The amendment clarifies requirements and answers questions from prospective offerors. Phase I proposals are due February 21, 2023 at 2:00 PM Eastern for the design-build contract award. The solicitation is issued by the U.S. Coast Guard Facilities Design and Construction Center and seeks construction and design services for small business contractors. It removes certain FAR clauses, updates the small business size standard to $45 million, and allows offerors to use subcontractor performance on more than one past project.

This amendment is being issued to incorporate the following changes:

1) Section I:

DELETE: 52.215-23, Limitations on Pass-Through Charges (June 2020)

DELETE: 52.236-1, Performance of Work by the Contractor (Apr 1984)

2) Section L:

DELETE: 52.215-22, Limitations on Pass-Through Charges – Identification of Subcontract Effort

(OCT 2009)

3) Section K: 52.204-8 Annual Representations and Certifications (JUL 2020). (DEVIATION

20-07)

DELETE: (2) The small business size standard is $39.5M.

REPLACE WITH: (2) The small business size standard is $45M.

Questions and Answers (numbering continues from Amendment 010):

146. Will the Government consider removing the following FAR Clauses: 52.215-22 and 52.215-23 as these are for cost type awards and not FFP's

Answer: See amendment language

147. Will the Government consider SBA's final ruling 13 CFR 125.2(g) regarding using subcontractor performance? 13 CFR 125.2(g) Four Factors: (1) prime is small business, (2) Prime cannot independently meet the past performance requirement, (3) Subcontractor is first-tier sub, and (4) Subcontractor is a small business.

Answer: The Government will consider the experience and past performance for all Key Subcontractors with a signed Teaming Agreement or Letter Of Commitment.

148. Will the Government provide the Q&A for questions #79 & 80?

Answer: The Government apologizes for skipping these questions in Amendment 006; they are provided here.

79. The phrase "on one (1) project submitted for factor 1.1 - Construction" was deleted from paragraph 1.1 a in Amendment 002, allowing Offerors to use the construction past performance of key subcontractors for two or more projects. However, Amendment 003 the question " Would the Government consider raising the maximum number of key subcontractor projects under Subfactor 1.1 from 1 project to 2?" was answered by the Government as "Answer: The Government does not anticipate a change at this time" which seems to be a contradiction of the Amendment 002 change.

Please clarify if Offerors are still limited to using no more than (1) key subcontractor project under Subfactor 1.1?

Answer: Requirements, as of Amendment 002, the Offeror shall have acted as the prime contractor on a minimum of four submitted projects. This leaves the remaining projects to demonstrate multiple

7 0 Z 0 4 7 2 3 R N M A C C S B key subcontractors experience, if required; however, no more than one project per key subcontractor.

Total projects submitted for Construction should be at least 5 and no more than 7. Total projects submitted for Design should be at least 5 and no more than 7.

80. Amendment 005 had One project must be $10,000 or higher. Is this a typo?

Answer: See amendment 006 language

149. For graphics and tables not included on 11*17, can the Offerers use text smaller than 10 point font?

Answer: The Government is not making a change to requirements. If the font size used is too small to read, the graphic and/or tables will not be considered during evaluation.

150. Question #123 indicates that “Design Project PPQ should be completed by Prime Contractor hiring the DOR.” Is it acceptable to submit a Design Project PPQ for a design build project which came from the Project Owner instead of the Prime Contractor hiring the DOR

Answer: Yes, the Design Project PPQ for a D/B project may be completed by the Project Owner

151. Will the Government consider removing FAR Clauses: 52.236-1 due to conflict with the Limitations on Subcontracting FAR Clause 52.219-14 B(3).

Answer: See amendment language

152. SF 1142 notes size standard is $45M. However, Page 78, 52.204-8 states the Size standard is $39.5M. I understand the size standards recently were updated. Would the Government clarify which size standard is correct?

Answer: The size standard for NAICS 236220 has recently changed from $39.5M to $45M. Therefore, the $45M is correct. See amendment language

153. Clauses 52.225-9 and 52.225-11 require fill ins, since this is only Phase I, is it okay to leave them blank?

Answer: Yes, these may remain blank for Phase I proposals.
