The paragraph states " The contractor shall be responsible for a site visit (to the electrical equipment shelter at pier papa on the FLETC side) to obtain all of the equipment heat loads, No additional site visits are scheduled.

periods of operation, and any other information relevant for use in running their HVAC analysis".

During the January 13th site visit the contractors were not allowed to examine the existing electrical equipment shelter.

Can the Government provide an escort and schedule a second site visit to examine the existing pier Papa electrical equipment storage building and the birthing of an NSC?

170 2/4/22 The scope of work for this project requires a significant amount of in-water and landside work including demolition, dredging, construction of new structures, and the handling of diesel contaminated material.

When considering the number of regulatory agencies that will be involved in the permit approval process, as well as the addition of the Navy’s review and approval for their “permitting” process (as described in 1.18), it is agreed that the lead-time to obtain the permits will be substantial. We believe it could actually be critical. It is possible that those external agencies could consume the entire allotted project duration (or more) of 1,125 calendar days to review, approve and issue the permits.

While we believe it was the intent of the USCG to account for that external approval timing in the development of this contract duration, the reality is the timing of these agencies approval is

See Amendment 0010. Item #10 DELETE: Period of Performance: 1125 calendar days from award for the Base Items and Option Item.

ADD: Period of Performance: 1429 calendar days from award for the Base Items and Option Item. (MMS) completely beyond the control of both the USCG and the awarded contractor. Presently however, the USCG is placing 100% of that responsibility upon the Contractor, which includes assessment of liquidated damages, and yet the Contractor has no ability to remedy or mitigate the delayed timing of these external approvers.

Would the USCG please consider an alternative contract duration and milestone period for this project?

One that more fairly and appropriately allocates responsibility for what the Contractor can actually control, and also provides a bid basis upon which all bidding NMACC contractors can consistently utilize?

For example, milestone #1 could provide 180 calendar days for the Contractor to prepare and submit all required permit applications.

After milestone #1 is achieved the clock would then “stop” in which time the project would await for regulatory approval to occur.

During this time the USCG could provide a bid basis assumption for all bidders to utilize of approx. 275 calendar days. If the agencies were to exceed this duration a contract modification could be issued to provide equitable adjustment to the Contractor. Upon receipt of regulatory approval of the permits the clock would then “start” again and would provide approx. 22 months for the Contractor to complete the physical scope of work on the project for a milestone #2. Late completion past this timeframe would then be subject to the LDs that are currently provided for in the contract.

174 2/4/22 Please provide any recent Pier Papa Project As-Builts for the Pier and/or Electrical building.

Including any pictures or final design documents available.

As-built drawings of the electrical equipment shelter in pdf format will be provided.

The only place in the RFP that quantifies the removal of contaminated soils is in Specification section 1800 1.1.1 Project Description. For bidding purposes, please confirm the removal and backfill of contaminated soils is 1,500 cubic yards, and any additional contaminated soils found will be handled as a differing site condition.

See amendment. References to removal of 1,500 CY of contaminated soil has been removed. Additional references have been provided in Attachment N that document that petroleum contamination in this location has been remediated, to include the capping of underground piping.

See 66, 139, 147 and 151.

See Amendment 0006.

198 2/4/22

As-builts for failed bulkhead are not available.

224 2/4/22

The Description of Work in the TOA and in the Price Proposal Form under Base Item 0001 states New Shore Tie service requirements for electrical, potable water, fire protection, sewer, bilge water, and compressed air services will be provided for 5 NSCs at Pier November and bulkhead mooring.

Should this be for 4 NSCs since the 5th NSC requirements are to be included in Option Item 0001? If so please revise the Price Proposal Form.

See amendment 0006 for deletion of bilge water and bulkhead mooring.

Others will need to address TOA and PPF.

5 vs 4 NSC was addressed in RFI 136 Amend 0005

229 2/4/22

TOA, section V. Award on Initial Responses, Non-Price Factor 1 requests us to provide a phasing plan and Non-Price Factor 3 request us to provide a construction sequence. Since the phasing plan and construction sequence are essentially the same and the Government has a tight restriction on each Factors page count, please consider combining the phasing plan and construction sequence into Factor 1 or Factor 3 due to the page limitations?

Neither phasing plan nor schedule will count towards page limitation?

Response will be updated to say, “SEE RFI questions 227 and 228”

232 2/4/22

There is no bulkhead mooring locations anymore ... this is left over from the previous WLB bulkhead mooring plan that was removed.

See amendment clarifying that there is no bulkhead mooring. See Amendment 0006, item #7.

252 2/4/22

Please elaborate on the “Navy permitting process” mentioned in paragraph 1.18 of Section 01800.

This paragraph alludes to a separate environmental permit package that must be provided to the Navy in addition to the normal permits provided to regulatory agencies.

This process is not well defined and other than ensuring the on site activities remain in compliance with existing land use controls (through their dig permit process) the Navy’s role as an approving authority for environmental requirements is not clear.

See Amendment 0006. An additional description of the Navy’s role and requirements in the ”Dig Permit" system (to include its interface with other regulators) is included in Attachment N.

Amendment 5

An updated Price Proposal Form was released in Amendment 5 which modified the original price proposal to now include additional Design and Construction lines related to a) construction (general) b) construction (dredging) and b) construction (dredge + equipment removal).

The intent of the revised pricing form for both Design and Construction lines is not clear as to what specific scope should be included in each line item, and as currently amended the price sheet could lead to duplication of price elements. Please clarify exactly what proposers should be including in these lines.

All construction activities should be broken into two categories.

“DESIGN” and “CONSTRUCTION” The major activities include dredging around the pier, dredging plus submerged equipment removal and general construction of new pier.

The new Price Proposal form just wants the major activities broken out into the two categories.

Format it into 3 activities… General Construction, Dredging and Equp Removal plus associated dredging. A line item for contaminated soil removal has been added. The 3 activities needed to be broken out into design and construction components. There’s a total for design, there’s a total for construction and there’s a total for contaminated soils. Add those up to get the total base.

333 2/21/22

Amendment 5

Please reference the updated price proposal forms provided in Amendment 0005. There are now 4 lines of design and construction prices to be provided not including the Total.

Please reference the third price line “Design/Construction (dredging plus” and the fourth line “Equipment removal)”.

Please confirm and update this should be one (1) price and not separated out. i.e.

“Design/Construction (Dredging plus Equipment removal) $_______”. It is currently shown as two (2) separate prices.

There dredging that will happen around the pier. There is dredging that is associated with the equipment removal.

We want to see these two items priced separately.

1.8.6.1 states "anodized" aluminum as the material of construction.

Anodizing must be performed post-welding and is not typically feasible for larger structures such as gangways, as "anodized" tanks are not available to suit the size. Please confirm if mill-finish aluminum is acceptable. If not please provide specification for type of anodized aluminum to be made.

Mil-finish aluminum is correct. See Amendment 0010.

343 2/22/22

Please provide a length requirement for the gangways, or provide the working parameters such as pier elevations, deck height where deployed from the ship, tide conditions at the location, potential interferences such as cleats and chocks on the pier?

354 2/22/22

Amendment 005, RFI response 55 and 56 states the dredge spoil sites are the responsibility of the Contractor. These sites cannot be determined until after award during the permit process so the Contractor cannot be held accountable for an unknown condition during the bid. Please provide a dredge spoil site location for all Contractors to price, such as Clouter Creek South Cell.
