
B.7(a)(1) Last Sentence of this paragraph.
8 This sentence states: "After expiration of each government fiscal year, the Contractor shall adjust its billings to the actual rates". Since a contractor will not know actual rates until the conclusion of the Contractor (not Government) fiscal year, will the Government confirm that this sentence is meant to state "Contractor fiscal year" and not "Government fiscal year" (NOTE:
rates cannot be adjusted until successful close of the year and financial analysis; therefore, this cannot be done immediately)?
Would the Government consider changing this requirement to "After close of each Contractor fiscal year and successful submission of an Incurred Cost Electronic (ICE) proposal per FAR 52‐242‐4, the contractor shall adjust its billings to the actual rates", which also supports Table B.7‐1 Provisional Billing Rates (developed to Contractor Fiscal Year).
Added clarifying language to Section B.7.
B.7 SPECIAL COST
REQUIREMENTS
N/A N/A
B.7(e) 1st paragraph, third sentence
10 The sentence states "Contractor procured or conducted training and education costs that are related to the field in which the employee is working or may reasonably be expected to work may be reimbursed". Would the Government consider adding "licenses and professional fees" to this category?
B.7(e) states:
“Reimbursement for trade, business, technical and professional activity and training and education costs shall be in accordance with the provisions of FAR 31.205‐ 43 and 31.204‐44 respectively.” As such, license and professional fees would be included under the technical and professional activity category in the above language.
No change is necessary to the RFP.
B.8 NON‐PROPOSED
COSTS
N/A N/A
B.8 Last paragraph, second to last sentence
12 The sentence states "If the actual cost of these vary by more than 10% from the nonproposed annual total cost in a given contract year, then an adjustment to the nonproposed costs and to the total cost of the contract may be negotiated." As the non‐proposed costs are not graded in the Award Fee plan, can the Government expand on the intent of negotiations for costs that are greater or less than 10%?
Additionally, can the Government provide details on if "10% from the non‐proposed annual total cost in a given contract year" is per non‐ proposed category, or all categories combined?
Language in regards to non‐proposed cost variance has been added to section B.8 for clarity.
B.8 NON‐PROPOSED
COSTS N/A N/A
B.8 Last paragraph, last sentence
12 This sentence states "Section B Clause B.7.(e)". Can the Government clarify if this should be referencing B.7.(f)?
Reference is for Section B.7(f). Correction made to
RFP.

H.24 Paragraph (a) 54 This section reads "The Contractor shall compile a list of TSDs used by NASA Centers in the previous year;
review compliance histories of NASA‐utilized TSDs and report any change in compliance histories to NASA HQ Environmental Management Division (EMD); solicit recommendations from NASA Centers about which facilities to audit; and make recommendations, with the rationale, to NASA HQ EMD regarding which facilities to audit onsite that fiscal year based upon factors such as frequency of use by NASA Centers, quantity and type of waste received from NASA Centers, last audit date, facility compliance history, Center recommendations, key contaminants of concern, and other relevant risk factors. The Contractor shall conduct onsite TSD audits approved by NASA HQ EMD.
The Government reserves the right to attend and participate in audits performed at the facility. The Contractor shall prepare an audit report for each facility and deliver audit reports to all NASA Centers and NASA HQ EMD in accordance with DRD 6.6.1‐001, Offsite Treatment, Storage, Disposal, and Recycling Facility Audit Reports."
The entire section appears redundant to PWS 6.6.1 Offsite Treatment, Storage, Disposal, and Recycling Facility Audits" Is it the Governments intent to have this requirement inside performance
The Government deleted Clause H.24 (Facility Audits For Off‐Site Treatment, Storage and Disposal) from the RFP since the same requirements are covered under Performance Work Statement Paragraph 6.6.1.

CBA L.,23.Section 3.e 137 The section on Cost and Supporting Information states "Identify all positions as subject to or exempt from the Service Contract Act (SCA) and/or any applicable CBA. For employees covered by the SCA/CBA, job classification titles shall be according to the Service Contract Directory of Occupations or the appropriate bargaining agreement (do not propose the Government provided labor categories). The Offeror shall ensure all prime and subcontractor direct labor rates at a minimum are equal to those outlined in applicable Wage Determination (WD) or CBA and so state in the Cost Narrative." The current CBA for the IAMAW was not included in the draft RFP. Will the Government incorporate the existing CBAs into the RFP and require it as part of the model contract?

(JAN 2011) N/A N/A
L.11 L.11(a) through L.11(i) 112 The Draft RFP has requested several items regarding Government Property Management in Section L.11.
However, the Draft RFP does not stipulate where this information is to be provided in the proposal. Is it the Government's intent that this data will be provided in Volume IV, Plans and Other Data, and like other sections in that volume, be exempt from a page limit?
Property management information referenced in section L.11 has been added as a requirement for Volume IV, Plans and Other Data.

N/A N/A l.18(a) L.9(d) The Offeror shall require all major subcontractors (as defined in Section L.23, Section 3(1)(c)), provide as part of their proposal, the information identified in (a) through (c) of this provision for cost reimbursement or non‐ competitive fixed‐price type subcontracts.
111 The Draft RFP states a 10 page limitation for the Total Compensation Plan. Can the Government please clarify that the 10 page limitation applies to each individual Total Compensation Plan submitted by the prime and each major subcontractor and not 10 pages total?
A footnote was added to the table in L.18 to clarify the requirement.

N/A N/A L.18(a) L.18(b) "...using not smaller than 12 point type in Times New Roman font for all text including illustrations, captions, figures, tables, graphs and graphics."
119 This font size requirement will make it very difficult to provide certain items, e.g. organizational charts (that have to go to the lowest level PWS paragraph per RFP L.21‐1.b.i) without breaking the items into multiple pages, which can potentially adversely impact ease of evaluation. As such, will the Government please consider changing the font size for graphics/illustrations/charts/figures to a font type such as no less than 10 point?
L.18(b) has been revised.

Conversely, the table on page 118 notes only 1 CD‐ROM for Volume V (Model Contract). Will the Government please confirm the number of CD‐ROMS Offerors are to submit for Volume 5?
L.18(l) has been revised for clarification.

N/A N/A
L.21‐2.a.i. "Rationale for the proposed skill mix and distribution (labor hours and WYE) for performing the work requirements by PWS section and how the staffing plan correlates with the proposed organizational structure and technical approach."
126 The proposal response for providing rationale for the proposed skill mix and distribution will require several pages in the Mission Suitability volume. As such, will the Government consider 1) excluding this requirement from the Mission Suitability page count limitations, or 2) moving the requirement to be part of the BOE response required in Volume IV Plans and Other Data?
No, the requirement will remain as stated.
L.23 VOLUME III –
COST
N/A L‐03b Basic Cost Template
L.23.1 First sentence, second paragraph
133 This sentence states: "Identify minor subcontractors in Attachment L‐03b, Basic Cost Template (BCT) worksheet “Subcontractor List”." While the draft RFP defines "major subcontractor" as any subcontractor with a value over $40M, the RFP does not appear to define what would qualify as a minor subcontractor for inclusion in the L‐03B BCT. In execution, there will be multiple subcontracts for services provided to the
Minor subcontractor refers to a subcontractor that is not a major subcontractor.

To what extent is KSC intending to provide onsite versus offsite support at KSC for the PWS elements 4.0, 6.0 and 7.0?
Performance Work Statement (PWS) Paragraph 4.0 involves onsite environmental services for NASA at Kennedy Space Center and Cape Canaveral Air Force Station.
PWS Paragraph 6.0 involves environmental support for NASA Headquarters and other NASA Centers. No permanent office space is available at NASA Headquarters or other
NASA Centers for PWS 6.0 work.
PWS Paragraph 7.0 involves indefinite delivery/indefinite quantity task order content.
Government‐provided support will be identified in the individual task order Performance Work Statement or contract terms.
The NEMCON Contractor may use space listed in Attachment J‐06, Government Furnished Facilities to accomplish NEMCON work.
Will KSC provide workload indicator associated with the breakdown between support to KSC and the
USAF?
