About this file

This is a Minority and Women-Owned Business Enterprise (M/WBE) Trucking Procedure Compliance document issued by the Harris County Department of Economic Equity and Opportunity (DEEO) for the Isom Stormwater Detention Basin project for the Harris County Flood Control District, with an estimated budget of $10,747,981. The document provides guidance and requirements for M/WBE trucking companies seeking to perform commercially useful function (CUF) and receive M/WBE credit on Harris County contracts. Key compliance requirements include that M/WBE trucking firms must perform at least 30 percent of subcontract work with their own forces, manage and supervise the entire trucking operation, own and operate at least one truck with one employed driver, and utilize only employee drivers rather than independent contractors. The document outlines four credit scenarios based on ownership and leasing arrangements: M/WBE firms using owned and operated trucks receive 100 percent credit; M/WBE firms leasing additional trucks from non-M/WBE firms while using their own drivers receive 100 percent credit; M/WBE firms leasing trucks without drivers receive 100 percent credit up to the value of work performed by company-operated trucks, with only commissions and fees counting for additional leased trucks; and M/WBE firms subcontracting to other M/WBE truck operators receive 100 percent credit.

Vendors utilizing M/WBE trucking companies must submit documentation with their M/WBE Utilization Plan including the trucking company's W-9, current insurance documents, and proof of truck ownership or registration on the TxDOT website, with additional documentation required post-award to verify CUF performance. The DEEO offers courtesy utilization plan reviews with a deadline of five business days prior to solicitation closure, requiring submission of the completed utilization plan, signed letters of intent, M/WBE certifications for all suppliers, and good faith efforts documentation. The DEEO emphasizes that only one submission per vendor per bid is accepted and that the courtesy review identifies minor deficiencies but does not determine plan responsiveness. Contact information for additional inquiries and policy details is provided through the DEEO office at 713-274-1400 or via email at DEEO@eeo.hctx.net, with comprehensive program information available on the DEEO website.
