Part E E.3.3.1 Factor 2: Management Approach 166 The Government will evaluate the extent to which the offeror’s approach demonstrates that the offeror has identified and committed to provide for participation by small businesses through participation in the DHS mentor protégée program and meeting the small business subcontracting goal. The Government will look favorably upon any offeror that exceeds the Small Business goals.

RFP Section E.2.6.1.2 states that the Management Plan will be organized "as follows: Section 3 - Program Management Plan (CDRL A001, See Section C.7.1)." "Each response must adhere to the following requirements: a. The Management Plan shall address and describe the elements identified in CDRL A001 and DID APM-ILS-001." "b...an explanation to support the merits of their proposal," and "c...provide sufficient information to demonstrate their experience...Resumes are expected..."

RFP Section E.2.7.2.3 requires that a Small Business Subcontracting Plan be submitted as part of Volume II:

Price and Other Proposal Information. Considering that the Program Management Plan is to be written to DID APM-ILS-001, which does not include small business subcontracting, and Volume II does require a Small Business Subcontracting Plan, would the Government consider deleting the evaluation of participation by sma businesses from Section E.3.3.1 Factor 2: Management Approach. If no, would the Government consider moving the evaluation of participation by small businesses to Section E.3.3.1 Factor 5 Price?

This has been edited in the RFP and provided in Amendment 1

Part E E.3.3.1 Factor 2: Management Approach 166 The Government will evaluate the extent to which the offeror’s approach demonstrates that the offeror has identified and committed to provide for participation by small businesses through participation in the DHS mentor protégée program and meeting the small business subcontracting goal. The Government will look favorably upon any offeror that exceeds the Small Business goals.

The requirement is that "the offeror has identified and committed to provide for participation by small businesses through participation in the DHS mentor protégée program and meeting the small business subcontracting goal." The DHS mentor-protégé webpage, https:/dhs.gov/mentor-protege-program, states, "The DHS Mentor-Protégé Program (MPP) is now codified through the National Defense Authorization Act of 2023. Effective March 1, 2023, the Office of Small and Disadvantaged Business Utilization (OSDBU) will not accept new applications until further notice." Considering that participating in a mentor-protege program for DHS is not currently possible, would the Government remove this language from the evaluation criteria?

Yes, the government will remove this language in Amendment 1

C.8.10.3 Technician Response Time (TRT) Supporting Performance Metric

6. Average Technician Response Time

(TRT)

5-6

"This metric calculates the average low-level metrics (M1 + M2 > 0) downtimes for all critical failures." and other, related text.

Would TSA confirm that the definition of TRT in the current version of the RFP is intended to include successful TCS work orders in the TRT calculation. We believe that successful TCS work orders represent Level 1 Maintenance that could have been completed independently by the TSO and as such are non-relevant.

TRT intention is to measure technician response time from start of the ticket open to technician onsite to start diagnosis. TCS is not included in this metrics calculation since TCS does not require technician to be onsite to resolve the issue. Table 2 – TRT Low-Level Metrics Count on Page 8 of D-7 SLA represents the government’s intention correctly.

Attachment D-3 Table 1 5 (Items are missing from the table) In Attachment D3 Paragraphs 4.6.2.4 and 4.6.2.5 indicate that TCS time that results in a parts or depot diagnosis should be treated as M3 (diagnosis). Table 2: Low-Level Metrics Summary does not have a corresponding line to define this situation.

Table 2 in Attachment D-3 only represents lower level metrics without any recursions in maintenance activities.

The section 4.6.2 describes 5 different types of recursions and explains which T-values are recorded and which lower level metrics are derived. Update on Table 2 is not necessary.

Part C C.8.8.2.1 114 (Text missing from section) Would TSA please confirm that assets at seasonal airports are removed from Sustainment CLINs while the airport is closed. C.8.8.2.1 does not explicitly state that assets at seasonally closed airports should be removed from sustainment CLINs and does not indicate when this should occur. The removal is implied by the "added to the sustainment CLINs" language for when the airport returns to operations. We suggest adding the following sentence between the current sentences 2 and 3. "The Contractor will remove assets at seasonally closed airports at either the date of the seasonal closure or the date the Contractor is notified of the closure, whichever is later.

RFP language was updated to include the removal of TSE from contract upon airport seasonal closure.

Part E E.2.7 Volume II: Price and Other Proposal Information

160 E.2.7.2.1 Tab 1 – Cover Page (limited to signed SF1449 and 2 additional pages)

Please confirm that any required Standard Form (SF) 30’s required to be submitted to acknowledge Amendments to the RFP shall be included in this section and shall not count against the page limitation.

confirmed

10.3.1 2

Although the contractor shall have an approved Authority to Operate in place at contract start, the contractor shall complete the third party assessment within 120‐days of contract award. An extension may be granted by the CO or COR based on DHS/TSA assessor availability.

Does this approved Authority to Operate refer to the start of the Transition period, or prior to the Start of the first Option Period? Option Year 1.

PWS C.8 Sustainment Services Technical Requirements 106

Unless otherwise directed, all TSE in the TSA warehouse is excluded from sustainment support requirements, except for required radiation tests in accordance with Section C.8.8.2, Sustainment and Radiation Surveys in Storage Situations.

Please clarify if radiation tests are required for TSE in the TSA warehouse, as the referenced section C.8.8.2 has changed to discuss Seasonal/Defederalization Situations, and the previous section in the draft RFP on Storage Situations has been removed

Section C.8 has been updated to indicate that radiation test are no longer required for TSE at the TSALC.

PWS C.8.1.2.1 Level II PM Performance Requirements 107

The COR may approve the Contractor to perform PM early in conjunction with a P1 ticket at remote airports

Are there parameters set forth for performing the PM early? For example, some systems require annual PMs dispatched 21 days prior to due date. What timeframe prior to PM due date is reasonable to make this request (30 days prior to due date? 60 days)?

For example, if an OEM is due to perform a quarterly PM at a remote airport and wants to bring forward a monthly PM to take place in the same visit for travel efficiency. In performing one PM early, that may increase the days between that new monthly PM date and the next scheduled monthly PM beyond the maximum allowable days between PMs. Please provide specific language around allowability or if an exemption to the maximum days between PMs would be granted in this scenario.

As indicated in the PWS, COR may approve the Contractor to perform PM early in conjunction with a P1 ticket at remote airports. The Contractor shall obtain authorization prior to performance. Approval is at the discretion of the COR. The Contractor shall work with local TSA to ensure the screening operations are not disrupted.

The only parameters are defined in Section C.8.1.2.2 PM Periodicity Requirements; "There shall be a minimum o 6 calendar days between PMs". If a PM is performed early the follow-on PM is due per requirements indicated in section C.8.1.2.2.

PWS C.8.1.2.1 Level II PM Performance Requirements 108

Provide all required consumables (cleaning supplies, filters, etc.). Request that the 6th bullet be changed to "Provide all required Level II PM consumables (cleaning supplies, filters, etc.)." This way it is specific to what consumables this section is requiring, it falls in line with the other sections where the specific level of PM consumable is identified (e.g. Sections 8.1 and 8.6.2 reference "Level I PM Consumables.") and it cannot be misconstrued as requiring that all consumables (Level I PM, operational) be supplied when Level II PMs are performed.

The bullet falls under Level II PM scheduling and it applies only to Level II PM.

PWS C.8.3.1 Level II Corrective Maintenance 111

The Government requires the Contractor to ·Perform CM ac ons for all covered fielded TSE to meet the CLS performance requirements identified in Paragraph C.8. 10, CLS Service Level Agreement (SLA) Performance Requirements. CM shall include any repair requirements necessary to bring inoperable TSE back to operational status. This includes, but is not limited to, repair after liquid spills on TSE broken parts due to operator misuse; unintentional damage during passenger screening or by TSA/airport personnel (e.g., cleaning crews); and other similar damages as a result of operator error.

For corrective maintenance on non‐relevant failures over $10,000 we recommend the amount come out of the supplemental CLIN to avoid OEMs pricing risks of expensive and extensive failures, to be consistent with Check Baggage ILS contract. This should lower the overall cost to TSA. Otherwise, it is difficult for OEMs to anticipate the frequency of these events to incorporate into fixed unit pricing.

Non- relevant failures are included in the FFP of the contract under corrective maintenance Level II. Only catastrophic failures are T&M and would be billed under section C.8.4 Catastrophic Response and additional support.

E.2.6 C.8.6.1

CDRL A030 Parts Obsolescence Management Plan (POMP) CDRL 030 requires the POMP to be delivered with the proposal, but Section E does not request the POMP as part of the proposal delivery. Should we include the POMP with the proposal submission and if so where?

The CDRL block 14 submittion requirement has been updated and POMP is due post award.

Part E ‐ Evaluation and Award

E.2.6 General Proposal Requirements 157 Tab 2 ‐ 1 page per reference Attachment F‐2 ‐ Assuming the table to be page 1, the questions/fill ins for the citations will take more than a single page. Sugges the government change the Past Performance page count to 2 pages per citation and 1 page for the table.

The page count for past performance has been updated in Amendment 1

RFP E.2.6. General Proposal Requirements 157

The offeror shall provide copies of their subcontract agreements with their subcontractors.

Offerors must submit a letter or some form of documentation confirming commitment between the offeror and subcontract that states the parties will finalize the agreement once the Government makes a final award. The agreements shall demonstrate a firm commitment by both the offeror and the subcontractor, even if all the specifics of terms and final pricing agreements are not finalized

For Volume 1 Section 5, does TSA want to see a draft subcontract agreement per subcontractor, or would a draft Master Subcontract Agreement Template to be used for all subcontractors suffice?

TSA requests a draft of each subcontract agreement to be utilized.

PWS

C.8.1.2.2 PM Periodicity Requirements C.8.8.1 Deployed

108, 114

C.8.1.2.2 PMs are not required if the unit is in storage greater than 90 days in accordance with Section C.8.8 Deployed Equipment, of this PWS. C.8.8.1 For the purposes of this contract, “deployed” TSE means equipment and its associated peripherals (e.g., carts, monitors, servers, switches, etc.) in a location other than the TSALC, including the airport, airport storage, airport rigger’s warehouses, non‐airport facilities such as TSA testing and training locations, and additional locations as designated under TSA Loan Agreements.

Please update PWS to state that the PMs are not required for equipment in storage. Section C.8 has been updated to indicate that radiation test are no longer required for TSE at the TSALC.

E.1.7 3052.219‐72 Evaluation of Prime Contractor Participation in the DHS Mentor Protégé Program (Jun 2006) and E.3.3.1. Factor 2: Management Approach

151 and

This solicitation contains a source selection factor or subfactor regarding participation in the DHS Mentor‐Protégé Program The Government will evaluate the extent to which the offeror’s approach demonstrates that the offeror has identified and committed to provide for participation by small businesses through participation in the DHS mentor protégée program and meeting the small business subcontracting goal.

Per the DHS Mentor‐Protégé program website https://www.dhs.gov/mentor‐protege‐program this program has not accepted new applications since March 1, 2023. We request that the DHS Mentor‐Protege Program be removed from any evaluation, as it creates an unfair situation because Contractors could not create a Mentor‐Protege relationship in the last year.

Yes, the government will remove this language in Amendment 1

PWS A.2.1.2 5‐13 Smiths IONSCAN 500DT

1. What is the ILS contractor's responsibility for supporting equipment that reaches end of life? For example, the Smiths 500DT has been formally declared End of Life by the OEM as of 2029.

2. Would the ILS vendor need to procure data rights to this equipment and provide sufficient spare parts through the end of the ILS contract?

3. Who would be responsible for the OEM activities typically performed under other TSA contracts, such as the system management support, engineering support, and IT support?

4. Who would be responsible for training and certifying technicians?

TSA would seek to replace TSE prior to it becoming unsupportable. If that does not occur then a separate maintenance agreement will be negotitated with the checkpoint maintenance contractor.

PWS A.2.1.2 5‐13 Smiths IONSCAN 500DT

The Smiths Responder BLS and Ionscan 500DT ETD will no longer be supported by the OEM during this contract; therefore, can the government reduce the quantities to zero for these units in the later year Option period pricing tables? If not, if a bidder does not provide a price for this equipment after the expected end of life, due to the OEM unwillingness to provide a price for support, would the bidder be considered non‐compliant?

See response above (line 78), quantity tables will be adjusted as end of life issues are addressed. If TSE requires maintainenance beyond EOL then a separate maintenance agreement will be negotiated.

Attachment F1 Price Evaluation

Template Tabs C through J =G9*H9*I9*ROUND(I9,2)

Please update the equations for total price in column J, rows 11 through 26? Currently the equations multiple the Daily Fixed Unit Price (I9) twice, resulting in an erroneous calculation.

This has been updated in Attachment F1, provided with Amendment 1

Attachment F1 Price Evaluation

Template Tabs C through J =H27*I27*ROUND(I27,2)

Please update the equations for total price in column J, rows 29 and 30? Currently the equations multiple the Monthly unit Price (I27) twice, resulting in an erroneous calculation.

This has been updated in Attachment F1, provided with Amendment 1

Attachment F1 Price Evaluation

Template Tabs C through J 1003AE Supplemental Support

Which labor category should be used for the Supplemental Support rate in cells I37? The offeror can determine how to calculate this blended rate.

Attachment F1 Price Evaluation

Template Tabs C through J 1003AE Supplemental Support

What basis should bidders use for the materials and travel costs for the Supplemental Support rate in cells I37? For example, is this for planned week long trips CONUS, day trips, and/or last minute trips to Guam? What materials are anticipated to be needed for this support? Absent this information, TSA will receive unusually high prices for this work item.

TSA is unable at this time to predict what work may occur under this CLIN. Offerors should bid a rate that would allow them to respond to any requirements that fir within the scope for that CLIN.

Attachment F1 Price Evaluation

Template Tab L. Consumables

Would TSA consider combining the manufacturer and alternate items onto one row, instead of requiring a separate cost for each item? As currently laid out, TSA seems to have the option to pick and choose which approved source to use for each item; this will have the unintended consequence of driving up overall costs as Bidders can negotiate better bulk pricing with vendors.

No.

F‐1 Maintenance and Inventory Data Would the Government please provide historical Failure Mode Indicator (FMI) data for the TSE? Information regarding failure types is available upon request to the CO

Section E 2.6 and E.2.7 ‐ E.2.6, Volume II requires unredacted preliminary copies of subcontract agreements with OEMs, however, E.2.7 doesn't address the Tab 6 requirements. Please clarify the requirements for the unredacted subcontractor agreements.

The RFP has been updated in amendment 1.

RFP E.2.5.4 Submission a. 156 Offers in response to this solicitation are due by 11:00am Eastern Time on Tuesday, June 4, 2024.

We request a two week extension to Tuesday, June 18, 2024, as at least one OEM has indicated they will not be able to provide a quote within sufficient time to deliver a proposal to the government

An extension until Tuesday June 18th is granted and will be included in Amendment 1

RFP Section B Contract clauses Due to the 8 year period of performance and the unknown impact on the stability of prices, request that TSA include 52.216‐4 Economic Price Adjustment‐Labor and Material in the resulting award

TSA will not be including this clause in this solicitation

A A.2.2.2 17 [table] Has the Leidos “Dual Mode Verification Trap” PN: 42200277 been approved for checkpoint use by the TSL, and if so, has training been made available? If not, is this only included to show equivalency to the TSL‐approved VT1272 and VT1273 manufactured by DSA Detection?

Correct, PN Removed.

A A.2.2.2 17 [table] Can the ETD Direct “Verification Sample A-Neg (1ea)” PN: ISV0156P and “Verification Sample B-Neg (1ea)” PN: ISV1326P be used in an identical manner as the OEM verification products? If not, will TSA make training available on how to use this new verification method?

ETD Direct PN: ISV0156P and PN: ISV1326P are qualified consumables for Leidos B220 ETDs. TSA will not be providing training.

A A.2.2.2 17 [table] The ETD Direct part number ISV0156P should not be listed alongside the OEM 10010156, and the ETD Direct part number ISV1326P should not be listed alongside the OEM 10011326. They are completely different verification methods with completely different procedures. The ETD Direct part number is a pen, while the OEM part number is a can. To have the ETD Direct part number in this list will cause confusion to those ordering the part numbers from this list.

Updated

A A.2.2.2 16 [table] On page 16 of the RFP, the DSA Detection part number of ST1269P is incorrect and should be corrected to ST1267. Please reference the attached TSL approval letter.

B B.1.3 (FAR 52.219-8) 36 _x_ (20) 52.219-8, Utilization of Small Business Concerns Will the ILS prime contractor be required to source ETD consumables from small businesses? If not, please explain the TSA’s reasoning.

This is a performance based contract. We will not be directing where contractor sources consumables as long as they meet our requirements

B B.1.3 (FAR 52.219-8) 36 _x_ (20) 52.219-8, Utilization of Small Business Concerns FAR clause 52.219-8, Utilization of Small Business Concerns included in the RFP, speaks extensively about the “policy of the United States that small business concerns… shall have the maximum practicable opportunity to participate in performing contracts led by any Federal agency… including contracts, and subcontracts…” How will this be accomplished in the new contract award as it relates to the acquisition of ETD consumables that will be different from the current ILS contract which essentially bars small businesses from selling ETD consumables?

TSA will be evaluating Small Business subcontracting as a whole on this efffort, not just specific to ETD consumables

E.2.7 Volume II: Price and Other Proposal Information Volume II includes the offeror’s proposal cover letter, Past Performance, Subcontract Plan, Representations and Certification, and Price Proposal.

To provide accurate proposal pricing, please consider this a second request for ILS CDRL A014 data reports, requested by FOIA 2022-TSFO-00514 in April 2022.

This request should fall in line with the TSA's answer provided in the Special Notice Q&A: "OEM maintenance data will be available, by request, with the release of the final soliciation. To receive it earlier, please request from the CO."

If unable to answer with the full historical data, could you provide the actual consumables consumption data (consumable quantities) from the year 2023 found in the A014 reports?

An attachment with historical consumables usage is available to offerors upon written request to the CO.

A A.2.2.1 14 TSA reserves the right to modify the contract to include provisions for new equipment and future technologies not listed in Section A.2.1, Pricing Schedule and CLINs, as they are deployed.

Will future TSL-approved ETD consumable technology be independently reviewed by the government for inclusion in the CLS contract after the award? If so, what are the procedures to do so?

If not, will the government put in place a procedure to ensure TSL-approved consumables that improve existing products and/or are more cost-effective are not excluded by the prime contract holder?

Yes, if and when new consumables become approved for use, they may be added to the new contract via a bilateral modification.

File details come from the government source that posted it. Updated .
