This amendment is being issued to incorporate the following changes:

1) Section L, Factor 1, Subfactor 1.1

DELETE:

JOINT VENTURES:

If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the JV entity. If the JV does not have shared experience, at least 1 (one) project shall be submitted for each of the individual JV members. Offerors who fail to submit experience for all JV members may be rated lower. Offerors are still limited to a total of seven (7) projects combined. Offerors proposing as a JV, shall submit the signed JV agreement. For 8(a) Mentor- Protégé Joint Ventures, the offeror shall submit the signed and U.S. Small Business Administration (SBA) approved Mentor-Protégé agreement.

REPLACE WITH:

JOINT VENTURES:

If the Offeror is a Joint Venture (JV), relevant project experience should be submitted for projects completed by the JV entity. If the JV does not have shared experience, at least 1 (one) project shall be submitted for each of the individual JV members. Offerors who fail to submit experience for all JV members may be rated lower; however, there is an exception for those small business entities that are submitting proposals with approved Mentor-Protégé Joint Venture Agreements. The Mentor-Protégé Joint Ventures will not be rated lower where only the mentor provides their experience and project submissions.

2) Sections I and K, in Microsoft Word format, for Offerors use is attached to this Amendment.

Questions and Answers (numbering continues from Amendment 008):

108. Can a DOR describe subconsultant team members who are not subject to the experience requirements of the answer to question 101?

Answer: The DOR would need to explain why the subconsultant's experience relevancy. However, under Sub-Factor 1.2, the subconsultant's experience will not be evaluated.

109. The RFP limits project experience to four (4) pages not counting B.1. This equates to 29 pages for the each subfactor 1.1 and 1.2 (total of 58 pages). Our team proposes have space for an introduction before Attachment B.1. Is there a total page limit for Factor 1?

Answer: The page limit for Factor 1 is a maximum of 58 pages (up to 7 projects and each project limited to 4 pages)

110. Is there a minimum single and aggregate dollar amount that must be provided for this RFP by the offeror' surety?

Answer: Per Section M, Factor 2: Bonding Capacity will be evaluated to determine the extent the offeror is able to bond at the Tier #2 and Tier #3 dollar thresholds. Higher rating may be given to offerors with the capability to bond within the Tier #2 dollar thresholds. Higher rating may be given to offerors with an aggregate bonding capacity upwards of the $45M NAICS threshold.

111. Do we need to provide the attorney of fact 2nd page with the surety letter?

Answer: The entire Surety Letter is required.

112. Can the government provided what pages that need to be submitted for Section I?

Answer: Section I & K, in Microsoft Word format, attached to this amendment

113. Does a JV Offeror need to provide copies of their state submitted/recognized articles of organization with the executed joint venture?

Answer: Per Solicitation, Section L.2: "If applicable, the offeror must provide a copy of the joint venture agreement, mentor-protégé agreement, or teaming/partnership agreement that is signed and dated by all joint venture members."

Per Section L.6, JOINT VENTURES provides further requirements that must be met.

114. Can we submit design-bid-build projects as part of the seven (7) relevant construction projects as long as we demonstrate the listed project characteristics listed in the RFP?

Answer: Factor 1 Experience requires "at least four (4) projects demonstrate Design-Build experience.

Other projects may be Design-Bid-Build

115. RFP states that "If the same project is being used to demonstrate construction and design experience, submit separate Project Data Sheets for construction and design." Will the DHS/USCG also require that the PPQ be completed separately for construction and design?

Answer: Yes, separate PPQ's are required. The Construction PPQ is the evaluation on the Construction Contractor's Performance while the Design PPQ is the evaluation on the Designer of Record's Performance.

116. As a JV offeror, we were approved by the SBA in their mentor protégé program. In Nov 2020, the SBA made changes to procedures when reviewing proposals or bids, the government is now required to consider the work done by the joint venture protégé and mentor in the aggregate. No longer does each joint venturer have to demonstrate independent experience. Now, the collective experience, past performance, and capabilities, of both the mentor and the protégé, will be reviewed to determine if the team meets a specific solicitation’s requirements. We request that DHS/USCG revise the area where it discusses that each JV firm must submit at least one project. We request that the DGS/USCG remove the statement "Offerors who fail to submit experience for all JV members may be rated lower" which is in conflict of the Nov 2020 change.

Answer: See amendment language

117. If submitting a proposal as a JV Offeror - does each JV Partner firm need to furnish a letter of intent/commitment if the JV and Mentor Protégé agreement are included in the proposal?

Answer: If the JV or Mentor-Protégé Agreement is included in the proposal, a Letter of Intent/Commitment is not required for the JV firms.

118. RFP states that "The design completion date shall be clearly stated on the Construction & Design Experience Project Data Sheet (Attachment C-1)" - we do not see where the attachment C-1 was included as part of the RFP documents. Can this form be uploaded to sam.gov?

Answer: Attachment C-1 was corrected to reflect Attachment B in Amendment 003

119. There is confusion as to what form needs to be completed for design projects. In some parts of the RFP it states we must use the Experience Information Form (Attachment B) which is MANDATORY and SHALL be used and completed in its entirety to submit project information. Within the same page it states the design completion date shall be clearly stated on the Construction & Design Experience Project Data Sheet (Attachment C-1). Need clarification from the DHS/USCG which form needs to be used to address design projects.

Answer: Amendment 003 corrected the C-1 to Attachment B.

120. Are all design projects required need to be design-build with a minimum of 20% concept design performed by the selected DOR?

Answer: Per Solicitation, Section M Factor 1: Relevant projects that demonstrate design-build experience may receive a higher rating than those that do not have design-build experience.

121. The RFP states that offerors shall provide applicable documentation on projects that were validated and/or certified through U.S. Green Building Council (USGBC) or the equivalent organization or process.

What documents are required since the RFP states that the total length for each project data sheet shall not exceed four (4) single-sided pages?

Answer: Project Experience Form (Attachment B) should state the certification received with a brief description of sustainable features used and /or a picture of the certificate under Block 16.

122. It states that prior PPQs can be used - if that is the case does the prior PPQs provided by an offeror need to meet the same requirements listed in NMACC III | ATTACHMENT C - Past Performance Questionnaire (PPQ) form?

Answer: Prior NAVFAC/USACE PPQ forms can be used as they contain the same requirements as the CG PPQ. All submitted PPQ's must meet the CG PPQ's requirements.

123. If a project is used for construction and design - do we need the client to complete two separate PPQ forms addressing the respective design and then one for construction work completed?

Answer: The Construction Project PPQ should be completed by the Project Owner; Design Project PPQ should be completed by Prime Contractor hiring the DOR.

124. Based on Q&A #54 provided in a recent amendment - is the government going to modify the B2 Experience form if JVs are submitting as an offeror. Suggest adding a field below the name of the offeror so that JV member who was prime for submitted project can have its UEI/Cage Code information entered.

Answer: Offeror should be able to fill in the JV member information on B2 form

125. Will the government considered extending this RFP by a minimum of 30 days since many firms are going to bid both pools?

Answer: Proposal due date has been extended to March 14, 2023. The Government does not anticipate another extension at this time.

126. If a selected project was a design-bid-build - does item 13 of the B2 Experience form need to be completed for the proposal?

Answer: Item 13 should be filled out for the Construction experience. Item 13 does not need to be filled out for the Design Experience if Design-bid-build.

127. If an Offeror is submitting a proposal for Pools 2 and 3 - does the Offeror need to show different projects for each pool and their respective states listed in the RFP, or can the Offeror use the same projects it has identified as its best of the best which shows a nationwide presence by the Offeror in both Pool proposals?

Answer: This is an Offeror's business decision; however, solicitation Section M.4 states "Relevant projects that demonstrate a diverse regional experience, within the specific Pool AOR, may receive a higher rating than those that do not demonstrate diverse regional experience."

128. Will the government consider allowing an Offeror to submit one proposal if an offeror intends to bid both pools? Offeror could identify acknowledge the pools in a cover letter that can be added as part of the proposal.

Answer: Per Solicitation Section L.2, "NOTE: If the Offeror wishes to participate in Pool #2 and Pool #3, a separate proposal must be submitted for each Pool."

129. with an extension granted under Amendment 8 to March 14 2023 - is the RFI due date extended as well?

Answer: Per Solicitation Section L.5, RFI/PPI's shall be submitted in writing and must be received by the Contract Specialist ten calendar days prior to solicitation closing date; therefore RFI/PPI's are now due no later than March 4, 2023.

130. Will the government considered extending this RFP by a minimum of 30 days since many firms are going to bid both pools?

Answer: Proposal due date has been extended to March 14, 2023. The Government does not anticipate another extension at this time.

131. If a selected project was a design-bid-build - does item 13 of the B2 Experience form need to be completed for the proposal?

Answer: Item 13 should be filled out for the Construction experience. Item 13 does not need to be filled out for the Design Experience if Design-bid-build.

134. with an extension granted under Amendment 8 to March 14 2023 - is the RFI due date extended as well?

Answer: Per Solicitation Section L.5, RFI/PPI's shall be submitted in writing and must be received by the Contract Specialist ten calendar days prior to solicitation closing date; therefore RFI/PPI's are now due no later than March 4, 2023.

135. Block 6 of Attachment B.2 request that Contract Duration (Date format) be entered. Does contract duration mean from award or NTP to completion date? Or does it mean something else. Also, what is the date format?

Answer: Contract Duration is the time from Contract Award through Completion Date. Date format is

XX/XX/XXXX

136. Block 11 of Attachment B.2 states if Design-Build, what percentage of the total design was provided to you in the solicitation? Please clarify, is this the percentage that the government provided in the solicitation or the percentage provided by the contractor's design firm?
