About this file
This document is a Questions and Answers (Q&A) file for GSA Solicitation No. 47QSSC-25-R-3040, addressing the GSA Approved Security Container Program. The solicitation seeks proposals from Original Equipment Manufacturers (OEMs) for security containers, vaults, and vault/armory doors under Federal Supply Class 7110, with a total aggregated contract value of $300 million. GSA will award multiple single-award Indefinite Delivery, Indefinite Quantity (IDIQ) fixed-price contracts with Economic Price Adjustments, anticipated to be awarded in October 2025 with an effective date of November 1, 2025.
The Q&A document covers critical aspects of the procurement, including pricing terms (FOB Origin Prepaid), delivery expectations, product requirements, and transition from legacy to new National Stock Numbers (NSNs). Key points include: no inside delivery services are required, contracts will be for five years (one-year base with four one-year options), pricing will be evaluated for fairness and reasonableness, and only OEMs listed on the Qualified Products List (QPL) are eligible. The solicitation is not a small business set-aside, uses NAICS code 332999 with a 750-employee size standard, and proposals are due by August 11, 2025, at 5 pm CST, with technical questions due by July 22, 2025.

Consolidated Q&A
| Question Number | Questions/Comments | Answers/Clarification |
| 1 | 5 Year Pricing – we have to talk with all of our suppliers to determine potential pricing over the next 5 years as EPA’s based on the PPI will not compensate for special material. |
| GSA will evaluate fair and reasonable pricing for each CLIN for the first one-year base period. Economic Price Adjustments (EPA) clause 552.216-71 applies after the first 12 month base period. During the term of the contract, the award price may be adjusted once during each 12-month period upward or downward. See clause 552.216-71, Economic Price Adjustment, pages 45 and 46. | ||
| 2 | We do not know how GSA is going to handle switching from the current NSN’s to the new NSN’s. Since the busy season is here, what happens if an order comes in for 25 each 7110-00-920-9342’s. As it was put in with EOY 2025 Funds and allocated and faxed in, who do you assign it to? You can’t send it back as funds were allocated and it is now FY 2026… Customer does not care, they just want their containers. | There will be no change in the way legacy NSNs are processsed. GSA will establish an NSN termination date which will be the last day legacy NSNs will be active and can be processed under the BPAs. All orders processed under these BPAs will be held to the terms and conditions of the BPAs. Details regarding the cancellation of the BPAs will be communicated by the Contracting Officer and/or Contracting Specialist assigned to administer, and/or close-out of the BPAs. |
GSA anticipates the new, brand-name NSNs will have an effective date of November 1, 2025, at which time the end-users can begin ordering the new brand-name NSNs under the new, IDIQ contract. All manufacturers awarded under this solicitation will begin receiving orders under the new contract numbers in which new terms and conditions apply. See Period of Performance, page 3.
| 3 | Therefore, the last issue is when will the IDIQ go into effect? If it closes August 11th right during the busy season and is issued right as FY 2026 is starting, I do not think that this gives GSA time to get GSA Advantage into place. | It is anticipated that award of the IDIQ contracts will be made in October 2025, with the anticipated effective date November 2025. See Period of Performance, page 3. |
| 4 | Time to get our pictures and fill out the form for each of the new NSN’s and our own paperwork will take much longer than 30 days. We can’t possibly get drawings, labels, accounting programs, paperwork, cut-sheets, websites, and advertising ready to go in 30 days | Please read RFP Sections L and M, pages 84 - 95. These sections details instructions to offerors and the evaluation factors for award and what is required by the submission due date. |
Regarding product images, the Government is requiring product images be submitted within three business days of contract award (not solicitation closing date). See Product Images, Descriptions, and Categorization, page 25. Additionally, Attachment 4 clarifies that GSA will provide the product descriptions for NSNs (as well as categorizations).
NOTE: Amendment 0002 revises product image language to allow for early submission of pictures if they are available and also revises Attachment 4. Images are to be submitted to both the Contracting Officer and Contracting Specialist.
5 Page 16 – Administrative Offset – can there be a clause added that notates that when a PO is received from GSA with no POC or incorrect/invalid information that the date starts from the time we receive the correct information? I currently have approximately 2/3rds of my PO’s that have no POC, incorrect shipping address, need inside delivery and it’s not notated, etc. and some I have in stock and ready to go and it takes me months to receive the information.
This is going to effect lead times significantly as vendors are not going to want to commit to a 30 day lead time when they can do that 98% of the time out of fear that it will cost us money. The overall objective is to obtain the best possible shipment times within industry standards, and which should not exceed 90 calendar days. See page 93, Factor 3 - Shipment. Language on page 16 will remain the same.
See the last paragraph on page 16 under the heading, Administrative Off-set, that gives consideration to hard to find POCs, which reads, "NOTE: Consideration may be given to late deliveries on a case-by-case basis if diligent attempts to confirm the POC and the ship to address were made and supporting documents can be provided to the Contracting Officer."
6 If it could be notated that we need a valid PO with valid information before delivery clock starts. Also, will there be a CO or CS available to make all of these changes (I am not kidding when I say that there is a significant number of PO’s that do not have POC’s or correct shipping information).
Example: I have a PO on my desk that says it’s supposed to go to the FAA in El Paso Texas, I had the unit in stock and ready to go and after talking to 4 different people they advised that the unit is actually supposed to go to a remote location in New Mexico and you can’t drive a standard semi and it’s a one lane road, a driver has to schedule a meeting at a Love’s truck stop, etc. the list was quite lengthy. Also, in this instance it would be considered inside delivery because standard dock to dock carriers could not do this. If the Customer is unable to get immediate funding for inside delivery are we still held to delivery terms or will they start when we receive all the information necessary to process the PO?
Also, will end users be directly BEFORE they place order that they will not be able to receive any type of delivery services other than Dock to Dock unless they are contracted separately? This program has been the same since it’s inception so it’s a huge change for your Customers. Just like the FAA order I have, how would we handle that if they couldn’t get funding? They would have no choice but to cancel the order because they can’t get the container from Site A to Site B. The Requisitoner is requested to enter the Point-of-Contact (POC) information. GSA continues to stress the importance of entering POC information to our customers; however, DoD currently does not require it. GSA will continue to address this issue at IACSE meetings to improve and ensure on-time shipments.
There will be a CO/CS available to make amendments to the PO's as applicable. See the section of the solicitation document titled, Deliveries, on page 14 regarding the contractor's responsibilities under the terms and conditions of the IDIQ contract as it relates to POC information, and for making all arrangements and coordination of all on-time deliveries to the delivery address.
Amendment 0002 clarifies that tailgate shipping is acceptable. In rare situationual occurences, like the one provided in your example, the Contractor is to notify the CO. Contractor's claims will be assessed based on the documentaton provided to the CO by the Contractor. Only the CO can determine if and approve additional freight charge claims, and issue an amendment to the PO.
The updated ordering procedures GSA issues for the subject solicitation will communicate inside delivery is no longer provided.
| 7 | It’s being asked of Contractors to supply GSA the exact information that we are inputing into your vendor portal – I am confused why you would require a vendor to submit to you the same exact information that you should be able to extract from your system? This is redundant work when vendors are already logging the exact information in GSA’s system. | See Amendment 0001, the reporting requirements have been eliminated to avoid redudancy. Instead, in Section H, pg 26 "Contract Deliverable - Monthly Backorder Status Report" GSA wants to partner with industry and receive a monthly status on late and backordered PO's including the reason for delay. |
| 8 | Are you able to add a clause that also allows us to submit a price increase (at least once a year but twice would be ideal) for items that are sole sourced on these containers that we have no control over such as locks and lockboxes. |
| 9 | Page 25 – Product images, descriptions, and categorizations |
As we discussed in the industry meeting, GSA will be uploading all information into GSA advantage. Just confirming this is still accurate. Also, for descriptions are we able to add a note to allow Customers to know if we keep minimal amount of inventory of a certain item or is this limited to certain information.
Also, some items we don’t have a photo of because we have never manufactured or we won’t be manufacturing one before this contract does into effect – are we allowed to submit a photo of our drawing in lieu of an actual photo if none exists?
We have several containers we have never manufactured (as you can see some are on the BPA contracts as Qty 0 because no one orders them) so we wouldn’t be able to manufacture an expensive container just for a photo. If you can confirm what’s acceptable. (GSA global supply currently has some generic photos for some of those items is that acceptable in those instances) GSA will be uploading all information, including descriptions and images, into GSA Advantage. No additional information may be added to the descriptions by manufacturers.
In lieu of photographs, drawings may not be used. If no pictures can be submitted after three days of award noticiation (or sooner), then GSA will use a generic image or "No Image Available" watermark in GSA Advantage. As images become available, they are required to be sent to the Contracting Officer and Contracting Specialist for coordination through the Product Management group for uploading onto the GSA Advantage website.
10 Page 7: There is no requirement for inside delivery, installation, repair, or maintenance.
Can you confirm are we to charge back to GSA the dock to dock portion of the shipping then submit the remainder to the Customer/end user or should the entire amount of the shipment be charged back to the end user. We utilize the same carrier for both so it’s itemized on the freight invoice so all charges will be on one invoice but we can separate those out if needed.
| Also, can you confirm if we are allowed to add a liftgate for delivery to the dock to dock portion? | If timely delivery of the products under any purchase or delivery orders issued against this contract requires lift gate shipping for dock to dock delivery to the ship to address listed on the Purchase Order (PO), then lift gate shipping is considered to be an allowable reimbursable shipping fee under the F.O.B Origin, Freight Prepaid terms and conditions, of this contract. The OEM may charge back to GSA the dock-to-dock portion of the freight bill, including any liftgate shipping under the Government Purchase Order (PO) number. Inside delivery fees are NOT allowable and reimbursable fees under this contract; therefore, the OEM cannot bill GSA against a Government PO for inside delivery fees. If OEMs elect to offer inside delivery to GSA Customers, the GSA Customer cannot purchase inside delivery services under this contract. | |
| 11 | Page 11 – Section E Inspection and Acceptance |
Contract is FOB Origin Pre-pay and Add which means title transfers when it leaves the origin point – language as currently written does not specify timeframe and leaves this open ended. There are many times that organizations order multiple units and they are on deployment, don’t need right away, etc. and these units sit in a warehouse for sometimes several years before use. For clarity and planning purposes, we respectfully request the inclusion of a clause specifying the timeframe for inspection and acceptance following delivery under this contract.
“The Government shall inspect and accept or reject the supplies or services within [10] calendar days of delivery. If no notice of rejection is provided within that time, the supplies or services shall be deemed accepted.”
We believe this will help ensure mutual accountability and facilitate timely invoicing and performance tracking. See page 11, second paragraph, clarifying when title transfers under this solicitation.
See amendment 0002, it is clarified that the Government shall accept supplies as promptly as practicable after delivery and supplies shall be deemed accepted 30 days after delivery. If no notice of rejection is provided within that time, the supplies or services shall be deemed accepted.”
| 12 | Due to the timing of this IDIQ, our registration is set to expire at the same time. SAM always asks that we register at least 60 days early so that paperwork has a chance to go through their system. If I print out a current copy of our SAM registration demonstrating that we have an active ́ registration, will this be sufficient for the solicitation? If I go in and renew, the registration will show pending until SAM has completed their end of the paperwork. | The GSA acquisition team will search SAM accounts for active registration for all offerors during evulations. Renewing SAM registration will not impact acquisition's search on active accounts. |
| 13 | Page 42 & 43 / Default (Section E) |
The clause appears to require the contractor to transfer title and deliver partially completed supplies and materials, parts, tools, dies, jigs, fixtures, plans, drawings, information, etc., upon termination for default.
Given that the government is not furnishing any property or materials under this contract, will the government confirm that this clause applies only to: (1) completed deliverables; and (2) property specifically acquired for this contract to which the government has or will obtain title.
This clarification would help ensure mutual understanding that contractor-owned tools, equipment, or proprietary assets not acquired specifically for this contract remain the property of the contractor. Can this clarification be added to contract language? The clause at 52.249-8, Default (Fixed-Price Supply and Service) (Apr 1984) language will remain the same. The following clarification is provided.
Section e. under the Default clause confirms that the the Government may require the Contractor to transfer title and deliver to the Government manufacturing materials (as defined in the clause) that the Contractor has specifically produced or acquired for the terminated portion of this contract. No Government furnished property has been identified for incorporation into this solicitation.
14 Page 45 – EPA changes did not address the below:
Will the government consider including an EPA clause that allows for a manual adjustment based on documented cost increases for high cost items that are required to be purchased from government specific sources in order to meet the federal specifications. (Locks/Kaba & S&G and lockboxes/Broko Rankin or Lockmasters) as these prices are not reflected in the PPI.
Also, would you consider adding a clause for labor increases. PPI is not reflective of labor so the only real item reflected in PPI for this particular product is steel. It’s a filing cabinet made of steel and the other major components are labor and government specific items only obtainable from government specific sources.
An EPA clause would allow us to maintain pricing stability while protecting the government from excessive contingencies built into our proposal. It would also allow us to keep the cost down in RFP and not incorporate 5 years of potential increases. 552.216-71 - The Economic Price Adjustment—Special Order Program Contracts (Aug 2010) - Alternate I clause on page 45 identifies NAICS codes as 332999, All Other Miscellaneous Fabricated Metal Products Manufacturing, and Producer Price Index (PPI) that will be used for calculating Econmice Price Adjustments (EPAs) under the IDIQ contract awards. NAICS code 332999 applies to the Metal Safe Manufacturing industry (including Steel); therefore the applicable inputs of production, including raw materials (e.g., steel) and labor, are included in NAICS 332999, PPI index based on sell price fluctuations.
See amendment 0002 that changes paragraph (e) of 552.216-71, Economic Price Adjustment—Special Order Program Contracts (Aug 2010) - Alernate I that revises the timing of when a price adjustment can be requested.
15 a. FAR 16.504 (c)(1)(ii)(D)(1) - A single contractor can not be awarded more than $100,000,000.00 including all options
b. On Page 8 it states, “ the Maximum aggregate value of the IDIQ is $300,000,000.00 – The title bullet states the “Total Maximum Contractor Dollar Amount for Supplies that Contractor Agrees to Supply the Government”. We can only agree to supply the government $100 Million per contractor. The government maximum agreement is $300 Million total for ALL contractors. You state this in the second paragraph at the top of this page.
c. Page 38 states $3M Maximum order limit on one order or group of orders...
Wording on Page 8 where it states that the TOTAL the Contractor agrees to supply the government is $300 Million. Need Clarification. a. In accordance with FAR 16.504 (c)(1)(ii)(D)(1), No task or delivery orders in an aggregate amount estimated to exceed $100 million (including all options) may be awarded to a single source unless the head of the agency makes a determination in writing.
b. The maximum total aggregate award value (including all options) of the total combined IDIQ contracts, including all task or delivery orders, under this solicitation is $300 million to all awardees under this solicitation. It is correct that contractors can only supply the government $100 million per contractor, unless the head of agency makes a determination in writing.
c. $3 million is the maximum for one PO.
See amendment 0002 for clarifications to this section.
| 16 | FACTOR 4 (page 92) – we cannot meet this requirement as we have conflicting information on the amount (is it $0.00 or $2,500.00?) Need Clarification. | The contractor must accept PO's with a $0 minimum. The total aggregate contract minimum that the Government guarantees is $2,500. Meaning if any OEM does not receive at least $2,500 in orders from end-users during the first base period, GSA will make a payment of $2,500. | |
| 17 | Will you be negotiating prices with OEMs before the award is made or will you decide not to award that Brand Name NSN without negotiation? | The government intends to negotiate; however, has reserved the right to award without negotiations. | |
| 18 | What happens if we have increases with KABA or S&G Locks and the increases are not represented in the PPI? Or the lock manufacturers increase prices at a time which is not during our 30 day renewal window? These are fixed costs that we cannot control and must use on GSA’s Security Containers. | Manufacturers will need to make a business decision on when they will submit price increases (see amendment 0002 revising paragraph (e) of the EPA clause that revises the timing of when a price adjustment can be requested. The Federal Acquisition Regulations (FAR), General Services Administration Acquisition Manual (GSAM), and/or other authorities may cite instances in which the agency may raise the price ceiling (the aggregate of permitted price increases during a 12-month period) when certain conditions are met. GSAM 516.203-3 (c)(1)-(2) is currently one such example. However, FAR, GSAM, and other applicable authorities are subject to revision, update, and may be superseded at anytime. | |
| 19 | As this is potentially for 5 years with little chance of EPA increases, are we allowed to put our individual Brand Name NSNs on a temporary sale? Immediately? GSAAdvantage states that sale prices are in effect immediately (when submitted) Is this true? | In response to the solicitation, all interested parties to this IDIQ contract are requested to quote their unit prices for a twelve-month contract period. Any resulting contract is considered an open market contract (as opposed to MAS contract). The only reason that the brand name NSNs awarded against the subject IDIQ solicitation are posted to GSA Advantage is so that end-users/GSA customers have visibility of GSA Global Supply items that have contract coverage (essentially an advertisement/catalog). GSA Advantage displays items from both GSA Schedule (MAS) contracts and Global Supply open market procurement (where customers order GSA Global Supply items and products are requisition first pass to contractors). Temporary sales cannot be uploaded to GSA Global Supply items in Advantage; however, GSA will accept a reduction in price. Any increases after the reduction must go through the EPA process. | |
| 20 | Can we give volume discounts on individual items? Can we give different volume discounts on different items as they will each be awarded individually? | Volume discounts may be provided and at different volumes per CLIN. | |
| 21 | How much will GSA add to our price on GSAAdvantage!? Standard 15%? | Any GSA mark-up that may be applied to the CLINs/NSNs to be advertised on GSA Advantage has not been determined. | |
| 22 | It also brings up the question of which company and NSNs will the contracting officer | ||
| release first into Advantage? | Contractors/Awardees will not be uploading images and/or descriptions for this requirement into GSA Advantage. GSA's Product Management group will prepare every NSN on the platform with its anticipated release for all OEMs on November 1st. | ||
| 23 | The most concerning point in the discussion of new versus old NSNs is that there is no mention of a crosswalk or reference guide, where it would be located, or how it could be accessed by the end users your customers? | GSA will provide a crosswalk to end-users. The exact locations of where customers can access it have not be finalized, but will be available through DoD and GSA websites. The Crosswalk will also be distributed to the IACSE committee for further distribution. | |
| 24 | As the descriptions and adjoining brand name NSNs will be handled in Global and Advantage websites, will there be references or comparisons available to other customers as well? What happens when a customer looks up an old NSN? | If a customer looks up a legacy NSN in FLIS, it will show terminated. A search for a legacy NSN in GSA Advantage will have no results. Any customer looking for a GSA Approved Security Container will have access to the crosswalk through DoD and GSA websites. |
NOTE: The results on FLIS and GSA Advantage for legacy NSNs will be dependent on when the NSNs/legacy BPAs will be terminated in which the OEMs will receive notice.
| 25 | As our company is under a MAS contract for accessories, we have a current GSAAdvantage! Account. Do I need to get another account as these are on a different procurement instrument and contract number? | No additional account is needed. GSA will operate all functions of the GSA Advantage platform for these items as it represents Global Supply. |
| 26 | How will you get all of the OEMs, their new Brand Name NSNs, new descriptions, old descriptions, old NSNs, and new prices all ON LINE by November 1st? | These procedures will remain internal to GSA and GSA's Product Management group will handle the transactions for the GSA Global Supply Cataglog via GSA Advantage. |
| 27 | Will each OEM be responsible for submitting their own information into GSAAdvantage? | No, all uploads into GSA Advantage will be done by GSA. |
| 28 | When will each OEM be required to have a GSAAdvantage! Account and on-line catalogue ready to go and be approved by the contracting officer? | This is not a requirement. |
| 29 | Will each OEM submit their entire awarded Brand Name NSN’s at one time on Advantage? | Asked and answered above. |
| 30 | How will we know what amount to put into GSAAdvantage for each of our Brand Name NSNs so that our price is marked up accordingly? | GSA will input pricing that will include our mark-up. |
| 31 | How will the current NSNs be crosswalked in GSAAdvantage so that our customers can see that we manufacture the same NSN but with a new Brand Name NSN? | End-users can find the crosswalk on the GSA and DoD websites. |
| 32 | Will customers be able to compare prices of OEMs next to each other for each legacy NSN or will they have to look up each Brand Name NSN to determine the prices? | The pricing as a result of this solicitation will be provided on the crosswalk. |
| 33 | Are there “generic” descriptions that we are required to put into our SIP catalogue files? | All descriptions for NSNs will come from GSA's engineering. |
| 34 | How long will it take for Advantage to upload all of our SIP catalogue files? | All descriptions and image uploads will take place with GSA's Product Management group. Manufacturers will not upload their own files. |
| 35 | Is it first come, first serve as far as who submits their SIP catalogue to the Contracting Officer first? Or will you approve all of the OEMs SIP catalogue files at one time? | Asked and answered above. All NSNs will be published at once. |
| 36 | What if one of the OEMs does not get their Advantage Catalogue to you in a timely manner? Will that hold up the other OEMs from being listed on Advantage? | Asked and answered above. |
| 37 | What happens to the orders accepted by GSA with old NSN’s while the new program is being uploaded and updated in Advantage? Who receives the orders? | Old NSNs will only be processed via legacy BPA numbers. Any orders received with legacy BPA numbers should adhere to those terms and conditions. There will be no change to order assignment processes if the legacy BPA numbers are being used. |
| 38 | What will the customers see when they type in a legacy NSN into Advantage? Will any other options appear for them? | Asked and answered above. |
| 39 | What about the other armed services platforms that feed into GSAAdvantage!? The Air Force has an Advantage site – will you coordinate your release with them? | GSA Engineering and Cataloging will coordinate the release of the new NSNs with all services. |
| 40 | As we will not have a new contract number until award, we will not be able to get a new Advantage account. How long will you give us to get an Account and get files uploaded? | You will not need a GSA Advantage Account for the resulting contract. |
| 41 | Who do we provide images and descriptions to? | Images will need to be provided to both the CO and CS for the contract: Amanda Foley and Theresa Cox. Each image must be titled "NSN_Cage." Example 7110-00-111-2222_123AB. |
| 42 | Will GSA be uploading all of the information to GSA advantage as we discussed in the industry meeting? | Yes, GSA is responsible for uploading description and images into GSA Advantage. |
| 43 | If we do not have photos, keep in mind there are many items we don’t have photos of because we have either never manufactured or that we won’t have before deadline. It’s not financially possible to manufacture a container for catalog purposes. Is it acceptable for all items we don’t have a photo for to submit a photo of a drawing? GSA’s current catalog is missing many photos or there is a generic photo. | Asked and answered above. |
| 44 | What are you defining categorizations? | Categorations for this procurement is under GSA Approved Security Containers and Vault Doors of FSC 7110. |
| 45 | PAGE 74 – Can you please remove this clause as it does not pertain to our GSA |
Approved Security Containers? If you cannot remove this clause, how do we fill it out?
If we leave it blank will this be considered an incomplete contract? We are asking for removal of this clause in our contract because it does not concern GSA Approved Security Containers – (k) Certificates regarding exemptions from the application of the
| Service Contract Labor Standards | This is part of the overall clause 52.212-3, and is required to be in the solicitation. In refernce to 52.212-3 (k) which states: Certificates regarding exemptions from the application of the Service Contract Labor Standards (Certification by the offeror as to its compliance with respect to the contract also constitutes its certification as to compliance by its subcontractor if it subcontracts out the exempt services.) [The contracting officer is to check a box to indicate if paragraph (k)(1) or (k)(2) applies.] Since neither (1) or (2) has been checked by the contracting officer, this is NOT applicable to this solicitiation and therefore would not need to be addressed. | |
| 46 | Why are there two extra pages on Attachment after the signature pages? What are we | |
| supposed to do with them? | We couldn't find extra pages. If pages are blank they may be disregarded. | |
| 47 | IPD’s on Attachment 2 : Q : Will you be able to correct the mistakes on my IPD’s in |
time for me to properly bid on the RFQ? What will happen if they are not corrected in time? Corrections to nine IPDs can be found in Amendment 0002: 1)7110-01-726-7196, 2) 7110-01-726-7199, 3) 7110-01-726-7195, 4) 7110-01-726-7198, 5) 7110-01-726-7185 6) 7110-01-726-7882, 7) 7110-01-726-7881, 8) 7110-01-726-7889, and 9) 7110-01-726-7894.
Additionally, if there are anymore part number discrepancies found please complete column L of the Revised Contractor Response Document Spreadsheet (CRDS) that has been posted with Amendment 0002. These notes/comments will be shared with engineering for updating IPDs and QPLs.
| 48 | QPL’s on Attachment 3 Q : Will the QPL’s be updated to correct the nomenclature on | |
| my Brand Name NSN’s before it is released as a permanent document? | Yes, QPLs will be updated once all evaulations have been completed and prior to publshing on the Assist website. | |
| 49 | Section E – Page 11, 2nd paragraph states, “The parties mutually agree an understand |
that the TITLE and risk of loss for damage supplies does not transfer to the Government until Inspection”. Q: Can you please remove the word TITLE so that the payment requirement on page 28 52.212-5 (5) 52-232-40 Providing Accellerated payments to
| small business (15 days) will not be missed? | This language will not prevent prompt missed payment per the referenced clauses. | |
| 50 | Q: Can you please remove SECTION E as it is covered in Page 17 52.247-32 (b) (4) |
(i), (ii), (iii ) ? – 52.247-32 (b) (4) ( i), (ii), (iii) FOB: Origin, Freight Prepaid states ,”The contractor will be responsible for any loss of and/or damage to the goods before delivery and while in the carriers conveyance. Meaning that until a POD is signed by receiving personnel the OEM’s are responsible for the Security Containers. AND it is covered on Page 27 52.252-2 Clauses incorporated by Reference: 52.212 -4 Contract Terms and Conditions Commercial Products (j) Risk of Loss – “Risk of loss or damage to the supplies provided under this contract shall remain with the Contractor until, and shall pass to the Government upon: 1. | 69 | g. Why are you using the GSAM clause 552.211-76 for frustrated freight claim charges |
when that is for freight going to GSA Wholesale warehouses when GSA no longer is in
| the warehousing business? | Page 15 Frustrated Freight/Charges for Improper Marking and Labeling, see amendment 0002 to correct the charges to read under clause 552.211-73. | ||

| 74 | c. Will you be using Section 5.5 from Mil-Std 129R for all standard shipments? | Yes | |
| 75 | d. Will you be using Section 6.3.3 from Mil-Std 129R for FMS Orders? | It looks like 5.6 covers FMS and 6.3 is International standardization agreement implementation. | |
| 76 | e. Which Packing list do you want us to use? Do you want #1 or #2 |
i. #1 RFP Page 28 522.211-77
| ii. #2 Mil-Std-129R Change 3 5.5 | Both are applicable, as MIL-STD-129R change 3 5.5 adresses the shipping container marking requirements and the packing list is usually found inside the package of shipping container. Any conflicts within the packing list requirement and any references within the MIL-STD-129R, the most current revision of MIL-STD-129R shall take precedence. | |

i. Will we be paid?
| ii. Do we let the freight company keep the container? | This will have to be evaluated on a case-by-case basis and in some cases the government may ask for a restocking fee. However, under no circumstances should the freight company ever keep the container. | ||

ii. SHIPMENT STATUS 90%
| iii. ON-TIME 80% | No. Offsets are at the Governments discression. | ||
| 82 | b. How much will you rely on the Data provided in the OMS reports for the Scorecard | ||
| Metric? | OMS is part of the metrics used for monitoring performance. If discrepancies arise they can be discussed with the CO/CS. | ||
| 83 | c. Will the dates in the Scorecard metric be adjusted as shown by the bottom notations? | As updates are made by the OEM in OMS, performance metrics should be updated on the subsequent reports. | |
| 84 | d. Do we still send our responses when we disagree with the OMS status and flags to GGS Contractor Performance as well as to our contracting officer in the spreadsheet that you will provide? | Yes | |
| 85 | e. Why are you not allowing for seasonal and contract surges in our metrics? | These will be taken into consideration on a case-by-case basis. | |
| 86 | METRICS – Last week’s Metric Scorecards from GGS Contractor Performance (No order left behind) for my BPA’s showed I had 16 orders that I was late on with out a backorder. | ||
| However, when you looked at the spreadsheet sent along with the documents, you could clearly see that all orders were in backorder status and flagged accordingly. Additionally, they stated that I missed a due date, when I had shipped an order early. The last one was filled out by a CO who never spoke to me regarding the contract, did not know the orders that I filled on the contract or how I filled them. Do we have the option to show you the CPARS reports where we worked with our CO? Can we provide you with the reports that should really count? | CPARS will be pulled for each contractor UEI. Any report completed, regardless of dollar value, will be shown for CO review. | |

| 92 | d. In the last paragraph at the bottom of page 14, what do you mean when you say timely? |
24 hours, 48 hours, 1 week? Depending upon the complexity of the report you are requestion we many need considerable time to get this to you. Is this considered
| grounds for termination of the contract? | All EDI requirements must be met according to the EDI attachment. Timely means a quick response within 24-48 hours, giving the govt. a response and/or request for additional time. Communication is key. | ||
| 93 | e. We are not able to meet the first half of your first requirement on reporting and delivery requirements on the bottom of Page 14 – “Provide real time order status (terminal-to terminal updates) and tracking information (tracking number and carrier) | This is a requirment to do business with the government and is not negotiable. Providing carrier information and tracking number meets the requirement. | |
| 94 | f. No one can meet the requirement to Provide real time order status (terminal-to terminal |
updates) as we do not send these by UPS, USPS or FedEX surface mail. These are sent using GROUND FREIGHT. We can only supply you with a tracking number (PRO Number), Carrier information, and a Bill of Lading. Will we fail to meet the stated
| Delivery standards in your RFP? Will our contract be terminated? | Please see response above. | |
| 95 | g. In the second bullet point on page 15, how are we to identify all supplies via a |
standardized system when you have removed the NSNs and given us all Brand Name
| NSNs? | In the solication document you were provided the "old' NSN and the 'new' NSN. Please use this as your refence going forward. Once this conract is awarded the 'old' NSNs will be terminated. | |

| 99 | c. Who determines where the fault lies in improper items, packaging, labeling, late or missing freight? There are many instances where the receiving warehouse mismarks or stores freight in the wrong place, do not tell end users their products have arrived. Many end users call us and tell us we sent the wrong item only to find out that their purchasing officer ordered the item we sent. Therefore, who would pay for the cost if it was not due to OEM error but errors on the other end? How would we know that this is truly our error? | This is determined by the Goverment. Instance of discrepancy will be handled on a case-by-case basis. | |
| 100 | d. Can this clause be re-written to allow for some of the responsibility of receiving security containers and accepting them to be placed on the customer? | The language will remain the same. | |
| 101 | e. Who determines when an order is delivered “late” in accordance with the terms of the | ||
| contract? | Your delivery term will be added to GSA's contract ordering system and will be calculated based on that date. DARO's timeframe begins once the Purchase Order has been issued. Changes may be made on an individual basis via bi-lateral modification. | ||
| 102 | f. What is considered “late”? Is it late if it is backordered? Is it late if it is bumped by a | ||
| priority or DX rated order at the last minute? | Anything exceeding the delivery date that was awared will be considered late even if backordered. Exceptions by priority orders will be handled on a case-by-case basis. | ||
| 103 | g. As the terms in the contract vary from clause to clause regarding receiving orders, | ||
| accepting orders, FOB terms, who will make this determination? | The governemnt will make this determination, based on the DARO your company quotes and is awarded. | ||
| 104 | h. Who determines poor on-time delivery? What is the standard that on-time delivery is | ||
| measured against? | See above. | ||
| 105 | i. Will you be using the flawed metrics of the OMS system to measure the on-time | ||
| delivery? | Asked and answered above. | ||
| 106 | j. How will you consider the delays caused by users that are moving to the new building? | This would be an exception and will be handled on an individual basis. | |
| 107 | k. How will you consider delays caused by the two required lock manufacturers who are |
not providing enough locks and fulfilling required orders, thereby holding up our
| production? | See above. Communication is key. | |
| 108 | l. How are you going to determine when the tracking data is not entered or submitted by | |
| the contractor as OMS has a habit of “going offline”? | This would be an exception and will be handled on an individual basis. | |
| 109 | m. How are you going to determine when the tracking data is not entered because the |
shipment is being held due to the end-user not allowing for delivery therefore the
| shipping company cannot provide Proof of Delivery in the correct amount of time? | This would be an exception and will be handled on an individual basis. | |
| 110 | n. How are you going to determine if the tracking data is not late when a shipment gets | |
| held up in a snowstorm? A flood? A hurricane? | This would be an exception and will be handled on an individual basis. | |
| 111 | TERMINATION/ DEFAULT: |
a. DEFAULT – RFP Pages 42-43 52.249-8
b. Why do we have this clause when the termination for the Government’s convenience
| clause RFP P84 52.212-4(l) is already in place? | Both clauses are applicable and used at the Governments' descretion based on the information at hand. | ||
| 112 | c. Will you be removing this Default clause? | No. | |
| 113 | d. Why do we have this clause when the termination for Cause clause RFP P84 52.212-4(m) is already in place? | This is applicable to this procurment. | |
| 114 | e. Will you be removing this Default Clause? | No. | |
| 115 | f. If you want to have our companies manufacture security containers for you, why have |
this clause that is completely subjective and will allow the Government to Default at any
| time? | This is applicable to this procurment. | ||
| 116 | g. Will you be removing (e) from this clause? | No. | |
| 117 | h. How can the government require us to give them our proprietary GSA Approved |
Security Container plans, supplies, materials, parts, tools, etc. when all of this is closely
| monitored by GSA/IACSE? | Section e. under the Default clause confirms that the the Government may require the Contractor to transfer title and deliver to the Government manufacturing materials (as defined in the clause) that the Contractor has specifically produced or acquired for the terminated portion of this contract. No Government furnished property has been identified for incorporation into this solicitation. | ||
| 118 | i. Will you be removing (g) as well? | No. | |

| were given in full text? | Yes. | |
| 120 | b. If it does, then do we also fill out and document 52.212-1 Instructions to Offerors | |
