This has been a common practice in DHS-ICE Procurements for the SPC detention contracts.

RFP Section L.6 should now address this question.

This will allow offerors to demonstrate how their affiliated companies are committed to be meaningfully involved in the offeror’s Krome contract performance through the contribution of financial, workforce, management, facilities, or other tangible resources.No. The Government will not allow for a 6th slide.

Since the Technical Approach is part of the Phase 2 submittal, will the Government please consider allowing an amended Cover Letter to be included with Phase 2 in order to address any assumptions developed while preparing the Phase 2 submission?RFP Section L.6 should now address this question.

Will the Government please confirm that offerors are to specifically address only PWS Section C.4 (4.1 through 4.4.14) rather than all of the PWS sections (C.5 through C.28) in their Technical Approach?The PWS is the entire SECTION C (C.1 Tthrough C.28). If you exclude C.5 through C.28 a lot is left out for the contractor to comply. Maybe this needs to be standardize accross sections to avoid confusion.

Will the Government clarify "maintain and uphold"? Are there current Government provided systems in place or are these systems Contractor provided? If Government provided, will the Government provide information regarding the type of systems, age, and anticipated maintenance and upkeep requirements to enable contractors to price the requirement?This refers to entrance access controls already in place by the government based on required standards (i.e., identification procedures/processes when granting entrance to the facility, package inspections, etc.). This is not asking for the contractor to maintain a "system" (as in equipment, software, etc.) but simply uphold entrance access controls protocols when employees or visitors arrived at the facility. Please refer to PBNDS 2011 2.4 (Facility Secuity and Control)
17DRAFT+RFP+Atch+1+-+Krome+PWS+1-12-2024C.945The PWS states "Contractor must provide all equipment and supplies required to achieve a self-supporting and independent operation throughout the period of performance of this contract." This is broad and could be over applied to several areas of this PWS. Will the Government provide additional clarification of this overly broad statement? For example, is the contractor required to provide all kitchen equipment and supplies; all main gate and lobby security screening equipment (e.g. x-ray machine and WTMD), NC property storage containers, etc.?The KROME SPC operations encompasses multiple ICE programs that are resposible to provide assistance (funding) to alleviate facility issues and provide with necessary equipment/services. The government is NOT asking the contractor to provide all and any equipment but only equipment directly affecting the performance of their functions to meet the PWS detention/transportation requirements. As indicated in this section, the government will only provide equipmen and/or supplies on those instances where the procurement and isntallation of such items are resticted by federal policy or regulation. For example, during intake the contractor shall not be dependent on the government for copiers, papers, and supplies to develop detainee manuals, handbooks, etc. The same applies to law library, the contractor shall provide with necessary copier equipment and supplies to meet law library requirements. For high dollar value kitchen equipment, X-Rays Machines, and other high ticketed items, ICE program takes care of that. Detainee property storage containers, kitchen supplies, is to be provided by the contractor. Please see Detainee Welfare Items / Other Direct Costs list for potential items to be procure through the reimbursable CLIN. When in doubt consult with the COR. All reimbursable items must be approved by the facility AFOD and/or the COR prior to being purchased.

That paragraph goes on and covers OT rates, and overnight lodging approval protocols as well. CLIN 0006 exists because of this.

30RFP+70CDCR24R00000008Section B, Items 0001a through 00062-3Items 0001a through 0006 show a period of performance starting 06/01/2024, and items 0001a and 0003a show a quantity of 12 months. To align with Item 0007 (the two-month transition period), the period of performance for all items should begin 08/01/2024 and a quantity of 10 months for items 0001a and 0003a. Will the Government update Section B accordingly? This will also apply to Attachment 3 (Pricing Template).Yes. CBA appears to modify pay rates in May each year, if that occurs in May 2024, will gov't accept a Price Adjustment proposal in those circumstances? See FAR 52.222-41 If wages to be paid or fringe benefits to be furnished any service employees employed by the Government Prime Contractor or any subcontractor under the contract are provided for in a collective bargaining agreement which is or will be effective during any period in which the contract is being performed, the Government Prime Contractor shall report such fact to the Contracting Officer, together with full information as to the application and accrual of such wages and fringe benefits, including any prospective increases, to service employees engaged in work on the contract, and a copy of the collective bargaining agreement. Such report shall be made upon commencing performance of the contract, in the case of collective bargaining agreements effective at such time, and in the case of such agreements or provisions or amendments thereof effective at a later time during the period of contract performance such agreements shall be reported promptly after negotiation thereof.

35DRAFT RFP Atch 1 - Krome PWS 1-12-20244.4 Food Service25does the gov't or the contractor pay for food and consumable (packaging & disposable items) supplies used to provide meals to detainees?The government pays for almost all food items for the detainees via our Defense Logistic Agency (DLA) agreement. However, the contractor is responsible for accessing the DLA system to place orders. Also, the contractor is responsible for buying other special meals (i.e., kosher, halal, etc.) via the reimbursable CLIN. Packaging and disposible items are also responsibility of the contractor via the reimbursable CLIN.

The Technical volume is (at least tentatively) limited to 10 pages, making the inclusion of not only the EFSP, but the QCP as a whole an impractical fit given the scope and complexity of the other requirements to be addressed. Will the government consider a substantial (60-70 pages) increase in the page allowance for the Technical volume?The Government was unable to find this language in the PWS dated Jan 31, 2024.
