| Number | Document Title | Section | Page | Question/Comment | Gov't Response |
| 1 | DRAFT+RFP+70CDCR24R00000008+Section+B-M_Final | L.10.1 and L.10.2; M.3 | 97-98; 104-105 | Will the Government please confirm that Prior Experience and Past Performance responses from an Offeror's affiliated companies under the common management of the same parent company can be submitted and that such submissions will be credited to the Offeror acting as the prime contractor? |
Accepting affiliates' prior experience and past performance allows the Government to assess not only the offeror’s direct experience but also the extent to which the additional experience, resources, knowledge, and personnel available to the offeror through its affiliated companies will directly benefit Krome.
This has been a common practice in DHS-ICE Procurements for the SPC detention contracts.
| RFP Section L.6 should now address this question. | ||||
| 2 | DRAFT+RFP+70CDCR24R00000008+Section+B-M_Final | L.6.1, Table 1 | 93 | For Prior Experience, will the Government allow offerors to include a 6th slide in order to address meaningful involvement of affiliates? |
| This will allow offerors to demonstrate how their affiliated companies are committed to be meaningfully involved in the offeror’s Krome contract performance through the contribution of financial, workforce, management, facilities, or other tangible resources. | No. The Government will not allow for a 6th slide. | ||||
| 3 | DRAFT+RFP+70CDCR24R00000008+Section+B-M_Final | L.6.1, Table 1 | 93 | The instructions state that the Cover Letter is due with Phase 1 and specify "All assumptions (especially technical but excluding pricing; all pricing assumptions must be included in the price narrative) must be identified in the cover letter. Assumptions identified in other areas of the RFP will not be considered." |
| Since the Technical Approach is part of the Phase 2 submittal, will the Government please consider allowing an amended Cover Letter to be included with Phase 2 in order to address any assumptions developed while preparing the Phase 2 submission? | RFP Section L.6 should now address this question. | |||||
| 4 | DRAFT+RFP+70CDCR24R00000008+Section+B-M_Final | L.10.2 | 98 | Will the Government please consider allowing offerors to submit a Past Performance Questionnaire for contracts where a CPAR has not yet been provided, and issue a template for offeror use? | No. The Government will not allow offerors to submit past performance questionnaires. | |
| 5 | DRAFT+RFP+70CDCR24R00000008+Section+B-M_Final | L.11.2; M.3 | 98-99; 106 | For the Technical Approach, in Section L, offerors are instructed to describe their plan to meet the requirements "listed in the PWS." In Section M, this is stated as "PWS (Section C.4)." Will the Government please confirm that offerors are to specifically address only PWS Section C.4 (4.1 through 4.4.14) rather than all of the PWS sections (C.5 through C.28) in their Technical Approach? | The PWS is the entire SECTION C (C.1 Tthrough C.28). If you exclude C.5 through C.28 a lot is left out for the contractor to comply. Maybe this needs to be standardize accross sections to avoid confusion. | |
| 6 | DRAFT+RFP+70CDCR24R00000008+Section+B-M_Final | L.12 | 100 | Will the Government allow offerors to submit additional Questions following the advisory down-select? | RFP Section L.12 should now address this question. | |
| 7 | DRAFT+RFP+Atch+1+-+Krome+PWS+1-12-2024 | 4.2.1.2 | 13 | Do Non-Citizens have the right to opt out of Recreation Periods? A positive response affects Recreation Officer staffing requirements because Pod officers must remain behind to supervise those who opt out and cannot assist with recreation. Please confirm whether NC's may opt out of recreation. | Confirmed. NCs shall be allowed to opt out from recreation. | |
| 8 | DRAFT+RFP+Atch+1+-+Krome+PWS+1-12-2024 | 4.2 | 13 | Bullet 18 in this section (top of page 13) states, "The contractor must arrange and provide for temporary housing services (i.e. lodging accomodations) as well as necessary transportation…for juvenile detainees, family units, and other detainees ...while temporarily housed outside the Krome SPC in accordance with ICE Policies." |
| Will the Government confirm that the costs for lodging accomodations (hotels) are reimbursed under one of the reimbursable CLINs? | Confirmed. | |||||
| 9 | DRAFT+RFP+Atch+1+-+Krome+PWS+1-12-2024 | 4.2.1.3 | 15 | Please confirm that all VAV equipment is the property of the Government. If so, please provide confirmation that any replacement, upgrades, or repairs to Government-owned VAV equipment is covered under the Cost Reimbursable CLIN 0005 or otherwise provided by the Government and will not be Contractor provided. | VAV is property of the government. Confirmed, replacement, upgrades, or repairs is covered under the cost reimbursable CLIN. | |
| 10 | DRAFT+RFP+Atch+1+-+Krome+PWS+1-12-2024 | 4.2.2 | 17 | The PWS states "Maintain IHSC provided basic first aid kits." Please confirm that replenishment/maintenance of first aid kit stock is covered either under the Cost Reimbursable CLIN 0005 or provided by IHSC, and not contractor provided. | Confirmed. | |
| 11 | DRAFT+RFP+Atch+1+-+Krome+PWS+1-12-2024 | 4.2.4 | 19 | Will the Government provide the annual costs and level of effort for contractors to provide training, badging, and parking for positions at Miami International Airport (MIA)? | Contractor operates at the airport under the ICE umbrella. Hence, contractor is not getting charged for training, badging, and parking. The current average annual cost for the level of effort required by ICE for positions (contract detention officers labor hours/posts) at MIA is $1.2M | |
| 12 | DRAFT+RFP+Atch+1+-+Krome+PWS+1-12-2024 | 4.2.5 | 19 | The facility communication/radio system requires a repeater system to function in all areas of the detention center. Is it the Government's intention that the contractor will provide a repeater system or will the contractor be allowed to use the Government's repeater system? | Government will allow to use the government's repeater system. | |
| 13 | DRAFT+RFP+Atch+1+-+Krome+PWS+1-12-2024 | C.6 | 36 | Please confirm logbook purchases are applied to the cost reimbursable ODCs CLIN since they will remain Government property? If not, will the Government provide an approximation of the number of logbooks used annually since this will be a substantial cost? | Confirmed. | |
| 14 | DRAFT+RFP+Atch+1+-+Krome+PWS+1-12-2024 | 7.1 | 37 | The second from the bottom bullet specifies creating detainee detention files. As this is a voluntary work program and these expenses are reimbursible, will the Government confirm that the rate paid to NC volunteers is still $1.00 per day or provide the rate that should be paid? | Confirmed. The rate is still $1.00 per day. | |
| 16 | DRAFT+RFP+Atch+1+-+Krome+PWS+1-12-2024 | 7.8 | 39 | Entrance Access Controls states, "the Contractor must maintain and uphold the personnel entrance, the personnel identification systems, …" |
| Will the Government clarify "maintain and uphold"? Are there current Government provided systems in place or are these systems Contractor provided? If Government provided, will the Government provide information regarding the type of systems, age, and anticipated maintenance and upkeep requirements to enable contractors to price the requirement? | This refers to entrance access controls already in place by the government based on required standards (i.e., identification procedures/processes when granting entrance to the facility, package inspections, etc.). This is not asking for the contractor to maintain a "system" (as in equipment, software, etc.) but simply uphold entrance access controls protocols when employees or visitors arrived at the facility. Please refer to PBNDS 2011 2.4 (Facility Secuity and Control) | |||||
| 17 | DRAFT+RFP+Atch+1+-+Krome+PWS+1-12-2024 | C.9 | 45 | The PWS states "Contractor must provide all equipment and supplies required to achieve a self-supporting and independent operation throughout the period of performance of this contract." This is broad and could be over applied to several areas of this PWS. Will the Government provide additional clarification of this overly broad statement? For example, is the contractor required to provide all kitchen equipment and supplies; all main gate and lobby security screening equipment (e.g. x-ray machine and WTMD), NC property storage containers, etc.? | The KROME SPC operations encompasses multiple ICE programs that are resposible to provide assistance (funding) to alleviate facility issues and provide with necessary equipment/services. The government is NOT asking the contractor to provide all and any equipment but only equipment directly affecting the performance of their functions to meet the PWS detention/transportation requirements. As indicated in this section, the government will only provide equipmen and/or supplies on those instances where the procurement and isntallation of such items are resticted by federal policy or regulation. For example, during intake the contractor shall not be dependent on the government for copiers, papers, and supplies to develop detainee manuals, handbooks, etc. The same applies to law library, the contractor shall provide with necessary copier equipment and supplies to meet law library requirements. For high dollar value kitchen equipment, X-Rays Machines, and other high ticketed items, ICE program takes care of that. Detainee property storage containers, kitchen supplies, is to be provided by the contractor. Please see Detainee Welfare Items / Other Direct Costs list for potential items to be procure through the reimbursable CLIN. When in doubt consult with the COR. All reimbursable items must be approved by the facility AFOD and/or the COR prior to being purchased. | |

| 20 | DRAFT+RFP+Atch+1+-+Krome+PWS+1-12-2024 | 4.2 and 11.1 | 12 and 54 | The sample staffing plan row for Larkin Hospital BHS Officers shows 8/8/5 over three shifts indicating that Larkin is a permanently staffed remote post. Please confirm that this location requires a supervisor on each shift in addition to the officers in accordance with Section 4.2 Bullet 17 (which also aligns with the required Airport Supervisor). | Confirmed. | |

That paragraph goes on and covers OT rates, and overnight lodging approval protocols as well. CLIN 0006 exists because of this. | |
| 25 | DRAFT+RFP+Atch+3+-+Pricing+Template+1-19-2024 | Contract Pricing Exhibit and Extended Pricing Tabs | n/a | CLIN 0003b describes "Transportation - Over GM Miles & Guard Hours with a unit type of "EA". It is not clear how the contractor will provide billing for both mileage and labor in the same CLIN. In addition, reconciliation of the G-391 with the contractor invoice will not be possible. Will the Government split this requirement into two CLINs, one for mileage and one for guard hours? | CLIN X003b: Is not to exceed 200,000 miles per year above the GM and represents a fully burdened mileage rate that includes both above-GM mileage and above-GM labor costs up to 200,000 above GM miles per year. | |
