About this file

This is a Solicitation/Contract/Order for Commercial Items (Standard Form 1449) for dry-dock repair services of the USCGC ALEX HALEY. The U.S. Coast Guard Surface Forces Logistics Center (SFLC) is seeking a qualified contractor to perform a complete dry-dock availability for the Coast Guard cutter during the performance period of July 21, 2026 through November 18, 2026, with the contract ordering period extending through December 31, 2026. The solicitation is set aside 100 percent for small businesses under the Alaska Shipyard Provision (10 U.S.C. § 9210), with a NAICS code of 336611 and a size standard of 1,300 employees. Offers are due by March 4, 2026 at 4:00 p.m. Pacific Time, with a 120-day period for acceptance of offers. The contractor must provide a complete dry-dock facility certified in accordance with SFLC Standard Specification 8634 (January 2022) with minimum water depth of 20 feet and vertical clearance of 135 feet, accessible from a navigable waterway near the cutter's homeport in Kodiak, Alaska.

The evaluation will be conducted using best value trade-off procedures with three primary factors: Technical Capability (most important), Past Performance, and Price (least important when combined with the other two). Offerors must submit a detailed planning document (Gantt Chart format) demonstrating work item scheduling, critical path analysis, identification of Coast Guard inspector presence dates, Technical Representative requirements, subcontractor involvement, and float calculations, along with a narrative not exceeding ten pages addressing performance risks, environmental mitigation strategies, utility disruption limitations, quality assurance approaches, and surge capacity. Past performance must be demonstrated through one to three relevant contracts completed within the last three years as prime contractor. Pricing must be submitted in Excel format using the provided Attachment 1 Pricing Sheet, establishing composite labor rates, lay-day rates, and markup percentages on materials and subcontractor costs for five ordering periods that will serve as maximum rates for subsequent task order negotiations. Additional required submissions include proof of insurance, E-Verify enrollment, list of subcontractors with percentages of work, welding certifications, dry-dock facility certification with pre-award calculations, and a completed SF 1449 with blocks 12, 17a, and 30a-c. Foreseeable costs to the Government based on shipyard location will be evaluated and added to the offeror's overall price for evaluation purposes only, including vessel transit costs of $568.84 per nautical mile, Government personnel travel from Seattle, Washington, crew travel for 100 cutter members, rental vehicles, per diem, family separation allowance, and temporary messing and berthing for up to 120 days.

NON-STANDARD CLAUSES

ORDERING WORK AT THE TASK ORDER LEVEL

The first task order will be the main task order for all the identified work items that are needed. If additional work is found then supplemental task orders can be accomplished to add the additional work. The specification (Attachment 2) contains the listing of all known work items which may be found necessary within the performance period.

Any additional work found necessary will be incorporated via change requests (CRs); the various CRs will be noted in any supplemental task orders in the various ordering periods. The process for incorporating additional work and change requests is noted below.

ADDITIONAL WORK

(a) The Contractor shall not perform additional work related to work items already under task order without the Contracting Officer's authorization. Additional work is work related to and falling under a work item already on contract via a task order, which has not been previously priced as a pre-priced CLIN/line item. The Government will contract for additional work on the basis of a negotiated, fixed price.

(b) The Contractor shall furnish a price breakdown directly to the Contracting Officer, itemized as required by the Contracting Officer, of any proposal submitted for additional work under a change request. Unless otherwise directed, the breakdown shall permit an analysis of all materials, labor, equipment, subcontract, overhead costs, and profit covering all work involved in the change request whether such work was deleted, added or changed. Any amount charged for subcontracts shall be supported by a copy of the subcontractor quote. If the proposal includes a request for a time extension, justification shall be furnished with the proposal.

(c) The requirements of this special contract requirement paragraph are to be used in conjunction with the “COMPOSITE LABOR RATE” paragraph also incorporated into this solicitation. The Contractor is required to have and/or furnish all tools and equipment incidental to each bench trade. Supplies such as wiping rags, hacksaw blades, sandpaper, welding wire, helium, etc., are also to be furnished by the Contractor. Other materials are to be charged at regular rates and prices currently in effect and as agreed to by the Contracting Officer. Material shall be best commercial quality available except where a precise specification is indicated in which case the specification shall apply, e.g., MILSPEC, Federal specification.

DISCOVERIES AND CHANGE REQUESTS:

Change requests should be transmitted electronically by email. The bullets below display the process of how change requests are to generally be followed during the availability:

1. Condition Found Report (CFR)-Generated by the Contractor and provided to COR

2. Condition Found Report Reply (CFRR)-Generated by the COR and provided to Contractor

3. Change Request- CR and IGE are generated by the COR and forwarded to Contracting Officer/Contract Specialist

4. COR provides copy of Change Request to the Contractor

5. Contractor’s Proposal- Provided to the Contracting Officer/Contract Specialist for the identified work on the change request

6. Negotiations- If needed, take place to establish pricing and terms

7. Approved change request - forwarded to Contractor and COR by the Contracting Officer/Contract Specialist

8. New Task Order - The Contracting Officer/Contract Specialist will issue a new task order covering all finalized and approved CRs.

In order to determine price reasonableness: All change requests that list sub-contracting and/or material must have a written proposal from the sub-contractor or the company providing the material with complete, detailed information (listing number of hours/price per hour; each part/component & associated cost; and an estimated shipping cost).

Condition Found Reports, will be transmitted electronically by email. The below display the process of how these documents are to be followed for the duration of the contract performance period:

(a) Condition Found Report (CFR) - All readings and inspections are to be taken within 24 hours after the machinery or system is opened. All reports of reading and inspections required by the specifications shall be submitted to the COR in writing using a "Condition Found Report (CFR)" form, within 24 hours after the readings and/or inspections are made.

Promptness in taking and reporting readings is particularly important for underbody work items such as shaft bearing or rudder bearing clearances. Often during the progress of a work item, conditions are discovered by the contractor which are considered abnormal for reasons of safety, expected reliability, health, or habitability. These conditions must be brought to the attention of the Coast Guard using a CFR. The Contractor should include in its CFR the following details as a minimum:

(i) A sequential number.

(ii) The contract item to which the "CFR" relates.

(iii) A clear statement, definition, and description of the condition found, including but not limited to frame numbers, part numbers, materials and dimensions as appropriate.

(iv) A proposed or recommended repair to correct the defective condition.

(v) Indicate whether the report requires Cost Guard action, or if it is provided "for information" only. If action is required, indicate the response time required by the Coast Guard and whether or not a contract extension would be needed if the additional work is authorized.

(vi) A space on the form for the Coast Guard to make comments.

(vii) All CFR's will be dated, submitted, and signed by a representative of the Contractor.

Contracting Officer Representatives (CORs) will respond to all CFRs in a timely manner.

(b) Change Requests must be submitted by the COR to the contractor in a timely fashion after responding to the CFR so as to facilitate accomplishment of any additional work. Contractor shall submit proposals to the Contracting Officer/Contract Specialist within a timely manner such as to support any additional work within the specified performance period.

COMPOSITE LABOR RATE:

The composite labor rate offered shall be the sole labor hour rate used to price the Prime Contractor's direct labor hours for change requests, i.e. additional work. The Contractor shall not receive any compensation in addition to this rate for the Prime Contractor's direct labor associated with such changes under this contract.

(a) The composite labor hour rate shall represent total compensation for the following:

· direct labor wages and salaries;

· all employee benefits including, but not limited to, paid leave, supplemental pay, insurance, retirement, savings, and legally required benefits;

· all indirect costs such as overhead and general and administrative expense;

· profit (fee)

(b) The quantity of Composite Labor hours indicated in the Attachment 1 Pricing Sheet is only an estimate. The estimated quantity represents the Government’s best estimate of the total number of additional work hours that may be required throughout the contract in the various ordering periods. The inclusion of these estimated hours does not obligate the Government to incorporate the additional estimated hours if not needed.

The contractor shall propose a composite labor rate, a lay day rate, and a proposed markup rate on estimated material and subcontractor costs for each of the five ordering periods (See Attachment 1-Pricing Sheet)

ACCESSIBILITY OF CONTRACTOR'S FACILITY

The Contractor shall provide a facility accessible from a navigable waterway at which a ship of the characteristics described in the attached specification can, using its own propulsion, safely arrive, lie afloat and depart at all states of the tide and at any time day or night. The facility and its approaches shall have a minimum water depth of 20 feet and a minimum vertical clearance of 135 feet.

ACCESS TO VESSEL

A reasonable number of officers, employees, and associates of the Government, or other prime Contractors with the Government, and their subcontractors, shall, as authorized by the Contracting Officer, have at all reasonable times, admission to the plant, and access to vessel(s) to perform and fulfill their respective obligations to the Government on a noninterference basis. Work hours for the vessel will be discussed at the Arrival Conference. Any work performed outside of those hours will be allowed at the sole discretion of the Contracting Officer.

The Contractor shall make reasonable arrangements with the Government or Contractors of the Government, as shall have been identified and authorized by the Contracting Officer, to be given admission to the Contractor's facilities and access to the vessel(s) and to office space, work areas, storage or shop areas, or other facilities and services, necessary for the performance of their respective responsibilities and reasonable to their performance. All such above personnel shall be required to comply with all Contractor rules and regulations governing personnel at its shipyard, including those relative to safety and security.

All personnel (active-duty military, civilian employees, contractors, etc.) must submit a completed copy of the Access List Spreadsheet. This information is provided to the quarterdeck of the vessel and allows ship's personnel to maintain visitor accountability. Contractors shall sign in and out at the quarterdeck each day and abide by 100% ID checks. Contractors who are not on the Cutter Access List will not be permitted onboard the cutter. Please do not hesitate to contact any of the personnel on the email lists below with questions for the required forms for submission regarding access to the USCG ALEX HALEY: CWO Carsten Stoeckler at Carsten.Stoeckler@USCG.MIL and 571-608-4619.

CONTRACT DEFICIENCY REPORT

The COR may issue a Contract Deficiency Report (CDR), SFLC Form 005. The Contractor shall respond in writing within 24 hours of receipt, unless otherwise approved by the KO, to the COR. The COR will comment on the Contractor's response and will forward the Deficiency Report and comments to the KO, with a copy to the Contractor and Availability Program Manager. The KO will render a final determination and provide it to the Contractor and COR in writing.

The name of the individual assigned as Property Administrator will be furnished to the Contractor at time of award. The Contractor shall not take receipt of property that is not listed in the specification, has not been previously identified as becoming part of the contract (via contract modification) or which otherwise cannot be identified. Such irregularities shall be immediately reported to the Property Administrator.

The Contractor shall complete the report provided herein, entitled, Government Property Report (ATTACHMENT (6)). This report is intended as a living document whereby relevant fields shall be filled in, always maintained and kept current. All property described in paragraphs (a) and (b) above shall be reported on the report. A separate copy of the completed report and any final DD 1149s or DD 1348s executed as a result of carrying out disposition instructions shall be provided to the Property Administrator.

Pursuant to the Government Property Clause the authority to render disposition instructions of Government property associated with this contract is delegated to the Property Administrator. The Contractor shall comply with all instructions in the contract for the return of government property to the Coast Guard. This includes government property taken off the vessel (shafts, propellers, etc.), government property returned to the vessel (special tools, etc.) or surplus government property not used during performance of the contract.

No oral or written statement of any person other than the Contracting Officer will in any manner or degree modify or otherwise affect the terms of this contract. The Contracting Officer is the only person authorized to approve changes in any of the requirements under this contract, and, notwithstanding any provisions contained elsewhere in this contract, said authority remains solely with the Contracting Officer. However, the KO may delegate certain other responsibilities to authorized representatives. In the event the Contractor effects any such change at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority, and no adjustment will be made in the contract price to cover any increase in cost incurred as a result thereof.

(b) All delivery orders or task orders are subject to the terms and conditions of this contract. In the event of conflict between a delivery order or task order and this contract, the contract shall control.

(c) A delivery order or task order is considered "issued" when—

(1) If sent by mail (includes transmittal by U.S. mail or private delivery service), the Government deposits the order in the mail;

(2) If sent by fax, the Government transmits the order to the Contractor's fax number; or

(3) If sent electronically, the Government either—

(i) Posts a copy of the delivery order or task order to a Government document access system, and notice is sent to the Contractor; or

(d) Orders may be issued by methods other than those enumerated in this clause only if authorized in the contract.

(End of clause)

52.216-19 ORDER LIMITATIONS (OCT 1995)

(a) Minimum order. When the Government requires supplies or services covered by this contract in an amount of less than $1,000.00, the Government is not obligated to purchase, nor is the Contractor obligated to furnish, those supplies or services under the contract.

(b) Maximum order. The Contractor is not obligated to honor-

(1) Any order for a single item in excess of $5,000,000.00;

(2) Any order for a combination of items in excess of $8,000,000.00; or

(3) A series of orders from the same ordering office within 30 days that together call for quantities exceeding the limitation in paragraph (b)(1) or (2) of this section.

(c) If this is a requirements contract (i.e., includes the Requirements clause at subsection 52.216-21 of the Federal Acquisition Regulation (FAR)), the Government is not required to order a part of any one requirement from the Contractor if that requirement exceeds the maximum-order limitations in paragraph (b) of this section.

(d) Notwithstanding paragraphs (b) and (c) of this section, the Contractor shall honor any order exceeding the maximum order limitations in paragraph (b), unless that order (or orders) is returned to the ordering office within days after issuance, with written notice stating the Contractor's intent not to ship the item (or items) called for and the reasons. Upon receiving this notice, the Government may acquire the supplies or services from another source.

52.216-21 Requirements (OCT 2025) (DEVIATION 26-04) This is a requirements contract for the supplies or services specified, and effective for the period stated. The quantities of supplies or services specified in the Schedule are estimates only and are not purchased by this contract. Except as this contract may otherwise provide, if the Government's requirements do not result in orders in the quantities described as "estimated" or "maximum" in the Schedule, that fact shall not constitute the basis for an equitable price adjustment.

(a) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued in accordance with the Ordering clause. The Government may issue orders requiring delivery to multiple destinations or performance at multiple locations.

(b) Except as this contract otherwise provides, the Government shall order from the Contractor all the supplies or services specified in the Schedule that are required to be purchased by the Government activity or activities specified in the Schedule.

(c) The Government is not required to purchase from the Contractor requirements in excess of any limit on total orders under this contract.

(d) If the Government urgently requires delivery of any quantity of an item before the earliest date that delivery may be specified under this contract, and if the Contractor will not accept an order providing for the accelerated delivery, the Government may acquire the urgently required goods or services from another source.

(e) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor's and Government's rights and obligations with respect to that order to the same extent as if the order were completed during the contract's effective period; provided, that the Contractor shall not be required to make any deliveries under this contract after 31 December 2026.

(a) (1) The Offeror certifies, to the best of its knowledge and belief, that—

(i) The Offeror and/or any of its Principals–

(A) Are are not presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;

(B) Have have not , within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks "have", the offeror shall also see 52.209-7, if included in this solicitation);

(C) Are are not presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision;

(D) Have , have not , within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds the threshold at 9.104-5(a)(2) for which the liability remains unsatisfied.

(1) Federal taxes are considered delinquent if both of the following criteria apply:

(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(2) Examples.

(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. § 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. § 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

(ii) The Offeror has has not , within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.

(2) "Principal," for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division or business segment; and similar positions).
