All provisions of this Article shall be applied in a manner consistent with the Family and Medical Leave Act (FMLA) implementing regulations as revised effective October 28, 2009 and/or the District of Columbia Family and Medical Leave Act (D.C. FMLA). Eligible non- Initial Evaluation Period employees who qualify will be granted up to twelve (12) (and/or sixteen (16) weeks of unpaid leave, as appropriate, for their own "serious health condition", for the birth or adoption of a child, for the care of a child, spouse, or parent with a "serious health condition'·, for qualifying exigency leave for families to service members, or up to twenty-six (26) weeks to care for an injured or ill service member. Employee rights under the Federal or D.C. FMLA shall be subject to all employer rights and prerogatives under those enactments. This Agreement shall not expand those employee rights under the Federal FMLA or D.C. FMLA.
Work Leave for Family or Medical Purposes
The District of Columbia Family and Medical Leave Act (DCFMLA) requires employers with twenty (20) or more employees to provide eligible employees with 16 weeks of unpaid family leave and sixteen (16) weeks of unpaid medical leave during a 24-month period.
Family Leave
Eligible circumstances for family leave under DCFMLA include the birth of a child, adopting a child, or caring for a child in foster care. Caring for a seriously ill family member is also eligible for family leave.
Medical Leave
Eligible circumstances for medical leave under DCFMLA includes recovering from a serious illness rendering the employee unable to work.
Leave under DCFMLA may be taken in blocks of time, intermittently, and in certain circumstances, at a reduced schedule. Employees can also use any accrued time instead of unpaid leave.
The employer may require medical certification and reasonable prior notice when applicable.
Employee Eligibility
An employee is eligible under the Act if she or he has been employed by the employer for at least one year without a break in service, and worked at least 1,000 hours during the 12-month period immediately preceding the requested leave. The one year of service requirement does not need to have immediately preceded the request for leave.
The District government is considered a single employer. The above eligibility requirements can be met by considering employment at more than one District agency.
Final Rule to Revise the Definition of “Spouse” Under the FMLA
The Family and Medical Leave Act (FMLA) entitles eligible employees of covered employers to take unpaid, job-protected leave for specified family and medical reasons. The FMLA also includes certain military family leave provisions.
The Department of Labor issued a Final Rule on February 25, 2015 revising the regulatory definition of spouse under the Family and Medical Leave Act of 1993 (FMLA). The FMLA entitles eligible employees of covered employers to take unpaid, job- protected leave for specified family and medical reasons.
The Final Rule amends the regulatory definition of spouse under the FMLA so that eligible employees in legal same-sex marriages will be able to take FMLA leave to care for their spouse or family member, regardless of where they live. This will ensure that the FMLA will give spouses in same-sex marriages the same ability as all spouses to fully exercise their FMLA rights.
The effective date for the final rule is March 27, 2015.
Major features of the Final Rule
The Department has moved from a “state of residence” rule to a “place of celebration” rule for the definition of spouse under the FMLA regulations. The Final Rule changes the regulatory definition of spouse in 29 CFR §§ 825.102 and 825.122(b) to look to the law of the place in which the marriage was entered into, as opposed to the law of the state in which the employee resides. A place of celebration rule allows all legally married couples, whether opposite-sex or same-sex, or married under common law, to have consistent federal family leave rights regardless of where they live.
The Final Rule’s definition of spouse expressly includes individuals in lawfully recognized same-sex and common law marriages and marriages that were validly entered into outside of the United States if they could have been entered into in at least one state.
Section 2: Disability Leave Without Pay
Regular employees may be granted Disability Leave without pay for the employee's personal illness, injury, pregnancy, or other disability. Such Disability Leave may also be required when the employee is unable to safely perform the essential functions of his/her job with any appropriate, reasonable accommodation. Disability Leave may be granted in addition to any leave granted under FMLA/D.C. FMLA or in place of FMLA leave if an employee is not eligible for leave under FMLA/D.C. FMLA. Subject to medical certification acceptable to the Employer, any eligible employee who becomes unable to perform the essential functions of his/her position, will be provided with Disability Leave for a period of up to six (6) months.
An Employer-designated physician's statement must accompany an employee's request for Disability Leave, and should be provided to the Employer. The statement should verify the medical condition that requires the Disability Leave and estimate the required leave time. A physician's release will be required for return to work in all cases. The Employer may also require that a physician's statement indicating any limitations on the employee's work duties be provided at any time in connection with the Employers efforts to accommodate an employee's medical condition or disability.
Except as provided under the FMLA/D.C. FMLA, or other applicable law, employees absent for more than ten (10) consecutive workdays due to illness, injury, pregnancy, or other disability, must request to be placed on an approved Disability Leave to be considered in employment status.
All Disability Leave must be approved in advance in writing by the Employer, except in emergency circumstances. The employee must apply in writing for reinstatement immediately following the termination of any disability, and if returned to employment, must immediately report for duty at the expiration of the Disability Leave. Employees who do not promptly request to return to work, and return to work at the expiration of their Disability Leave, are subject to immediate termination of employment, as is any employee who accepts or engages in other employment or business activities, or who becomes self-employed while on Disability Leave.
During the Disability Leave, an employee will receive no compensation other than any accrued Paid Leave or Sick Leave to which they may be entitled under this Agreement. Nor will employees accrue any fringe benefits or seniority while on Disability Leave.
Disability Leave will be provided consistent with any applicable legal requirements and the Employer's business needs. Return to work from a Disability Leave is not guaranteed. The Employer will attempt to reinstate employees to their former position, or to a comparable position for which they are qualified, consistent with the Employer's business needs and the availability of positions.
Section 3: Personal Leave Without Pay
A Regular Full-Time employee may request personal leave without pay for a period of up to six (6) months with two (2) weeks notification to the Employer unless it is an emergency in which case the two (2) weeks prior notification requirement shall not apply. It is within the Employer's sole discretion whether such requests, which must be in writing and state the reason for and length of the desired leave, will be granted, however, such leave shall not be unreasonably denied. Neither seniority nor benefits shall accrue during such personal leave.
Employees on leaves of absence for personal reasons who engage in other employment or other business activities during such leave shall be considered as having resigned. Upon giving two (2) weeks' notice of intent to return to work, the Employer will attempt to reinstate the employee to his/her position or to a comparable position. The employee will have to pay the insurance premium out of pocket.
Section 4: Military Service
Employees enlisted or entering the military service of the United States pursuant lo the provisions of the Uniformed Services Employment and Reemployment Rights Act and amendments thereto shall be granted all rights and privileges provided by that Act.

Section 2: Seniority Lists

Section 3: Promotions
In the event that a non-unit promotion becomes available that requires specific skills, ability and/or training, first preference for such job shall be given to the individual at that site deemed by the Employer to be most qualified in terms of skill, ability and/or training, regardless of seniority. If the Employer determines that two candidates for promotion are equally qualified, the promotion will be awarded to the most senior candidate, based on the then current Seniority List. If the employee deemed most qualified by the Employer declines the promotion, such position shall be offered to the employee deemed the next most qualified by the Employer. If the Employer, in its sole discretion, determines that no unit employee is qualified, the Employer may hire an individual from outside the unit to fill such position. If within ninety (90) days of his/her promotion, the promoted employee fails to satisfactorily fulfill the requirements for the position to which he or she was promoted, such employee shall be demoted to his or her original or similar position in the bargaining unit at the employee's prior site or other site, and shall receive the appropriate rate of compensation for such lower position unless removal is directed by the Government.
A bargaining unit position shall not be deemed a promotion unless it carries a higher pay rate than a regular unit employee position. If there is a pay rate increase, interested employees will receive training and the most senior employee will receive the promotion.
Section 4: Reduction in Force
In the event that the workforce load at any location shall be reduced by the Employer for any reason, probationary employees shall be laid off first and shall have no recall rights. Unit employees with the least seniority shall be laid off thereafter provided that the remaining employees are willing and able to provide all coverage required by the Employer. Shift reassignments shall be by bidding.
In the event of a layoff, neither seniority nor fringe benefits shall continue to accrue. An employee shall retain the seniority which he or she possessed at the time of the layoff except as provided in Section 6.
The Employer shall make every effort to give any non-probationary employee, who is laid off at least fifteen (15) working days' notice of the layoff.

Initial Evaluation Period employees who have been laid off have no recall privileges.

D. An employee shall continue to retain recall rights for a one (1) year period commencing from the date of the layoff.
Section 6: Loss of Seniority

Except as provided below, an employee who is laid off for reasons other than the Employer's loss of contract to provide services at each location, will retain his or her seniority for one (1) year.
An employee's seniority with the Employer shall be broken if the employee: voluntarily quits;

A laid off employee who is recalled shall be sent notice of recall by certified mail to the employee's last known address. If such employee does not respond within five (5) business days of the Employer's sending such certified mail, or if the employee fails to respond to or refuses such offer, the employee will be deemed to have voluntarily quit, even if the notice is returned as undeliverable. To accommodate travel and similar out- of-town plans of employees who have been laid off, failure to respond with five (5) business days may be excused in the Employer's sole discretion upon prior written notice that Employee will be unavailable and unable to respond within five (5) days for a limited, specific and finite period of time only. An employee who has voluntarily quit or been terminated has no right to recall and no other rights under this Agreement.
