47PF0024R0007 Detroit Janitorial Questions & Answers

1. Is it possible for a Sole-Source for this project?

a. No. This is a competitive 8(a) procurement.

2. How do I request to get solicitation moved to a GSA Schedule and 8A.

a. There will not be any changes made to the acquisition plan.

3. In Section L. Instructions, Conditions, and Notice to Bidders/Offerors, paragraph L.2 Instructions for Submitting Proposals, Past Performance section on page 221 it states the following: “While offerors must submit evidence of a minimum of three (3) customer references for past performance evaluations…” In Section M. Evaluation Factors for Award, paragraph M.4 Past Performance – 30%, on page 236 it states the following: “FAR 15.305(a)(2)(iv) states, “In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance.” Therefore, failure of the offeror to provide a minimum of three relevant references, and/or the inability of the Government to complete a minimum of three reference checks, after making a reasonable effort to do so, will result in the offeror being rated as “neutral” on the past performance factor.” These two seem to contradict each other. Can you please confirm that our firm would still be compliant, receive a neutral rating, and remain eligible for award if we are unable to provide three (3) customer references?

a. That’s correct, you would be rated as neutral and still eligible for the award.

4. I did not see any page count limits for Volume I. Can you please advise what the page count limits are?

a. There is no page count limit.

5. Do we have to be on the GSA schedule?

a. No.

6. Will this require General Liability Insurance?

a. Yes. Per Section H.18 of the RFP, the Contractor shall obtain and maintain for the entire life of the contract, in addition to any insurance required by law, the following minimum kinds and amounts of insurance required pursuant to FAR clause 52.228-5, Insurance – Work on a Government Installation, and GSAR 552.228-5, Government as Additional Insured.

i. Workers' compensation insurance in the amount required by the jurisdiction in which the Contract is performed. The Contractor shall obtain Employers' liability coverage of at least $100,000.

ii. Broad form comprehensive commercial general liability insurance in the amount of at least $500,000 per occurrence. Such insurance shall include, but not be limited to, bodily injury and property damage ($50,000 per occurrence).

iii. Comprehensive automobile liability covering the operation of all automobiles used in connection with performing the contract in the amount of at least $200,000 per person and $500,000 per occurrence for bodily injury and $20,000 per occurrence for property damage.

The Contractor shall promptly provide to the Contracting Officer proof that it has obtained insurance required by the contract in the form of certificates of insurance. The Contractor shall submit to the Contracting Officer all renewal certificates issued during the life of this contract immediately upon issuance.

7. Can we apply our Professional Liability Insurance, which covers up to $1 million nationwide and applies to third parties?

a. Please refer to question #5.

8. Will past performance be a significant factor in your selection process?

a. Per Section M.4 of the RFP, past performance is 30% of the evaluation.

9. We have years of experience on the commercial side for janitorial services. Can we submit this for the past performance?

a. Yes. Per Section L.2 of the RFP, past performance can be provided for contracts of similar or greater scope for Governmental or commercial properties.

10. Is the incumbent able to rebid for this project?

a. No, the incumbent has since graduated out of the 8(a) program.

11. What's the current head count per manpower reports submitted by the incumbent?

a. GSA does not have a comprehensive list of contract employees at this time.

12. Once the deadline to submit proposals has passed, how long will it take for the contract award to be announced?

a. Award will be made on or around March 1, 2024.

13. Will the government reduce the performance period completed to at least 1 consecutive year?

a. No. In order for past performance references to be deemed relevant, the performance period completed must be at least 2 consecutive years. There's no regulatory or policy requirement regarding the number of years a contract needs to be in place to be considered relevant past performance. Historically, GSA Region 5 (R5) has used a minimum of 2 consecutive years to show that the contractor has experience performing contracts with a period of performance longer than one year. There has been no change to this in R5.

14. Will the government reduce the single building requirement to at least 400,000 square feet?

a. No. The net cleaning area for PVM alone is 721,653 square feet. In order for past performance references to be deemed comparable, contracts covering a single commercial or government building must be at least 500,000 gross square feet. The combined net cleaning area for this requirement is 1,527,274 square feet. In order for past performance references to be deemed comparable, contracts covering multiple commercial or government buildings must be at least 1,000,000 gross square feet combined.

15. I saw that the RFP mentions having the proper security clearance in section H.5. In that section, it mentions only fitness determination and GSA Tier 1 background checks. Is there a cost for these, and if so, how much?

a. No, there is no cost to you.

16. Will we need to perform cleaning duties in Judges Chambers? If so, will we need to be escorted and how much will that cost?

a. Yes, duties will include Judge’s Chambers. Typically, no escort will be needed (no additional cost).

17. What are the teaming parameters and how subcontractor past performance will be evaluated?

a. Offerors submitting under a Contractor Teaming Arrangement (CTA), joint venture (JV), or any major subcontractor arrangement, must provide a copy of the agreement detailing ownership stakes, roles, responsibilities, and description of tasks to be performed by each member, along with the associated proposed prices (e.g., unit prices, labor categories, and hourly rates). For CTAs, an authorized representative of each entity must sign the proposal package and provide a certificate or statement that identifies a single point of contact, i.e., a principal representative (by name) of the CTA for purposes of resolution of contractual matters and payment issues. For prior experience and past performance, projects may be submitted as a team or for an individual member of the arrangement. Evidence of a history of successful past performance as a team will be considered an asset because it minimizes risk to the Government. For individual references, each firm in the arrangement will be evaluated and the composite score will be the average of all the scores for each firm.

18. Appendix A of the CBA is missing. Can that be made available?

a. The union (SEIU Local 1) said there was originally an Appendix A with job descriptions and wage rates, but it was moved into the body of the CBA and whoever negotiated that contract didn't eliminate the reference to the Appendix.

19. Are Rosa and Customs not a CBA driven site?

a. Correct. Only PVM and Levin fall under the CBA.

20. Are there additional clearances for the U.S. Marshals Service?

a. No, not at this time.

21. What happens if you don't find anyone with the 8(a) certification?

a. We would work with the Small Business Administration (SBA) to find a solution since this procurement is required to remain in SBA’s 8(a) program.

22. Can you advise if a bond is required?

a. No, a bond is not required.

23. Can you advise if there is an opportunity to sole source the above referenced project?

a. See answer to question #1.

24. How will this specific past performance meet the needs of the GSA more than the general 1 yr of experience?

a. See answer to question #13.

25. Can these new more stringent GSA regulations or recommendations that can be documented?

26. The requirements will restrict competitive bids from being issued and/or reviewed in a favorable light by the GSA. Number of references on GSA Solicitations generally is a maximum of 3 Past Performance references and Prior experience reference. The requirement of 3 minimum references in prior experience and Past performance limit the number of competitors that will qualify for the contract award. Generally, the GSA requests a Maximum of 3 references, not a minimum. Why is the GSA reducing the number of companies that can bid on the contract?

a. Per Section M.4 of the RFP, in the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, failure of the offeror to provide a minimum of three relevant references, and/or the inability of the Government to complete a minimum of three reference checks, after making a reasonable effort to do so, will result in the offeror being rated as “neutral” on the past performance factor.

27. 2 Consecutive years of experience on each contract reference Number of years in Single project.

Why has the number of years of experience changed from the general 1 year of experience to two years for each required contract?

28. How does adding additional years demonstrate to the GSA the contractor’s ability to meet the service requirements?

29. A CPARS from the contractors on government contracts should fulfill the reference and service levels provided to the government.

a. Per Section L.2 of the RFP, in addition to those references provided directly by the offeror, the CO may identify and analyze the past performance of the offeror on any other relevant contract that they currently have or had of which the CO has knowledge or obtains knowledge, including but not limited to projects listed in the Contractor Performance Assessment Reporting System (CPARS).

30. Past Performance and Prior Experience in buildings over 500000 sq feet. Similar square footage requirement definition is not similar to the sq footage of the buildings in the contract. The Requirement limits the number of contractors that can compete on the contract due to the excess in sq. footage requested to be referenced in the past performance and prior experience. Why is the square footage requirement for each past performance reference so high given only one of the buildings exceeds 500000 sq feet net cleanable?

a. See answer to question #14.

31. Would the GSA consider referencing one building of 700000 sq. feet and up, another 300000 sq feet and an up and 50000 sq feet an up to be more similar to the buildings in the solicitation?

a. See answer to question #14.

32. After reviewing the job spec for the Janitorial Contract I do believe the Cleanable Square Footage for PVM is wrong. Please see the attached email and spec sheet which was corrected in 2020 because the wrong square footage was put out in 2017. Looks like a little over 70,000 sqft is missing which is 2 floors at PVM.

a. GSA has reverified the Cleanable Square Footage (CSF) for the McNamara Federal Building and is officially adjusted from 721,653 SF to 793,360 SF.

33. What is the cleaning frequency for each location and the days of the week?

a. The contractor shall have adequate staff onsite to accomplish cleaning within the contractor’s approved schedule during the days and hours for each location specified in Section C.1.2 of the RFP. The contractor shall also provide sufficient staffing and means to respond to service requests during the building(s) normal operating hours, stated on the Building Information Sheet in Exhibit J1.

34. Where can I find the scope of work?

a. The SOW is located in the attachment titled, “RFP 47PF0024R0007 Detroit Janitorial.”

35. What are the pre qualifications for this bid?

a. This procurement is an 8(a) set-aside, so you need to be a certified 8(a) firm.

36. In the RFP in sections management plan and staffing plan, it request a list of names for those employees. I would like to possibly keep the current staff and maybe add on staff as needed.

Could I just state that in my RFP? Because currently we do not have a list of names for the current staff employees under your current contract.

a. The incumbent, AmeriClean Janitorial Services Corp, can provide information regarding current employees (https://www.alliedns.com/contact-us). At a minimum, Project Manager and Supervisor names and resumes should be submitted as part of the initial proposal package, along with the planned number of personnel at each location.

37. With the many questions that have been submitted, what's the likelihood the RFP or notice will be amended?

a. Amendment 0001 has been posted.

38. If the RFP or notice is amended, this may change the contents of the proposals to be submitted, can the due date of proposals be moved forward?

a. The due date for proposals has been extended to 8:00 am EST on 12/12/2023. This is the latest that the RFP can be extended due to other affected milestones internal to GSA.

Please remember to email proposals to theodora.veresses-kohlweiss@gsa.gov AND tammi.ortiz@gsa.gov. Firms are responsible for submitting proposals so as to reach the Government office by the due date and time.

a. The incumbent is providing all services that are outlined in the present solicitation, i.e., janitorial services, grounds maintenance services, snow removal services and the typical subcontracted services.

41. Why are prospective incumbents being asked for financial statements?

a. Per FAR 9.104-1, “To be determined responsible, a prospective contractor must- (a) Have adequate financial resources to perform the contract, or the ability to obtain them.”

FAR 9.104-3 says, “Except to the extent that a prospective contractor has sufficient resources or proposes to perform the contract by subcontracting, the contracting officer shall require acceptable evidence of the prospective contractor’s ability to obtain required resources.”

42. Can partnering with other firms substitute the necessity of submitting financial statements of an individual firm?

a. For a prospective contractor that is a joint venture, the Contracting Officer (CO) will consider the financial condition of the joint venture. If the joint venture does not demonstrate adequate financial resources for award, the CO will consider the financial condition of each party to the joint venture.

43. Can site visits be arranged with the respective property managers, if site visits weren't made on the original date cited in the solicitation?

a. Private or make-up walk-throughs will not be scheduled, however, you're free to explore public areas of the facilities on your own time.

45. For the performance duties that are outside of the NAICS code for Janitorial/Custodial, can these be subcontracted out?

a. This is a performance-based solicitation, therefore, it is up to the contractor to determine how best to meet the requirements of the RFP.

46. Can we have a copy of the old solicitation, more specifically the RFP, in which the current incumbent gained the award? It is unretrievable on sam.gov (https://sam.gov/opp/1cbd93239967d54e8da9b5585269f89b/view)

a. GSA has provided the current overall annual and monthly price as a starting point, but the expectation is that proposals will be staffed and priced based on the requirements in the RFP and the vendor's expertise. This is a performance-based solicitation, therefore, it is up to the contractor to determine how best to meet the requirements.

118. Will the government provide a seniority list for CBA covered locations? The reason this is necessary is that for the Levin Courthouse, the CBA wage rate for an employee hired before November 1, 2010 is $26.44 per hour, and the wage rate for an employee hired after November 1, 2010 is only $19.60. This is a difference of $6.84 per hour per employee which will add a significant risk to bidders who are not privy to this information. The differential can be $14,227.20 per employee per year or $71,136 per employee over the life of the contract. If a contractor is not able to properly bid, they would still be required to pay the CBA accordingly, and by not having the seniority list, they will be forced to take undue risk.

119. Can the government please confirm the current yearly or monthly value of each site?

a. See answer to question #113.

120. Is there a cost for parking at the sites?

a. GSA does not provide parking for contractors at any of the locations. There is paid public parking available in the general area of each building.

121. Given the union rules, it seems like the requirement will be to extend the CBA and its corresponding rates to each location because they are under the same employer. How would the government like for the vendor to price the other facilities Cargo site and Rosa Parks FB ? With or without the CBA rates?

a. Nothing is precluding a vendor from extending CBA rates to all locations, however, that is an internal business decision.

122. Is a CMMS Gov system in place? Will the contractor use it?

a. Refer to Section C.1.1.

123. Theodore Levin US Courthouse: When was the last time the Marble floors were restored?

a. No, this reference would still be considered.

a. See answer to question #82. These are the only documents available from the union at this time.

142. Please provide current year contract amount.

a. See answer to question #65.

143. In section C.1.2 of the RFP, the working hours are defined as follows for the following buildings:

PVM, Cleaning shall take place no earlier than 6:00 a.m. and ending no later than 8:00 p.m., (Monday through Friday, excluding Federal holidays). Levin Courthouse, Cleaning shall take place between the hours of 6:30 a.m. and 10:00 p.m., (Monday through Friday, excluding Federal holidays). US Customs Cargo Facility, Cleaning shall take place between the hours of 5:00 a.m.

and 7:00 p.m., Monday through Friday, for a total of fourteen (14) hours daily. Rosa Parks, Cleaning shall take place between the hours of 6:00 a.m. and 4:30 p.m., (Monday through Friday, excluding Federal holidays), during which time the contractor must have adequate staff onsite.

Question - Can the government explain the rationale for cleaning hours for PVM and Levin Courthouse? Since much of the cleaning must be done after business hours, this small window of time i.e. 5:00pm - 8:00 pm for PVM and 5:00pm - 10:00pm for Levin Courthouse, necessitates a large number of part time workers. In our experience, relying on this many part time workers jeopardizes the reliability of service delivery. Can the exit hours be negotiated with the COR in order for the offeror to deliver full time work force and have the time needed to properly clean each building?

a. Amendment 0001 adjusted the cleaning hours for PVM from 6am-8pm to 6am-10pm. The final paragraph of Section C.1.2 remains unchanged: For all locations, the hours shall not be changed unless authorized by the CO or their designee. Contractor shall provide sufficient staffing and means to respond to service requests during the building(s) normal operating hours, stated on the Building Information Sheet in Exhibit J1. The performance of disruptive services, including, but not limited to, vacuuming, carpet shampooing, floor waxing, shall be scheduled with GSA and, if applicable, the tenant, for a time when the space is vacant or after normal building operating hours. Nighttime cleaning may be authorized, COR approval required.
