I) Page 108, SUBCONTRACTOR – Clarification of Amendment 0001 and 0002

DELETE: SUBCONTRACTORS:

The Offeror may utilize the experience of a proposed key subcontractor to demonstrate construction experience for factor 1.1 - Construction; however, Offeror shall have acted as the prime contractor demonstrating meaningful involvement on submitted projects. In those instances where the Offeror is utilizing the key subcontractor experience, then the Offeror must also provide supporting documentation (such as partnership agreement, teaming agreement, or letter of commitment on the proposed partner/teaming letterhead) with both prime/subcontractor firm authorized signatures which demonstrates agreement by the proposed subcontractor for the entire duration of the NMACC III. If the agreement/letter is not provided or meaningful involvement in the performance of the NMACC III contract is not demonstrated, then the proposed subcontractor submitted project experience will not be considered and will be deemed “Not Relevant”.

END OF AMENDMENT

QUESTIONS AND ANSWERS (numbering continued from Amendment 0002)

32. Factor 1: With Amendment 0002, Relevant design projects are now described as "Projects submitted for the Offeror shall have been completed within eight (8) years of the date of issuances of this RFP; however, ongoing projects within the same dollar range may be submitted, provided that design is 100% complete and construction duration to date has exceeded one year." [Amendment 0002] and "Design projects submitted for the DOR(s) shall have been completed within the previous eight (8) years prior to the date of issuance of this RFP. For design-build projects, the design portion of the contract shall have been completed in the previous eight (8) years prior to the date of issuance of this RFP." [Remaining in original RFP]. Can you please confirm that Design-Build projects will be acceptable if the design portion is complete whether or not the project is in construction or has a minimum construction duration of one year?

Answer: Per Amendment 0002, Experience with design-build (at least four (4) projects). Projects submitted for the Offeror shall have been completed within eight (8) years of the date of issuances of this RFP; however, ongoing projects within the same dollar range may be submitted, provided that design is 100% complete and construction duration to date has exceeded one year.

33. Factor 1: If construction of a submitted design project has not received a bid and/or is not in construction, can the cost estimate be used to satisfy the project size requirement (i.e cost estimate >$25M or >$50M but has not received bids)?

Answer: For Design-Bid-Build projects, with a completed design but bid has not been received the estimated cost may be used to satisfy the project size

34. Seeking clarification on RFI responses included in Amendment 1 and Amendment 2. Both RFI’s are related to Offerors utilizing experience of proposed key subcontractors to demonstrate construction experience in Factor

1.1. It is clear an agreement, in writing, is required for proposed Key Subcontractors. What is not clear in the RFI responses is the acceptable capacity in which the Key Subcontractor’s experience was contracted. Please confirm an Offeror may use the experience of a Key Subcontractor in the NMACC III proposal if the Key Subcontractor’s experience was performed as a Prime Contractor.

Answer: See Amendment Language

35. Attachment B.2: The Attachment B.2 Experience Information Form section 15 requests us to list the construction trades, subcontractor and brief work description. Some projects can have over 20 – 30 trades resulting in 2-3 pages just to answer section 15. Please increase the Experience Information Form page count from 4 pages to 6 pages to cover section 15.

Answer: The Government does not anticipate a change in page limit at this time

36. Factor 3 Past Performance: Factor 3: Past Performance. CCASS or CPARS are not available to a design firm of a design-build project since they are issued to the design-build contractor whom the Government had the contract with. If the Offeror’s design firm proposes a design-build project in Factor 1, should the design firm get a PPQ from the design-build contractor with whom they had the contract with? Confirm this will satisfy the design firm Factor 3: Past Performance requirements?

Answer: Confirmed. If a CPARS/CCASS/ACASS is not available, a PPQ for the Design firm will satisfy the design firms past performance requirement.

37. Please confirm that teaming agreements, table of contents, tabs, cover letter, cover sheet, Reps and Certs, SF 1442, SF 30, and surety bonding letter are not part of the proposal page count?

Answer: Confirmed, teaming agreements, table of contents, tabs, cover letter, cover sheet, Reps and Certs, SF 1442, SF 30, and surety bonding letter are not part of the proposal page count

38. Factor 2 Technical Approach: Factor 2 Technical Approach requests an abundance of information but is restricted to a 10 page count limit. For us to detail our Management Approach and commitment to the NMAC III adequately responding to all the listed minimal requirements, 10 pages is not sufficient. Please consider increasing the page count to 20 pages for us to provide the Government our best technical approach.

39. Amendment 0002, Factor 1: Amendment 0002 replaced portion of Factor 1, Subfactor 1.2 Design Experience specifically d) stating design projects need to have construction duration exceeding one year. The following paragraph states for DB projects, only the design needs to be completed within 8 years. Please correct section d) to reflect that only the design needs to be complete within 8 years for Designer design-build projects.

40. Attachment B: For construction experience, please confirm Prime should leave box 13 (on Attachment B Experience Information Form) on design disciplines blank for design-bid-build projects where there was no design.

Answer: Prime should list the firm developing the design in Box 13

41. Factor 2: The previous NMACC II solicitation gave NMACC II Offerors a total of 14-pages combined to discuss the elements "Organizational Structure," "Capacity," and "D/B Management" as three separate factors. In this NMACC III solicitation, the CG is asking Bidders to address the elements "Organizational Structure," "Capacity," and "D/B Management" as one Factor within a total of 10-pages only. Please consider allowing NMACC III Offerors a total of 15-pages to comprehensively address the required elements of the Factor 2 Technical Approach narrative.

42. Factor 1: Please confirm offerors can include projects by key construction subcontractors as long as we include a Letter of Commitment signed by both firms.

43. Page 108: Page 108 of the RFP states in the SUBCONTRACTORS paragraph, "The Offeror may utilize the experience of a proposed key subcontractor to demonstrate construction experience for factor 1.1 - Construction;

however, Offerors shall have acted as the prime contractor..." Please confirm that this should state, "SUBCONTRACTORS shall have acted as the prime contractor on submitted subcontractor projects."

44. Can the Government please confirm we can alter the “Attachment B Experience Information Form” with headers, footers, and page numbers.

Answer: Offeror may alter Attachment B with headers, footers, and page numbers as long as page limit is adhered.

45. If an offeror is providing a letter of commitment for design firms who will be utilized as the DOR, does the government have a Letter of Commitment Template they would like us to use?

Answer: The Government does not have a Letter of Commitment Template. Offeror may use their own template.

46. Box 6 on Attachment B.2 - Experience Information Form requests the contract duration. Please advise if this duration should be in date format (award to completion date) or if it should state the duration as the total number of days.

Answer: Contract Duration shall be in date format.

47. The submission requirements for Factor 2 Technical Approach are significant. The stated limit of 10 pages appears to be insufficient for a thorough response. Would the Government consider increasing the page limit to 15 pages, inclusive of the organizational chart?

48. The Factor 2 Technical Approach requires a significant amount of information to be described between the Organizational Structure, Capacity, and Design-Build Management sections. The Design-Build Management section itself is specifically broken down into several parts which require a large amount of space to respond to.

Would the USCG please consider extending the page limit for this Factor from 10 to 20 single sided pages to allow necessary space to properly respond to each section?

49. Can the government please confirm if a Bid Bond is required for the Phase I submittal?

Answer: A Bid Bond is not required for Phase I

50. The government requires a "formal letter from its bonding company". Does this count to the page count for Factor 2? If so, can that be changed so that it does not take away from our Technical Approach page count?

Answer: As the letter from the bonding company is to be provided with the Cover Letter, SF1442, etc, as outlined in L.2, the letter does not count against the page count under Factor 2.
