WARNING: This document is FOR OFFICIAL USE ONLY (FOUO). It contains information that may be exempt from public release under the Freedom of Information Act (5 U.S.C. § 552). It is to be controlled, stored, handled, transmitted, distributed, and disposed of in accordance with DHS policy relating to FOUO information and is not to be released to the public or other personnel who do not have a valid “need-to-know” without prior approval of an authorized DHS official.
CHAPTER 1 - INTRODUCTION TO THE STANDARD
1.1 BACKGROUND
United States (U.S.) Customs and Border Protection (CBP) is the single component within the U.S. Department of Homeland Security (DHS) responsible for managing, securing, and controlling the nation’s borders to prevent terrorists and their weapons from entering the United States, while facilitating lawful international travel and trade.
CBP’s priority mission is homeland security, with the responsibility to improve security at and between U.S. Ports of Entry (POEs) as well as extending the zone of security beyond the physical borders of the United States.
CBP provides security and facilitation of international trade and travel at POEs using traditional and innovative approaches.
Traditional methods include screening individuals, comprehensive examinations of suspect baggage and cargo, and a diligent effort to protect American agriculture from the introduction of infectious plants, animals, pests, and disease. Innovative approaches include the use of non-intrusive inspection (NII) technology, license plate readers (LPR), and radiation portal monitors (RPM) to enhance inspection efficiency and efficacy.
This Design Standard (DS) applies to all Land Ports of Entry (LPOEs) in the U.S. An LPOE is a facility that provides controlled entry into or departure from the U.S. for persons and cargo arriving as commercial, non-commercial, pedestrian, or rail traffic.
An LPOE houses CBP and other entities responsible for enforcement of federal laws pertaining to immigration, drugs, agriculture, wildlife, smuggling, and commerce.
1.2 APPLICATION AND USE OF THE DESIGN STANDARD
This LPOE DS, henceforth referred to as “this Standard,” provides its users with the following:
• Criteria to be used for planning, programming, budget formulation, design, and construction of new LPOEs or renovations, additions, or alterations to existing LPOEs.
• Project stakeholders and standard requirements coordination practices.
• Technical requirements and criteria for the construction of CBP spaces at LPOEs.
• Standard operations definitions that inform programming, code applicability, and design.
• A baseline for program of requirements (POR) and budgetary estimates.
• Parameters and adjacency guidelines for proper programming and layouts of LPOEs.
• Applicable authorities that govern planning and execution of LPOE construction and alterations projects.
If a member of a project team (CBP stakeholder or architect/engineer) needs clarification on a requirement in this Standard, that team member must submit a Request for Information (RFI) to the Office of Facilities and Asset Management (OFAM) Field Operations Facilities Program Management Office Project Manager (FOF PMO PM), who is the CBP designee for interpretation of this Standard. No architect, private party, or other entity within CBP or General Services Administration (GSA) has authority to make a binding interpretation of any CBP Facility DS.
1.2.1 Definition of the LPOE Design Standard
This Standard is CBP’s policy that establishes minimum requirements that must be met in all LPOE projects. Proposed revisions to these requirements are subject to a waiver request process, per Section 1.2.6, Alternate or Equivalent Means, Exceptions, and Deviations, in this Standard.

It is to be controlled, stored, handled, transmitted, distributed, and disposed of in accordance with DHS policy relating to FOUO information and is not to be released to the public or other personnel who do not have a valid “need-to-know” without prior approval of an authorized DHS official.
1.2.2 Applicability
This Standard applies to the planning, programming, design, and construction of LPOE projects and serves as the primary reference for architect/engineer (A/E) consultants, government agencies, facility operators, transportation lines, and all CBP personnel involved with an LPOE facility project.
This Standard applies to LPOE projects as follows:
• All new construction, defined as construction of a building or structure where none previously existed or renovation of a building or structure that was not an existing LPOE.
• All additions to an existing LPOE, defined as adding operational and physical capacity to buildings or site structures, including roadways, or new equipment or systems required for LPOE functions and operations.
• All alterations to an existing LPOE, defined as remodeling, improving, extending, or making other tenant-requested changes to an existing LPOE, exclusive of maintenance or repair work.
• Planning, programming, engineering, design, project execution, and closeout/acceptance activities for all above-mentioned project types must conform to the requirements in this Standard, unless otherwise directed by the FOF
PMO PM.
1.2.3 Use of Terms “Will,” “Shall,” “Must,” “Should,” and “May”
This Standard uses the terms “Shall,” “Must,” “Should,” and “May” as defined below:
• “Shall,” and “Must” indicate a direction or requirement that is mandatory.
• “Should” indicates a course of action that CBP strongly prefers but does not consider mandatory. Project sponsors and service providers shall include these items in all scoping and estimating proposals unless the project sponsor and service provider can demonstrate a reasonable argument not to include these items.
• “May” indicates a course of action that CBP prefers but does not consider mandatory; it often includes the selection of a course of action from more than one acceptable option. Project sponsors and service providers shall include these items in all scoping and estimating proposals unless the project sponsor and service provider can demonstrate a reasonable argument not to include these items.
The Office of Field Operations (OFO) is the approval authority for all alternatives, exceptions, and/or deviations to all directions, criteria, or requirements listed as “should” or “may” and all request must be routed through OFAM.
Refer to Section 1.2.6, Alternate or Equivalent Means, Exceptions, and Deviations, in this Standard for details.
1.2.4 Design Standard Compliance
The most current signed edition of the LPOE DS at project inception, including any issued Interim Guidance, applies to all projects. Project inception is the actual start of an in-house CBP feasibility study or the date of contract with a consultant commissioned to provide a feasibility study. The feasibility study addresses an individual LPOE construction project, including PORs, project budgets, time schedules, and other specific requirements unique to that individual project. As projects move from study phases to building design phases, the date of inception must change to the date of contract with an A/E consultant for development of a building project for design-bid-build delivery or the date of issuance of a request for proposal (RFP) for design-build delivery.

The completion of a feasibility study or the pre-design phase marks the end of the planning phase of a project and the beginning of the design phase. In the design phase, incorporating new requirements into the design of a project starts to have cost and schedule implications. Therefore, potential changes or new requirements must follow the FOF PMO change control process, which is managed by the FOF PMO PM. Through the change control process, requirements and proposed alternatives are evaluated against cost and schedule implications. This process determines whether the new requirement will be implemented. The exception to this general rule is for projects that have completed the feasibility study and are awaiting design funds. When a design is delayed by two years or more after the completion of a feasibility study, a requirements refresh should take place before a funding request is initiated to ensure that the design programming and budget allow the project to be designed and constructed in compliance with this Standard. The CBP-approved POR must be finalized before the project moves into the design phase.
Facilities planners and designers must adhere to requirements in a new Standard based on the following hierarchy of requirements and project stages.
Table 1-1. Schedule of Standard Compliance
If a new Standard is issued when the… Then…
Feasibility study is not yet complete All planning, site selection, and design must be fully compliant with the new Standard.
Feasibility study and pre-design activities are complete;
awaiting design funding
Design must comply with the new Standard. A requirements refresh should take place before requesting design funds to ensure that the design programming and budget allow the project to be designed and constructed in compliance with the new Standard.
Feasibility study is complete; design documents are less than 60% complete
Design must comply with the new Standard. The FOF PMO PM has the authority to review new requirements against the design documents and request a waiver from any new requirements that present a significant impact to scope or schedule.
Design documents are greater than 60% but less than 90% complete
Design must comply with the new Standard as it affects code compliance, physical security, and life safety.
Compliance with all other new requirements presented in the new Standard requires review by the FOF PMO PM based on a thorough assessment of cost, schedule, and scope impacts as well as compliance with Office of Professional Responsibility (OPR) physical security standards and OFO’s operational considerations. If it is in CBP’s best interest to comply with a new requirement(s) or if there is a change to the baseline schedule and/or cost, the FOF PMO PM must submit a formal change request to obtain approval and funding for the change.
Final design documents are issued for construction, but the start…
