I. INSTRUCTIONS FOR SUBMISSION OF PROPOSAL
1.0 Compliance to the RFP Requirements
The offeror shall examine and follow all RFP instructions. Failure to comply with the instructions contained herein in any way may result in a determination that the proposal is not responsive and will not be further evaluated by the Government. This RFP does not commit the Government to pay any costs for the preparation and submission of a proposal in response to this RFP. The Contracting Officer (CO) is the only individual who can legally commit the Government to the expenditure of public funds in connection with this procurement.
2.0 Description of Requirement
Scope
The selected Contractor will support CWMD’s community-wide approach in working with emergency management officials through a defined process of understanding the current capability, understanding the unique chemical threats to a community, and through scenario-based response training and exercises. This approach will allow CWMD to support communities throughout the country in agile decision making and response capabilities during a chemical incident, to include the identification of those critical decision points, information flows, and decision making defined by position and affiliation during a response to a chemical incident.
This approach will be accomplished with a chemical vulnerability, threat, and unmitigated risk assessment process that over the course of CWMD’s engagement with a community will align the entire response capability.
Threat and Vulnerability - Within each community, map the framework of all known high-risk chemicals, prevention resources available, response resources available, interconnections between responders, and response coordination across every stakeholder.
Risk Assessment - Using this mapped framework build scenarios for each community to work through risk and identify gaps in capabilities.
Enhanced Readiness - Build a repeatable process for CWMD to use across every community in the United States regardless of size to build their community into a national prevention and response capability.
The jurisdictional specific tools to be developed include Community Chemical Inventory, Community Chemical Commodity Flow and Gap Analysis; a Cognitive Decision-Making Framework; and a Federal Resource Compendium.
The process should be piloted and validated in at least one jurisdiction during the Period of Performance. Developing digital, IT, software, or other automated tools is outside the scope of this project. In addition, the Contractor shall also develop procedures and training materials to be used to instruct others independent from the Contractor. The Contractor will establish and maintain technical assistance teams to work with CWMD and the local jurisdiction to implement the specified tools.
1) Contract Type
The Government anticipates awarding one (1) Single-Award Indefinite Delivery Indefinite Quantity (IDIQ) contract via full and open competition and will not be set-aside for small business. The resulting Single Award IDIQ contract award will allow for time and materials (T&M), cost-reimbursement (CR), and a hybrid of T&M and CR orders without further competition.
2) Place of Performance
The Contractor shall perform all tasks identified in the Statement of Work (SOW) (Attachment
1) at various locations including, but not limited to Contractor facilities; CWMD-identified jurisdictions (will vary based on DHS priorities, stakeholder interest and operations tempo) and potential for periodic visits to the Department of Homeland Security located at 2707 Martin Luther King Jr. Ave SE, Washington, DC 20528.
3) Period of Performance/Ordering Period
The government anticipate the following ordering period for the resultant IDIQ contract:
Base Period: 12 months from date of award Option Period One: 12 months from end date of base period Option Period Two: 12 months from end date of Option Period 1
The ordering period above is tentatively established and subject to change. Period of performance at the task order level will be specified in each individual order.

Statements expressing opinions, sentiments, or conjectures are not considered valid inquiries or comments for this purpose and will not receive a response from DHS. Inquiries requesting a Government’s response that would compromise a fair competition will not be answered. Further, offerors are reminded that DHS will not address hypothetical questions aimed toward receiving a potential “evaluation decision” from DHS.
II. EVALUATION
Basis for Award
The Proposals received under this RFP will be evaluated in accordance with the instructions contained in this evaluation plan. One (1) award will be made to the contractor whose Proposal is determined to best meet the needs of the Government after consideration of all factors, that is, the Proposal that provides the best value to the Government. The Small Business Subcontracting Plan evaluation factor will be evaluated on an acceptable or not acceptable basis in which the offeror will submit a small business subcontracting plan and provide a record of previous performance in carrying out the goals of subcontracting plans by including two (2) Summary Subcontracting Reports (SF 295) for recent individual contracts to meet or exceed the DHS FY23 Small Business Contracting Goals of 43%.For this procurement, best value is defined as the Proposal that results in the most advantageous acquisition decision for the Government as determined by trade off analysis among the non- price and price factors. Trade-off analysis and other analytic means involve the evaluation of superior technical capability (e.g., benefits clearly attributable to increased productivity, probability of successful agreement performance, ability to control cost, maintain schedule, and/or unique and innovative approaches to the work effort) versus the added cost.
This effort will include a Small Business Subcontracting Plan acceptable/not acceptable determination and an evaluation of the strengths, weaknesses, and risks associated with each of the other stated evaluation factors (factors 2-4) to produce an overall confidence rating of High, Some, or Low confidence in the ability of the Offeror to meet the Government’s requirements. This may result in an award to higher-priced Offerors when a technical Proposal represents the best value to the Government. As the evaluations of the non-price evaluation factors become equal between the Offerors, price becomes more important in making the award determination. If two or more Proposal/Proposals are determined not to have any substantial technical differences (i.e., are substantially equivalent with respect to the non-price factors), award may be made to the lower priced Proposal. It should be noted that an award may be made to other than the lower priced Proposal if the Government determines that a price premium is warranted due to technical merit.
The Government may also make an award to other than the highest rated Proposal, if the Government determines that a price premium is not warranted.
The Government intends to make an award upon the basis of initial Proposals. Discussions are not anticipated; however, the Government reserves the right to hold discussions at the sole discretion of the Contracting Officer. Offerors are therefore cautioned that each initial Proposal should contain the Offeror’s best Proposal.

Factor 1 is acceptable/not acceptable and is not weighed relative to the other factors. Offerors that do not pass this evaluation factor will not be further evaluated.
Factors 2 and 3 are weighed equally and both are weighed more than Factor 4.
When combined together, Factors 2, 3, and 4 non-price evaluation Factors are weighed significantly more important than price Factor 5.
The evaluation factors for this award are:
Factor 1: Small Business Subcontracting Goal (This Section Does Not Apply to Small Businesses
The Government will evaluate each offeror’s proposed small business participation as follows:
1. Subcontracting Plan. Evaluate the subcontracting plan for compliance with FAR 19.704; the proposed approach in meeting or exceeding subcontracting goals with small, small disadvantaged, women-owned, service-disabled veteran-owned, veteran-owned, and HUBZone small businesses will be evaluated; and the offeror’s past experience in meeting proposed subcontracting goals on past contracts will also be evaluated.
Offerors must meet or exceed the DHS FY24 Small Business Subcontracting Goal of 43% of the subcontracted dollarsOfferors must meet or exceed the DHS FY24 Small Business Subcontracting Goal of 43% of the total proposed value of this Task Order.
The DHS subcontracting goals for Fiscal Year 2024 are listed below:
SB Subcontracting
Goals SB Category SB Goal
SB 43%
SDB 5%
WOSB 5%
HUBZone 3%
SDVOSB 3%
Factor 2: Technical Approach
The Government will assess its level of confidence that the contractor will successfully perform the requirements set forth in the SOW. The Offeror’s overall Technical Approach shall demonstrate its understanding of the requirements by providing details about how it plans to accomplish all required tasks set forth in the SOW. The Proposal shall include a sound, thorough, and reasonable technical approach to meet those requirements. The Offeror shall identify any performance risks it may encounter during execution of its technical approach/performance and present a reasonable plan to mitigate/neutralize those performance risks. The Offeror shall demonstrate a feasible plan that implements its proposed technical approach.
Simple restatements of the SOW, or mere assurances that the work will be done satisfactorily, will not achieve a high technical rating. The Proposal shall be structured and supported in a way that adequately convinces the technical evaluators that the Offeror thoroughly understands the requirement, presents a sound, reasonable, and thorough approach to meet the requirement, and has selected the best method to implement the proposed approach.
Factor 3: Management Approach/Staffing Plan
The Government will assess its level of confidence that the contractor will successfully manage the requirements set forth in the SOW. The Offeror’s overall Management Approach/Staffing Plan shall demonstrate its approach to effectively manage this requirement, and staff it with an appropriate labor mix of personnel skilled and experienced enough to support implementation of the Offeror’s Factor 2 Technical Approach. The Proposal shall include a proposed labor mix including labor categories, position descriptions, and the total number of personnel for each position that is reasonable for implementation of the Offeror’s proposed technical approach, and performance of the support services sought under this RFP. The Offeror’s management approach shall demonstrate the feasibility and accountability of the organizational approach of the Offeror’s team, including the management and roles of any teaming partners and/or subcontractors.
The Offeror shall provide well-qualified Key Personnel that meet the requirements of the roles for which they are proposed and satisfy the minimum requirements outlined in the SOW for these positions. Key Personnel resumes must demonstrate the knowledge the key personnel gained from past experience, as well as from ongoing efforts that are similar in nature to the services required under this RFP.
Simple restatements of the SOW or mere assurances that the work will be done satisfactorily, will not achieve a high technical rating. The proposal must demonstrate that the Offeror is experienced in managing an effort of this size, scope and complexity, that the Offeror has thought out how to manage the tasks, how to staff the tasks, how to avoid staff turnover, etc. The Proposal shall demonstrate to the evaluators that the Offeror’s Management Approach and Staffing Plan, if implemented, would fully support the Offeror’s proposed technical approach, with minimal risk and maximum success.
Factor 4: Past Performance
The Government will assess its level of confidence that the contractor will successfully perform the requirements based on the contractor’s past performance on other similar Government contracts or programs. The past performance evaluation will examine the extent to which the Offeror’s past performance demonstrates their capability to deliver high quality service. Only recent (or ongoing) and relevant past performance data regarding work will be evaluated. Recent is defined as within the last three (3) years. Relevant is defined as work similar in size (e.g.
experience in performing and delivering services for federal contracts of $10 million dollars or higher which involve a large and complex level of effort. Experience in staffing a large and diverse number of employees which can successfully deliver a large volume of services), scope (e.g. experience in providing personnel who have worked with all levels of government to execute multiple taskings with differing objectives but which are interrelated and interdependent), and complexity (e.g. experience with fielding teams which have successfully executed taskings simultaneously and in multiple jurisdictions throughout the country that involved complex systems engineering solutions and complex issues related to chemical preparedness, chemical vulnerability, threat, and unmitigated risk assessment processes).
Past Performance evaluations will be based on: (a) Offeror’s proposal submission describing a minimum of three (3) and a maximum of five (5) projects previously or currently performed; (b) Information obtained in Government past performance reference checks related to the project descriptions submitted as well as other inquiries on Offeror’s past performance, and (c) Information obtained from Government past performance databases. Neither a favorable nor unfavorable rating will be provided for this Factor if the Offeror does not have relevant past performance or if past performance information is not available.
Factor 5: Price
The Offeror’s price will be evaluated to determine if the contractor has proposed a price for the labor categories/descriptions and travel indicated in the Technical Proposal for the base period and two 12-month option periods. The total price for the base and option periods will be added to the total proposed price. Evaluation of the option periods does not obligate the Government to exercise the option(s).
The price will also be evaluated to determine if the labor rates are based on 1,920 hours per full time employee per year. The Government expects to receive price competition through the submission of price Proposals from multiple vendors, so Offerors are encouraged to offer discounted labor rates.
Cost realism analysis may be performed, at the Government’s discretion. Cost Proposals should be realistic and balanced.
