NASA ENVIRONMENTAL

AND

MEDICAL CONTRACT

(NEMCON)

DATA REQUIREMENTS LIST/DATA REQUIREMENT DESCRIPTIONS (DRL/DRD)

The Contractor shall comply with the data requirements descriptions (DRDs) as listed in Table J-02.

Additional Information:

A. The Government reserves the right to reasonably defer the date of delivery of any or all line items of data specified in the DRL. Such right may be exercised at no increase in the contract amount. The Government also reserves the right to terminate the requirement for any or all line items of data specified in the DRL. In the event the Government exercises this latter right, the estimated cost shall be subject to equitable adjustment in accordance with the clause hereof entitled "Changes – Cost Reimbursement." (FAR 52.243-2 Alt II).

B. To the extent that data required to be delivered under a data requirement (DR) is also required to be delivered under another clause of the contract, the requirements established by both the DR and such other contract clause shall apply. In the event of conflict between data requirements of the DR and another clause, the contract clause shall take precedence.

C. Nothing contained in this DRL provision shall relieve the Contractor from delivering data called for by, or under the authority of, other provisions of this contract which are not identified and described in the DRL attached to this contract.

D. Except as otherwise provided in this contract, the cost of data to be furnished in response to the DRL attached to this contract is included in the price of this contract if it is a fixed-price contract; or, if this is a cost-type contract, the cost is included in the estimated cost and shall be reimbursed in accordance with FAR 52.216-7, "Allowable Cost and Payment" clause.

8. Preparation Information

In the event of a competitive solicitation for a follow-on effort, NASA may provide non-proprietary historical information such as average composite direct labor rates and approximate seniority profiles of incumbent personnel to all interested parties in order to increase the probability of realistic pricing. The Government does not intend to disclose any contractor proprietary information.

The Contractor's Re-Procurement Data Package shall include the following:

1. Labor Resources

a. List of directly charged labor skills by contractor labor category, mapped to the Government-provided Standard Labor Classifications (SLC) as identified in Attachment J-08, Labor Classification and Qualifications Crosswalk, and segregated by current Performance Work Statement (PWS) section. Include the hours and the number of WYEs currently supporting each PWS section.

The hours and WYE detail shall be provided at the lowest level PWS number (e.g., 1.2, Risk Management; 1.3.2, Resource Management). Ensure that hours and WYEs counted at the lowest level PWS number are not counted again at the next highest PWS level.

b. The average current straight time labor rate for each direct-charged labor category identified in paragraph (1)(a). Provide both the date when these wages were last adjusted for escalation by contractor labor category, and the rate of escalation applied. Also indicate whether any adjustments are projected to be made prior to contract expiration. If so, provide the anticipated date and rate of escalation, and identify the contractor labor categories expected to be affected.

c. For fringe benefit calculation purposes, seniority level by labor category identified in paragraph (1)(a) and number of WYEs by labor category. Provide data separately for exempt and non-exempt personnel.

See example provided in Table 1 in the Attachment.

2. Non-Labor Resources

a. Provide total non-labor unburdened cost incurred for the most recent 12 month period grouped by expense type (e.g., subcontracts, supplies, travel, training, facilities)

The plan shall include an attachment showing a reconciliation of contract value to the operating plan value.

The operating plan submit shall be transmitted by e-mail with a cover letter. The submit shall include additional files detailing operating plan assumptions to the Agency/Customer/lowest level PWS/element of cost level, manifests used to develop the plan, proposed travel and training lists, comparisons to prior fiscal year estimate at complete values, and other information considered in developing the plan. The plan shall be submitted in Microsoft Excel compatible electronic files. The plan shall be available for query per PWS 1.4.2 requirements within 30 calendar days of operating plan approval by the Government.

Contractor format is acceptable as coordinated and agreed upon by the Government. A sample report format is provided.

Ensure data submitted as part of this DRD is reconcilable to the Contractor’s financial management systems.

In addition, the Contractor shall provide variance explanations that communicate to the Government the main drivers of cost variances, whether the variance is expected to increase or decrease in the future, and any associated operational risks. Ensure data submitted as part of this DRD is reconcilable to the Contractor’s financial management systems.

All file(s) in the report submission shall be compatible with the Microsoft Office product suite. Contractor format is acceptable as coordinated and agreed upon by the Government.

1. Cost Variances

The Contractor shall provide views of cost variances at various levels of detail. The views shall include combinations of the following fields:

a. Federal Agency

b. Contract line item number (CLIN)

c. Government fiscal year

d. NASA Program

e. Contract Customer

f. First level, second level, and third level PWS numbers, as applicable

g. Element of cost

The views above shall, at the minimum, provide cost variances of the below:

a. YTD cost plan vs. YTD cost actuals

b. Total annual cost plan vs. total estimate at complete

c. Current report’s variance vs. prior report’s variance

The Contractor shall include cost variance explanations in the report at the Customer by lowest level PWS number by element of cost level. Variance explanations using other combinations of fields shall be included in the report upon the request of the Government.

The exact combinations of fields that will be submitted in the reports shall be coordinated with the Government.

2. Additional Supplementary Data

The Contractor shall include the following separate analyses in the report:

a. PWS 1 allocation (or similar) summary, including: element of cost plan vs. actual, cost allocated by Customer, hours by labor category

b. YTD hours plan vs. YTD hours actuals by lowest level PWS number

8. Preparation Information

This DRD establishes the requirements for the NF533M cost reporting used in NASA accounting processes and reporting of supplementary financial data for financial management purposes. NF533Ms shall report cost and labor hour data for all Agencies and Customers of the Contract.

Electronic files shall be in Microsoft Office compatible format. NF533Ms specifically shall be in a Microsoft Excel compatible format. The due dates communicated by this DRD reflect the date that the submissions are to be received by personnel on the distribution list, not the date the reports are generated or sent by the Contractor. Ensure data submitted as part of this DRD is auditable and reconcilable to the Contractor’s financial management systems.

The following deliverables shall be submitted by the Contractor as part of this DRD:

1. NF533M Reporting

NF533M reports shall be prepared in accordance with NPR 9501.2, NASA Contractor Financial Management Reporting, as well as any supplementary information listed in this DRD. Any potentially conflicting instructions or confusion shall be clarified by coordinating with the Government.

There are no NF533Q requirements in this Contract.

The Contractor's accounting system shall be capable of accumulating, segregating, and reporting costs by each of the categories listed in the NEMCON PWS 1.4.2 b and PWS 1.4.2 c. Common descriptions of the elements of cost included in NF533M reporting are available in NPR 9501.2 Chapter 3.3.2.2.

Cost, labor hours, and Work Year Equivalents (WYEs) to be reported on the NF533M shall be consistent with the elements of cost structure shown in Attachment 1. Dollar values shall be rounded and stated to the nearest whole dollar, and productive hours to the nearest whole hour. Any deviation from the structure shown in Attachment 1 shall be coordinated with, and approved by, the Government.

The Contractor shall submit NF533Ms in various views, as listed in Attachment 2.

The grand total cost reported by the reporting category (e.g. JON) view of the NF533Ms shall represent the full cost of the work executed under that reporting category (e.g. JON). All indirect rates and allocations such as fringe benefits, PWS 1 program management allocation, G&A, award fee, or other indirect cost allocations shall be included in the grand total costs reported by the reporting category (e.g. JON) view NF533Ms. The same full cost concept described above shall apply to NF533Ms in any view shown in Attachment 2.

2. Indirect Rate Summary

The Contractor shall identify indirect rates charged to the Contract in a monthly Indirect Rate Summary submitted as part of this DRD. This summary will present rates for fringe benefits, G&A, and any other overhead rates charged in the NF533M submits. The actual rates used on the NF533M will be compared to their provisional and operating plan values. If variances between the rates exist, they shall be explained in the summary. Contractor format is acceptable as coordinated and agreed upon by the Government.

3. Accounting Calendar

By Contract performance start date, and by the first NF533M submission during the month of October of each new Government fiscal year thereafter, the Contractor shall furnish an accounting calendar based on a quarterly cycle of 4-4-5 week months. This accounting cycle shall start on October 1, and end on September 30, where four consecutive cycles represent one Government fiscal year. The Contractor’s accounting calendar shall also identify the number of work hours and non-productive hours in each monthly accounting period.

4. Element of Cost Contents

With the initial submission of the NF533M, and by the first NF533M submission during the month of October of each new Government fiscal year thereafter, the Contractor shall provide an Element of Cost dictionary describing the content reported under each element of cost. Contractor format is acceptable as coordinated and agreed upon by the Government.

5. Narrative

Any additional supporting explanations to the NF533M data, Indirect Rate Summary, or other financial discussion shall be included in a monthly narrative as part of this DRD. NPR 9501.2 Chapter 3.6 provides additional guidance. Contractor format is acceptable as coordinated and agreed upon by the Government.
