About this file
This document is a Federal Aviation Administration (FAA) certification guideline issued January 20, 2023, establishing compliance requirements for bidders and offerors on FAA-funded Airport Improvement Program projects. The guidelines apply to both construction projects and equipment/building projects and establish a mandatory certification process that bidders must complete and submit with their proposals. Bidders must select one of four mutually exclusive certification statements indicating their compliance approach with Buy American preference requirements under 49 USC 50101 and related Made in America laws. The certification options allow bidders to commit to 100 percent U.S.-manufactured products, to apply for FAA-issued waivers, or to qualify for Type 3 or Type 4 waivers based on specific circumstances. Selection of certain certification statements requires submission of formal waiver requests within 15 calendar days of being identified as the responsive bidder, with failure to submit required documentation resulting in non-responsive determination and proposal rejection.
The guidelines specify distinct documentation requirements for different waiver types. Type 2 (Nonavailability) waivers require completed Content Percentage Worksheets, Final Assembly Questionnaires, and evidence of thorough market research demonstrating that materials are unavailable in sufficient U.S. quantity or quality. Type 3 waivers apply when U.S. component costs exceed 60 percent of total component costs and require detailed cost analyses and listings of non-domestic components. Type 4 (Unreasonable Costs) waivers are available when Buy American compliance would increase project costs by more than 25 percent and require minimum two comparable bids, supplier scouting documentation, and completed waiver applications for comparable offers. All certifications carry significant legal consequences, as false statements constitute federal offenses prosecutable under Title 18, United States Code and 49 USC 47126. Bidders agree to provide source documentation, maintain domestic product compliance, and refrain from seeking post-contract waivers absent extenuating FAA-determined circumstances.
