About this file

This document is a Questions and Answers file for a transportation services solicitation (Solicitation Number: 70LART25RPFB00007) issued by the Department of Homeland Security Federal Law Enforcement Training Center for transportation services at the Artesia, NM location. Key details include clarifications about transportation assets, with the government indicating they will provide some transports but contractors must be prepared to supplement these with their own vehicles to meet full contract requirements. The incumbent contractor is Oak Grove Technologies (current contract value: $34,955,309.30), and the solicitation involves complex submission requirements including seven-page limits for prior experience documentation, past performance questionnaires for team members, and specific guidance on wage determinations.

Notable additional details include the contractor's responsibility to provide buses/transports and over-the-road communications, with guidance to utilize Government-Furnished Property (GFP) buses first before deploying contractor-provided transports. The solicitation also addresses potential workforce unionization, noting currently no official Collective Bargaining Agreement is in place, and wage determinations are based on the Service Contract Act for Eddy County. Offerors are consistently advised to conduct thorough due diligence, review all 62 attachments carefully, and prepare proposals that comprehensively address the Performance Work Statement requirements.

TRANSPORTATION QUESTIONS

1. Can the Government please clarify whether the Government will provide the transportation assets or if the Contractor is responsible for providing the assets? It appears that there will be several GFP transports in support of the mission; however, the Contractor can anticipate acquiring additional assets to meet the full requirements. Is this correct?

Answer: Yes, the Government intends to provide some transports but may not be in numbers adequate to meet the requirements of the contract, this is a new requirement.

1. Page 51 of the solicitation document states that “the Contractor shall provide all buses/transports and over the road communications in support of this requirement.” However, Optional Form 336 (page 3 to start) states that “GFP buses will be the primary method of transportation, contractor provided transports will support all remaining requirements.” Furthermore, Attachment 22 – Historical Data Trans has the incumbent Contractor having “zero “0” provided vehicles” but that “Contractors should not depend on the government fleet to meet requirements.”

Answer: Please refer to Attachment 23 for Government transports provided, GFP should be utilized prior to contractor provided transports. Read PWS and requirement, the contractor must be able to provide buses/transports without any Government provided GFP Buses.

1. Instructions for Volume 1: Factor 1 – Prior Experience (p. 131) state that Volume 1 is limited to seven pages, front and back. Can the Government clarify whether this means each physical sheet (front and back) counts as a single page toward the limit, or if each side of a sheet is counted separately (i.e., front = 1 page, back = 1 page) for a total of up to 14 sides? When submitting via email there are page numbers there are no front and back. Example 7-page submittal is 7 pages.

1. Can the Government clarify whether the contracts referenced in Factor 1 (Prior Experience) must be the same as, or may be different from, the contracts provided in Factor 3 (Past Performance)? Specifically, is the Offeror required to use the same contract examples for both factors, or may the Offeror select different contracts that best demonstrate prior experience and past performance separately? It is up to the offeror on submitting proposals and reading the requirement.

1. The instructions for Volume 3: Factor 3 – Past Performance state “if the offeror proposed teaming partner(s) or subcontractor(s) in response to this RFP, the offeror shall provide two additional past performance questionnaires for each teaming partner(s) and/or subcontractor(s) for contracts entered into by the federal government, agencies of state and local governments, and/or commercial customers.” However, we do not see a requirement for Prime contractors to provide past performance questionnaires. Can the Government please clarify whether or not past performance questionnaires (for Prime and subcontractor/team members) are required for this solicitation, and if so, please specify:

4. What information is required to be included in the questionnaires? Refer to 52.212-1 c.

4. Should past performance questionnaires be submitted directly to the Government, or included in proposals: Phase 2 instructions will cover this.

1. If questionnaires are not required, can the Government please clarify their intent for offerors to “provide two additional past performance questionnaires for each teaming partner(s) and/or subcontractor(s)? See question 5.

1. Offerors are in possession of the Wage Determination attachment. However, the labor categories in the PWS and Historical Data attachment are not directly correlated to Occupation Codes within the Wage Determinations. In order to ensure offerors’ price volumes accurately incorporate Wage Determination rates, can the Government provide a cross-walk of relevant LCATs and their correlating Occupation Codes? Answer: Each offeror must come up with own bid. See Historical data information on positions (one must keep in mind these requirement are off HSFLAR-17-D-00002).

1. Please confirm whether the workforce supporting the Student Support Contract contract has voted to unionize; and will this effect Transportation? Additionally, is a Union or Collective Bargaining Agreement (CBA) currently in effect for this contract? If a CBA is not currently in effect, please provide the current status of CBA negotiations or implementation.

Currently there is no official Collective Bargaining Agreement in place, hence wage determinations (service contract act Eddy County provided). While there are talks between incumbent and union (IUOE LOCAL953). The Government does not involve itself in contractor and union matters (a vote has occurred in the past). If a CBA takes place the offerors will be notified and amended. It is up to each offeror on their proposal and due diligence.

1. Who is the incumbent?

Oak Grove Technologies (HSFLAR-17-D-00002).

Current value of $34,955,309.30, do see historical information and up to each offeror on due diligence and reading the Performance Work Statement.

1. Noticed the attachments to this solicitation is 62 and some have nothing to do with the transportation service request. Can you confirm all the attachments are actually meant for the solicitation?

Refer to Solicitation and Performance Work Statement, due diligence is up to each offeror.
